WHEREAS the City of Clearwater possesses a unique environment
and quality of life associated with that environment; and
WHEREAS, the City of Clearwater has engaged in extensive planning
and the development of laws to protect such environment and quality of life; and
WHEREAS, it is necessary to strengthen and support the zoning code
as one vehicle to protect and preserve the quality of life presently existing
within the City; and
WHEREAS, the violation of such Zoning Code poses n potential threat
to continued community planning efforts; and
WHEREAS, on February 16, 1978 , the City Commission of the
City of Clearwater, after proper public notice, held a public hearing on
certain proposed changes to the zoning ordinance of the City of Clca rwater ,
in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning ordinance were approved by the City Commission after its evaluation
of all evidence presented at the said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. Section 1. 03, Purpose, of Article I, Title, Authority,
Purpose, Enactment, Jurisdiction, of Appendix A, Zoning, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to
read as follows;

Section 1. 03. Purpose and Enforcement Declaration.
The purpose of the ordinance is to promote the health,
safety, morals, general welfare and quality of life of
the City of Clearwater, and to guide the orderly develop-
ment of the city.
The City Commission of the City of Clearwater, Florida
further finds and declares that any violation of the provisions
and standards set out in this zoning code shall constitute an
irreparable injury to the citizens of the City of Clearwater,
and the City of Clearwater acting on behalf of its citizens
shall have authorit to seek injunctive relief to terminate or
prevent any violation of this zoning code.
Section Z. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 0+41, Florida Statutes.
Section 5. The provisions of this ordinance shall take effect
immediately upon its passage.
