AN ORDINANCE AMENDING SECTION 35.07, PROCEDURE
FOR AMENDING ZONING ORDINANCE, OF ARTICLE XXXV,
ADMINISTRATION AND ENFORCEMENT, OF APPENDIX A,
ZONING, OF THE CODE OF ORDINANCES OF THE CITY
OF CLEARWATER, FLORIDA, 1962, TO PROVIDE FOR THE
CITY CLERK TO PUBLISH ONE NOTICE OF ANY PUBLIC
HEARING TO BE HELD BEFORE THE PLANNING AND ZONING
BOARD OR CITY COMMISSION IN CONSIDERATION OF A
ZONING AMENDMENT AT LEAST TEN DAYS, BUT NOT MORE
THAN FORTY-FIVE DAYS IN ADVANCE OF SUCH HEARING
IN A NEWSPAPER; TO PROVIDE THAT THE CITY CLERK
SHALL NOTIFY FROM THE LIST PROVIDED BY THE APPLICANT
ALL PROPERTY OWNERS WITHIN THE AREA FOR WHICH A
PROPOSED CHANGE IN THE ZONING MAP HAS BEEN REQUESTED
OR FOR WHICH ANNEXATION AND INITIAL ZONING IS PROPOSED,
TO PROVIDE THAT THE CITY CLERK SHALL BE REQUIRED
TO NOTIFY ALL PROPERTY OWNERS WITHIN TWO HUNDRED
FEET OF ANY PROPERTY ON WHICH A PROPOSED CHANGE
IN THE ZONING HAS BEEN REQUESTED EXCEPT WHERE SUCH
CHANGE INCLUDES MORE THAN THIRTY SEPARATE PROPERTY
OWNERS WITHIN SUCH TWO HUNDRED FOOT DISTANCE, THEN NOTICE
SHALL BE PROVIDED BY PUBLISHING IN A NEWSPAPER ON
TWO SEPARATE OCCASIONS, WITH THE FIRST AT LEAST
FOURTEEN DAYS PRIOR TO THE DATE OF HEARING; TO
PROVIDE FOR THE POSTING OF NOTICE OF PUBLIC HEARING
REGARDING A PROPOSED ZONING CHANGE ON THE SUBJECT
REAL PROPERTY FOR A PERIOD OF NOT IE SS THAN FIVE DAYS
IN ADVANCE OF THE HEARING, EXCEPT WHERE SUCH POSTING
OF INDIVIDUAL PARCELS WOULD INVOLVE MORE THAN TEN
SEPARATE PARCELS, THEN THE AREA PROPOSED TO BE
RECLASSIFIED OR ANNEXED SHALL BE IDENTIFIED BY NO

WHEREAS, certain of the proposed changes and amendments to the
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Sub-section (5), Public Notice and Public Hearing, of

City of Clearwater, after proper public notice, held a public hearing on
certain proposed changes to the zoning ordinance of the City of Clearwater
in accordance with procedure as established; and
zoning ordinance were approved by the City Commission after its evaluation
of all evidence presented at the said public hearing;
Section 35. 07, Procedure for Amending Zoning Ordinance, of Article XXXV,
Administration and Enforcement, of Appendix A, Zoning, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby amended
to read as follows:

to be reclassified on the zoning map, or the area to be annexed
and classified on the zoning map, shall be identified by no less_

at the perimeter of the area, in addition to which there shall
be a minimum of one (1) posted notice der each five (5 acres
included within the area proposed to be amended, in combination
with publishing notice of the hearing in a newspaper of general
circulation in the city on two (2) separate occasions, with the first
of such two (2) notices published at least fourteen (14) days prior
to the date of the hearing.

(f) The ublication and hearing re uiremente rovided in this
sub-section (5) are to be construed as being separate and
& part from the requirements imposed with res ect to the
consideration and passage of a zoning ordinance.
Section 2. All ordinances or parts of ordinances in conflict harewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance,be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.

Section 4. Any person, or-persons, firm or corporation or association
W
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500.00), or imprisoned in Sail for not
exceeding sixty (60) days or by both such fine and imprisonment in the
discretion of the Judge. Each day that a violation is permitted to exist
shall constitute a separate offense.
Section B. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 7. The Provisions of this ordinance shall take effect
immediately upon its passage.
