ORDINANCE NO. 1740
AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1977, AS
AMENDED, BY RECLASSIFYING AND ZONING CERTAIN
PROPERTY AS DESCRIBED HEREIN; PROVIDING FOR
REPEAL OF ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY OF
THE PROVISIONS HEREOF; PROVIDING PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING
FOR PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE,
WHEREAS, on November 3, 1977, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established, which said hearing was thereupon continued"?
until November 17, 1977; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the said continued public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 197711, as amended, is amended to
indicate that fact as hereinafter set out:
zoned as RS-60 - Single Family Residential District

Commence at the SE corner of Section 19, Township 29 South,
Range 15 East, Pinellas County, Florida; thence N 89.04107" W,
along the South boundary of said Section 19, 2235, 08 feet to a
point on the East right-of-way line of the South approach to the
bridge across Clearwater Pass, said point being N 31'58'2011
E of and 603. 33 feet from a point of tangency on the said East
right-of-way line, thence N 31.58120" E, along the said East
right-of-way line, 276.62 feet; thence S 89.0410711 E, 345.47
feet for a P. O. B.; thence N 31.581201' E, along a line 346.00
feet Southeasterly of and parallel to the center line of the South
approach to the bridge across Clearwater Pass, 120.62 feet to
a point of curvature; thence on an arc to the right of 71.97 feet,
with a radius of 70.00 feet, subtended by a chord of 68. 85 feet,
chord bearing N 61.25140" E, to a point of tangency; thence
S 89.0710011 E, 701.23 feet; thence on an arc to the left of 43.74
feet, with a radius of 150. 00 feet, subtended by a chord of 43. 58

Section 7. The provisions of this ordinance shall take effect immediately
upon its passage.

to a point of tangency; thence N 3105812011 E, along a line 746.00
feet Southeasterly of and parallel to the center line of the South
approach to the bridge across Clearwater Pass, 71.65 fact to
the P. O. B. ; containing 6. 54 acres, more or less.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Any person, or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500, 00), or imprisonment in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the discretion
of the Judge. Each day that a violation is permitted to exist shall constitute
a separate offense.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 6. -The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
