1766 r ORDINANCE NO. 1766 AN ORDINANCE SUPPLEMENTING ORDINANCE NO. 954 ENACTED NOVEMBER 26, 1962, AUTHORIZING THE CONSTRUCTION OR ACQUISITION OF AN INCINERATOR FOR THE CITY OF CLEARWATER FOR THE PURPOSE OF DISPOSING OF GARBAGE AND OTHER WASTE MATERIAL OF SAID CITY; AUTHORIZING THE ISSUANCE OF $1, 100, 000 INCINERATOR REVENUE BONDS TO PAY THE COST THEREOF; PROVIDING FOR THE RIGHTS OF THE HOLDERS OF SAID BONDS; PROVIDING FOR THE METHOD OF PAYMENT OF SAID BONDS; PROVIDING FOR NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Authority for This Ordinance. This Ordinance is adopted pursuant to the provisions of Chapter 166, Part II, Florida Statutes, and other applicable provisions of law. Section Z. Findings. It is hereby found and determined as follows: A. The City authorized $1, 100, 000 of Incinerator Revenue Bonds in 1962 (sometimes hereinafter referred to as the "Bonds"), of which $3Z7, 005 in principal amount are still outstanding, and not covered by reserve deposits; B. Ordinance No. 954 authorizing the issuance of said Incinerator Revenue Bonds provides that garbage disposal rates shall be sufficient to cover operation and maintenance cost and debt service requirements, including sinking fund and reserve payments; C. Historically, the Sanitation Division has always provided sufficient revenue to meet all debt service requirements, but has relied on other revenues of the City to meet operation and maintenance expenses; D. Section 3.04 (B) requires the City in each year the Incinerator Revenue Bonds are outstanding to budget annually amounts sufficient to pay principal of and interest on the Bonds as such amounts come due without deduction or credit against said annual appropriations for revenues derived from the operation of the City's Garbage Disposal System; and E. The City deems it desirable in keeping with Section 3.04 (B) to secure the Bonds by an irrevocable pledge (subordinated and junior to the City's. Section 3. Covenants. For so long as any of the Incinerator Revenue Bonds are outstanding, the City covenants and pledges that all of the Bonds shall be henceforth additionally secured equally and ratably by a pledge of and lien on the Utilities Services Taxes levied and collected by the City to the extent available provided, however, that such pledge and lien in favor of the holders of the Bonds shall be junior and subordinate to the pledge thereof and lien thereon in favor of the holders of the City's outstanding Bridge Bonds, Utilities Tax Bonds, and any and all obligations hereafter issued payable and ranking on a parity therewith from the Utilities Services Taxes; provided, further, nothing herein shall grant to any holder or holders of any Bonds the right to compel the exercise of the ad valorem taxing powers of the City or taxation in any form on any real or personal property herein to pay said Bonds or the interest thereon. Section 4. This instrument to Constitute Contract. This Ordinance shall be deemed to be and shall constitute a contract between the City and the holders of the Bonds. The covenants and agreements set forth herein to be performed by the City shall be for the equal benefit, protection and security of the legal holders of any and all of the Bonds and the coupons attached thereto, all of which shall be of equal rank and without preference, priority or distinction of any of the Bonds or the coupons over any others thereof except as expressly provided herein. Section 5. Severability of Invalid Provisions. If any one or more of the covenants, agreements or provisions herein contained shall be held contrary to any express provision of law or contrary to the policy of express law, though not expressly prohibited, or against public policy, or shall for ;:•?.?rd:?1766.? , . , u e>: ?? • ..1y.?1?y,,T ..[717 ! (4/6/78 i , any reason whatsoever be held invalid, then such covenants, agreements or f provisions shall be null and void and shall be deemed separate from the remaining covenants, agreements ox provisions and shall be deemed separate from the covenants, agreements or provisions of Ordinance No, 954 and shall in no way affect the validity of any of the other provisions hereof or thereof or the Bonds or coupons issued thereunder. Section 6. Notice of Proposed Enactment. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Chapter 166. 041, Florida Statutes. Section 7. Effective Date.
