ORDINANCE NO. 1739
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
- ` REPEALING SECTION 14-44. 1, HYPODERMIC SYRINGE1
POSSESSION, SALE, OF CHAPTER 14, OFFENSES AND
MISCELLANEOUS PROVISIONS, OF THE CODE OF ORDINANCES
OF THE CITY OF CLEARWATER, FLORIDA, 1962;
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR THE PROPER NOTICE OF
PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE,
WHEREAS, the City Commission of the City of Clearwater, Florida,
has reviewed the necessity for Section 14-44. 1 of the Code of Ordinances
relating to hypodermic syringes; and
WHEREAS, the City Commission finds that such code requirement
is no longer necessary and in fact creates a problem or a hindrance to those
persons properly obtain'i'ng a syringe; and
WHEREAS, the City Commission believes that it would be in the
best interest of the citizens of the City of Clearwater if such code provision
was repealed;
NOW, THEREFORE, BE IT ORDAINED BY THE, CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 14-44. 1, Hypodermic syringe; possession,
sale, of Chapter 14, Offenses and Miscellaneous Provisions, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed in
its entirety.
Section 2. Should any section, y , paragraph, sentence or ward of this
ordinance be declared for any reason to be invalid the same shall not affect
the validity of the ordinance as a whole, or any part thereof, other than the
part declared to be invalid.
Section 3. Notice of the proposed enactment of this ordinance has,
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes. .
