ORDINANCE NO. 1767
AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER, FLORIDA, 1978, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR THE REPEAL
OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on March 2, 1978, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 197811, as amended, is amended to
indicate that fact as hereinafter set out:
Zoned as ISP - Institutional Semi-.Public District
A. Begin at the NE corner of Section 16, Township 29
South, Range 15 East and run thence West along the
North line of said Section, 1320.0 feet; thence South,
along the West line of the East 1/2 of the NE 1/4 of
said Section 16, 1526, 16 feet to an inter section with an
Easterly projection of the centerline of Pierce Street;
thence N 89°450 W, along the centerline of Pierce Street,
418.0 feet to an iron stake set in a projection of the
West line of Osceola Avenue as extended across Pierce
Street; thence South 20.0 feet along this projection to
the SW corner of the intersection of Pierce Street and
Osceola Avenue; thence S 8804811211 W, along the Southerly
line of Pierce Street, 45.0 feet for P. O. B. ; thence
continue S 88°481121' W, 280.0 feet; thence S 0.19'551+ E,
147.96 feet; thence N 88.50'45" E, 325. 0 feet; thence
N 0019155" W, along the Westerly line of Osceola Avenue,
13.2 feet; thence S 88148112" IV, 45.0 feet; thence
N 0' 1915 511 W, parallel to Osceola Avenue, 135.0 feet
to P. O. B.

Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Any person, or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500.00), or imprisonment in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the discretion
of the Judge. Each day that a violation is permitted to exist shall constitute
a separate offense.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
