AMENDING ARTICLE I, IN GENERAL, OF CHAPTER 4,
ALCOHOLIC BEVERAGES, OF THE CODE OF ORDINANCES
OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO
PROHIBIT THE SALE, SERVICE OR CONSUMPTION OF
ALCOHOLIC BEVERAGES ON OR IN ANY PUBLIC PARK
OR MINIPARK IN THE CITY; PROVIDING A PENALTY
FOR FAILURE TO COMPLY HEREWITH; PROVIDING FOR
REPEAL OF ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF CLEARWATER, FLORIDA:
Section 1. Section 4-21 of Article I, In General, of Chapter 4,
Alcoholic Beverages, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby amended to read as follows:
Section 4-21. Consumption of alcoholic beverages in
public, prohibited.
It shall be unlawful, for any person to sell, service, dispense,
use, consume or drink any beer, wine or other alcoholic beverage
within the following laces:
(a) On or in any public beach;
(b) On or in any street, alley, sidewalk, parking lot or park
located within one hundred (100) feet of any public beach;
(c) On or in any street end fronting on the Gulf of Mexico
in the City of Clearwater; or
(d) On or in any public park or minipark in the City of Clearwater.
For the purposes of this section, the term "park" shall be
construed to mean all dedicated arks and athletic fields,
and all grounds used by. the City for park or plM round
purposes, but exclusive of an permanent structures erected
thereon at which alcoholic beverages are sold.
Section 2. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate or
fail to comply with the provisions of this ordinance shall be subject, upon
conviction, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00),
or imprisonment for not exceeding sixty (60) days, or by both such fine and
imprisonment.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.

Section 4. Should any part or provision of this ordinance be declared
by a court of -competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section S. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166.041, Florida Statutes. j`
Section 6. This ordinance shall become effective immediately upon
its passage.
