ORDINANCE NO. 1741
No. 1711 established a toll classification and token system for the Clearwater
Pass Bridge; and
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING ARTICLE 11, OPERATION OF VEHICLES, OF
CHAPTER 22, TRAFFIC, OF THE CODE OF ORDINANCES
OF THE CITY OF CLEARWATER, FLORIDA, 1962, BY
AMENDING THE CLEARWATER PASS BRIDGE TOLL
SCHEDULE TO INCLUDE A CLASSIFICATION FOR MOTOR-
CYCLES AND MOPEDS; TO PROVIDE THE NUMBER OF
TOKENS WHICH MAY BE PURCHASED FOR ONE DOLLAR;
TO PROVIDE FOR THE SALE AND REDEMPTION OF TOKENS;
TO PROVIDE FOR THE USE OF TOKENS BY CERTAIN
VEHICLES; TO SET UP A REPORTING PROCEDURE TO BE
USED BY EACH EXEMPT VEHICLE CLASSIFICATION;
PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER
NOTICE OF PROPOSED ENACTMENT; AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE,
WHEREAS, the City Commission through the passage of Ordinance
WHEREAS, the toll classification and token system inadvertently
omits the user class of motorcycles and mopeds from the rate classification
system; and
WHEREAS, the inclusion of motorcycles and mopeds in the established
class of two-axle vehicles is deemed appropriate; and
WHEREAS, the City Engineer hereby certifies that the net revenues to
be derived in the current and in each succeeding year, after giving effect to such
changed rates of tolls and other charges, will be sufficient in each future
year to produce net revenues equal to one hundred per centum (100%) of
the average annual amount of Bond Service Requirements which will become due
in such years on all outstanding 1977 Bonds as required in Section 15E of
Ordinance No. 1701; and
WHEREAS, the implementation of the token system requires the
establishment of a token rate; and
WHEREAS, analysis of the token system has demonstrated that a
change is required in the number that will be offered;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. Section 22..81, Clearwater Pass Bridge Toll Schedule,
of Article 11, Operation of Vehicles, of Chapter 22, Traffic, of the Code of
Ordinances of the City of Clearwater, Florida,, 1962, is hereby amended to
read as follows=
Section 22-81. Clearwater Pass Bridge Toll Schedule.
The following rates are hereby adopted for the use of Clearwater
Pass Bridge:
Vehicle Toll Class Description
Two-Axle Vehicles (Including motorcycles
and mopeds)
Two-Axle Vehicles (Including motorcycles

The rate schedule established herein shall not be revised except
in the manner provided by Section 15E of Ordinance No. 1701
of the City of Clearwater, Florida.
The City Manager or the Chief of Police of the City of Clearwater,
or their designee, are hereby authorized' to waive the tolls established
herein when in the exercise of their discretion it is determined that
such waiver is necessary to complete any emergency evacuation of
Clearwater Beach or Sand Key.
Section 2. Article II, Operation of Vehicles, of Chapter 22, Traffic,
of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended by enacting new Sections 22-82, 22-83, 22-84 and 22-85 to read
as follows:
Section 22-82. Sale of Tokens and Redemption of Tokens.
The Finance Director of the City of Clearwater shall be
responsible for obtaining and selling the tokens authorized
by Section 22-81 of the Code of Ordinances. The City Manager
shall determine the place or places within the City of Clearwater
where such tokens will be sold and shall establish regulations
relating to the sale and distribution of the tokens.
The City of Clearwater shall have no obligation to repurchase
any of the tokens sold in the manner provided herein.

Section 22-83. Use of Token System,

Section 22-84. Exemption Application and Records.
The 'Finance Director of the City of Clearwater is authorized
to develop a Clearwater Pass Bride Exemption Application to
be completed b all affected Bridge usero asspecified in Section .,• ?`f =
22-81 (excluding pedestrians). The exemption provided in Section
22-81 shall not be effective until such application is completed
and approved h the Finance Director. Such application shall
specify the reasonable identification procedure to be utilized b

Clearwater Pass Bridge personnel in granting toil exempt use
of Clearwater Pass Bridge and recording same to the appropriate r ?n ..
user class and benefiting agency. Such exempt user reports shall
be maintained by Bridge personnel and submitted periodically to
the Finance Director.
Section 3. All ordinances or parts of ordinances in conflict herewith

Section 4. Should any section, paragraph, sentence or word of this
ordinance be declared for any reason to be invalid, the same shall not i

affect the validity of the ordinance as a whole, or any part thereof other ,y
than the part declared to be invalid.

Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 6. This ordinance shall become effective immediately upon ,
its passage.
