THE EXECUTION OF SUCH WRITTEN AGREEMENTS; TO PROVIDE FOR A RESOLUTION BY MEDIATION IF AN IMPASSE IS REACHED; TO PROVIDE FOR ARBITRATION OF IMPASSE ISSUES INCLUDING REFERRAL TO A HEA RING PANEL AND THE CRITERIA THEREFOR; PROVIDING PENALTIES FOR THE VIOLATION HEREOF; PROVIDING FOR THE SEPARABILITY a OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT i HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE,' WHEREAS, there exists within or on the boundaries of the City of Clearwater a significant number of Mobile Home Parks estimated to be twenty- nine (29) in number, and a significant number of residents residing in such Parks, estimated at 5, 500 persons; and WHEREAS, it has been determined that mobile home residents do not truly occupy an equal negotiating or bargaining position in relation to mobile home park owners when negotiating as to proper park rules and regulations, park services and maintenance standards and the other terms to be included in leases to be offered to the residents; and 1724 4; v 4/20/78. Iq on or' WHEREAS, it has been determined that mobile home owners residing in such park occupy a unique position as it pertains to the security of their investment in their mobile home unit for in no other type of housing does the resident have as significant an investment as does the mobile home resident and in no other type of housing is that investment so subject to being lost or materially damaged due to unilateral decision of a landlord, and only very recently has any protection existed at law for the mobile home owner and even the present statutes give the mobile home owner but basic minimal safeguards; and WHEREAS, it has been determined that any negotiating position enjoyed by a resident in a mobile home park is eroded to a significant degree when the mobile home owner has a substantial investment in the unit occupying the lot, the removal of which would cause a severe economic hardship for the mobile home owner, and the desire of the mobile home owner to attempt meaningful negotiations with the park owner is, therefore, discouraged because of the fear of possible reprisals; and WHEREAS, it has been determined that the practice used by mobile home park owners of limiting acceptance to the park of other than new mobile homes practically precludes the relocation of a mobile home in a similar park area within a reasonable location and at a reasonable expense; and WHEREAS, it is necessary to complement present Florida statutes relating to the relationship between mobile home park owners and mobile home residents; and WHEREAS, due to the number of people residing in such parks, due to age of a majority of such residents, due to their limited or fixed means of support of such residents, due to the lack of readily available park sites to move to or from at will, and due to the impact that can occur to the City of Clearwater from the displacement and dislocation of such residents, the City Commission finds that the police power should be exercised to preserve both the safety and welfare of such residents and the City of Clearwater; :yard: '# 1724 '??sta ?f','f 5y•a F>t?',•;,^? r•i;i?•.? :-?_ "Jli.tiikj:.,s:J: •,.•. :'?Y ??cr" i ? :? ?? =•? ?+-,"?f'?? !'" :? The Code of Ordinances of the City of Clearwater, Flo rida, % "r. . ? • v s 04 Xp ? 1? •,1' rr \ y 1962, is hereby amended to enact a new Chapter 3A relating to Mobile Home lr• , F .• ?'' s';;, Parks to read as follows; °_;' ;f'F ,, Chapter 3A. Mobile Horne Parks. Section 3A-1. This ordinance shall be known as the Mobile Home Park Ordinance. ;' Section 3A-2. Application. This Code is a Mobile H0 me Park Code designed to provide minimum standards to establish and govern both the responsibilities of mobile home park owners and mobile home residents of such parks in order to preserve and :r'u -': improve the economic and aesthetic values of such parks and thereby prevent the deterioration of all mobile home parks "F'r ' located within the City of Clearwater, Florida. Section 3A-3. Definitions. Unless a different meaning clearly appears in the context, the following terms shall have the following meanings: (a) Mobile Home Park. Any area, tract, site, or plat of land whereupon mobile homes as herein defined are placed, located, or maintained solely for residential purposes, or intended to be placed, located, or main- tained, and shall include all accessory buildings used or intended to be used as part of the equipment thereof. (b) Mobile Home Park Resident. The person or persons owning a mobile home unit occupying a mobile home lot within a Mobile Home Park or area where ten (10) or more mobile home units are located and paying rent or other consideration to the mobile home park owner(s). (c) Mobile Home Lot or Space. A plot of ground within a mobile home park which is designed for and designated as the location of one mobile home and its appurtenances and not used for any other purposes whatsoever other than the customary accessory use thereof. (d) Mobile Home Park Owner. An owner, lessor, sub-lessor, assignee or other person receiving or entitled to receive rent or other consideration for the use and occupancy of any mobile home lot, or an agent of any of the foregoing. (e) City. The City of Clearwater, Florida. (f) Negotiating Units. A group of residents within any individual mobile home park who has voted that the mobile home park desires to be represented by a negotiating agent and who has filed the statement required under Section 3A-8 (b) herein. (g) Mobile Home. A resident of a mobile home park who has been selected by the other members of the negotiating unit to represent the negotiating unit in negotiations with the mobile home park owner. (i',J Board. The Mobile Home Park Board created hereunder to administer the terms of this Ordinance. r Section 3A-'4. Mobile Home Park Board. , (a) There is hereby created the Mobile Home Park Board which shall have the duties and responsibilities as hereinafter set forth. (b) Composition. The membership of the Board shall consist of seven (7) members, all of whom shall be residents of the City of Clearwater. The membership of the Board shall consist of two (2) mobile home park owners and two (2) mobile home park residents to be appointed to the Board by a majority vote of the City Commission. In the event that the mobile home park owners' representatives or the mobile home resident representatives selected for appoint- ment by the City Commission refuse to accept such appointment or having accepted such appointment fail to attend and participate' in two (2) consecutive meetings, then, the City Commission may ' appoint different members where the appointments have been refused or may declare the membership position or positions vacant by reason of absence or failure of participation and appoint a successor member or members to serve the unexpired term. Where the appointment has been refused or where the position has been declared vacant, the City Commission shall not be limited in making a new appointment to mobile home park owners or mobile home park residents. Upon appointment, the park owner members and resident members, or such other member or members as the City Commission shall appoint, shall appoint three (3) other residents of the City of Clearwater to the Board. In the event that the owner and resident members are not able to agree upon three (3) other appropriate members, they shall so report to the City Commission, which shall then select such members. In the initial appointment, one of the park owner members, one of the park resident members and one of the public resident members will be appointed for an initial term of one (1) year. All subsequent appointments shall be for two (2) year terms or the remainder of an unexpired term created by resignation a other vacancy. The members of the Board shall hold office for a term of two (2) years and shall serve without compensation. (c) Organization. At its first meeting, the Board shall have, the authority to adopt such Mules of Procedure as required in order for it to conduct its duties hereunder. (d) Purposes, Duties and Responsibilities. In addition to the duties set forth above, the Board shall additionally have the following duties in the appropriate s { circumstances; , s>"; (1) To accept written complaints relating to the terms 3 of park rules and regulations, park maintenance ] ?:. standards and the terms and conditions of park . . !; leases except rents being charged; to conduct hearings concerning the allegations contained in said complaints, to request the attendance of park owners and residents in order to fully investigate , and explore the allegations contained in the said complaint, to make recommendations to park owners and residents concerning the resolution of matters x contained in these complaints, to make findings of fact concerning undesirable conditions existing in parks or to make findings that the complaint so filed is unwarranted and unreasonable, to make public reports concerning its recommendations and findings and to monitor corrective actions or remedial procedures. (2) To conduct an ongoing reviewof conditions in the mobile home parks in the City of Clearwater regarding (a) availability of rental spaces, (b) the effect of changes in park ownership on park conditions, (c) the existence or non-existence of resident hardship due to park conditions, (d) any evidence of the existence or the non-existence of emergency conditions within the various mobile home parks, (e) the availability of spaces or lots for mobile homes and appurtenances, and (f) costs associated with removal of mobile homes to alternativet park,tareas. (3) To review upon request the annual leases offered to tenants by mobile home park owners as to the reason- ableness of the terms of such leases and to determine the availability to the individual residents of an opportunity to bargain with the park owner regarding the resident's desires and the presence or absence of meaningful negotiations between park owners and park residents. S a ,F r (4) To conduct mediation or binding arbitration proceedings to resolve disputes between park owners and park residents upon the written consent of both parties to such mediation or binding arbitration. Where the parties consent to arbitration such consent shall include consent that the arbitration be conducted using the Florida Arbitration Code as set forth in Chapter 68Z of the Florida Statutes. Appeal by either party from the arbitration proceedings shall be that provided in Section 682. Z0, Florida Statutes. Section 3A-5. Mobile Home Residents--Organization and Representation. (a) Right to Organize. Mobile home owners residing in mobile home parks located within the City of Clearwater shall have the right to form, join and participate in collective negotiating organizations. (b) Right to Representation. Mobile home park residents shall have the right to be represented by a negotiating agent and negotiate collectively with their mobile home park owner in the determination of the terms and conditions that will exist within the mobile home park relating to park rules, park maintenance standards, and the term of park lease. Mobile home owners shall also have the right to refrain from exercising the right to be represented in negotiations with the mobile home park owners. Questions relating to rentals or service charges are subject to the exclusive jurisdiction of the State Mobile Home Tenant- Landlord Commission. (c) Nothing in this Chapter shall prohibit or prevent a mobile home owner from presenting, at any time, his own grievance in person or by legal counsel or from negotiating individually with mobile home park owners without the intervention of any negotiating agent. Section 3A-6. Selection of Negotiating Agent. Each mobile home park shall, by vote of all lot residents in the park (1 vote per lot), determine whether or not the mobile home park desires to be represented by a negotiating agent in negotiations with the mobile home park owner. Upon request of residents occupying twenty per cent (2016) of all lots in the mobile home park, an election shall be held within the park in accordance with the procedure established by the Mobile Home Park Board for the conduct of such elections. The election shall be supervised by the Board and shall be by secret ballot. An election to determine whether or not the mobile home park desires to be represented by negotiating agents shall be conducted not more often than annually and in the event that the vote of the majority of the lots voting is to the effect that the park does not desire to be represented, another election shall not be held until at least one year from the date of the first election. -6- 4/20/78 'r ! ?i i '• ': • ?'•? r? Upon the determination that a park desires to be represented by a negotiating agent in negotiations with the mobile home park owner, all persons desiring to participate in the selection of a negotiating agent shall sign a statement to that effect and file it with the Mobile Home Park Board and that group shall be identified as the negotiating unit for that park. The Board shall determine appropriate procedures for the execution and filing of the said statements. The negotiating unit shall select by secret ballot three (3) persons to act as negotiating agents for the residents of the park concerned, each person to be selected by a majority of the negotiating unit. (c) Registration and Certification of Negotiating Agents. The three (3)negotiating agents for each park shall register with the Mobile Home Park Board by filing with the Board, in affidavit form, a statement certifying that they have been selected to act as negotiating agents for a particular park in accordance with the rules of the Board and the procedures set forth in this Chapter. (d) Copy to Park Owner. A copy of the registration affidavit shall be sent to the mobile home park owner by certified mail, return receipt requested, by the r Board, and unless a response is received from the mobile home park owner within thirty (30) days from the trans- mittal of the registration affidavit, the negotiating agents shall be certified by the Mobile Home Park Board as being entitled to represent the park in negotiations with the park owner. if a response is received from the park owner or from any resident of the park denyi=ng certification is appropriate for the negotiating agents, the Board shall set a hearing on the appropriateness of the certification of the negotiating agents forthwith and shall decide the propriety of such certification. The decision of the Board shall be final and binding on all parties. (e) Filing of Pledge. Upon certification, the negotiating agents will file a pledge with the Mobile Horne Park Board that the agents will conform to the laws of the State of Florida and to the provisions of this Chapter and that they will represent the members of the negotiating unit fairly and without regard to age, race, sex, religion, or national origin: (f) Compensation Affidavit. Each negotiating agent will file with the Mobile Home Park Board a statement, in affidavit form, certifying that no compensation or remuneration of any type has been received from any source arising from his position as a negotiating agent and that he is a resident in the park that he represents. Section 3A-7. Collective Negotiations. (a) Negotiations. After negotiating agents have been certified by the Board, pursuant to the provisions- of this Chapter, the negotiating agents and the mobile home park owner or his agent jointly shall negotiate collectively, upon the written request of either party, in the determination of the matters set forth in Section 3A-5 (b) of this Chapter. IV" Ti 1, 0,- ° @,?? • K concerning leases shall, at 'minimum, concern all provisions concerning any financial obligations of the mobile home owner and at least those provisions required by Florida Statute, No party shall be required or expected to negotiate the same issue or substantially the same issue unless a change in circumstances has occurred or unless a new lease is being considered or has been offered to the park mobile home owners. (b) Previous Agreements. The provisions of this Chapter shall not affect or invalidate any reciprocal lease or rental agree- ment entered into prior to the effective date of this Chapter nor shall the provisions of this Chapter be interpreted to interfere with any contractual relationships in existence at the time of the passage of this Chapter. (c) Agreements Reduced to Writing. Any park rules and regulations or park maintenance standards or terms of any lease which are agreed upon between the negotiating agents and the park owner shall be reduced to writing and copies thereof shall be signed by the parties indicating such agreement and filed with the Mobile Home Park Board and the City Clerk. (d) Execution. Upon agreement being reached between the parties concerning lease terms, the agreed upon lease shall be offered for execution to the members of the negotiating unit and upon execution by the said members of the negotiating unit, the lease''shall also^be executed by the park owner. The failure of any member of the negotiating unit to execute the lease shall not change or modify any of that individual's rights then existing under the provisions of Florida Statutes nor shall this Chapter be interpreted to require the execution of the offered lease by any mobile home park resident. Section 3A-8. Emergency--Collective Negotiation. (a) Finding by Board. If, during the process of its continuous review of mobile home park conditions, the Board determines that in its opinion a condition exists regarding (1) park rules and regulations, (2) park maintenance standards or (3) the terms and conditions of the lease, excluding rent, and the duration of the term of the rental agreement or lease agreement, and that the condition cannot be dealt with effectively by the ordinary operations of the private mobile home housing market, voluntary collective negotiation or through enforcement L: the provisions and remedies contained in Part III of Chapter 83 of the Florida Statutes, the Florida Mobile Home Landlord and Tenant Act, and.that the existing condition will produce a serious threat to the public health, safety and general welfare of the citizens of Clearwater, Florida, the Board may find that a severe emergency condition exists in the mobile home market warranting the institution of emergency collective negotiating rights as set forth in this ordinance. V 4W S (1) That the vacancy rate for available rental mobile k home parks within the City of Clearwater is five per cent (57o) or less, or that available mobile home sites for existing owned mobile homes is four per. cent (4%) or less or that park restrictions unrelated to human habitation standards create a shortage of mobile home sites suitable for providing adequate housing in the City of Clearwater. (2) That an inequitable or unreasonable condition exists regarding ark standards and regulations or park maintenance standards or the terms of park leases } _ - and that the park resident does not occupy, a reciprocal negotiating position to negotiate a change in the situation. No showing need be made that every judicial remedy has been exhausted, although available remedies offered by the park owners shall have been ¢t?' exhausted by the residents. (3) That due to some existing condition in the park, the mobile home owners investment is subject to deterioration or loss because of an unilateral decision of the park owner or the fear of reprisals from park owners has eliminated the possibility of reciprocal negotiations between the park owners and park residents. (b)Resolution Considered by City Commission. Upon transmittal of a report provided to the City Commission containing a finding that an emergency condition exists regarding mobile home parks within the City of Clearwater, Florida, and detailing the extent and the conditions of such emergency, the consideration of a resolution implementing the provisions of this chapter shall be scheduled as an agenda item for the next regular meeting of the City Commission. At the meeting at which the resolution is to be considered, a public hearing shall be conducted by the City Commission concerning the existence of emergency conditions. The City Clerk shall cause the notice of the consideration of such resolution to be placed in a newspaper of general circulation within the City of Clearwater at least three (3) days before the meeting at which thepublic hearing is to be held and at which the resolution is to be considered. Following the public hearing, the City Commission shall consider the resolution, which resolution shall contain a finding that an emergency condition exists, and if such resolution shall be passed by the City Commission, Sections 3A-9 and 3A-10 of this Chapter ' shall become initially available, effective and operative upon stiuplation of issue(s), until such effectiveness is - rescinded by further resolution of the City Commission. Section 3A-9. Impasse--Resolution by Mediation. (a) Impasse. If the parties are unable to negotiate the terms of the lease, park rules and regulations, or park maintenance standards sixty (60) days after commencement of negotiations, or if an emergency condition has been determined by the City Commissiaii to exist, an impasse shall be deemed to have occurred. Prior to submission of an impasse to mediation, the parties shall meet together for the purpose of stipulating issues in dispute and said stipulation shall be filed with the Board. Upon submission of the stipulation concerning an,impasse being submitted to the Board, the Board shall forthwith notify the parties of the time and place of a hearing to consider the impasse issue(s). All hearings before the Board shall be public and it shall be the function of the Board in the mediation procedure to bring the parties together as will tend to effectuate the settlement of the dispute. Nothing in this section shall prevent the parties .,from. mutually selecting their own mediator. The mediation hearing will be conducted on an informal basis and under such rules of procedure as are deemed desirable by the Board. Following the close of the mediation hearing, the Board shall meet and review all of the matters presented and shall expeditiously prepare a recommended solution to the impasse, which recommendation shall be submitted to both parties. Upon receipt of the Board's recommendation, the parties shall again meet and attempt to resolve the dispute. In the event that either the negotiating agents 'or'the, park owner do not accept in whole or part the recommendations of the Board, the party rejecting the recommendation shall notify the Board and the other parties within fifteen (15) days of the transmission of the Board's recommendation that the impasse has not been resolved and shall specify the unresolved issues. Section 3A-10. Arbitration of Impasse Issues. (a) Referral to Hearing Panel. Upon receipt of a notice from either party that the impasse has not been resolved, the Board shall notify both parties that the submission to a hearing panel for the resolution of the impasse is necessary. The Board shall set a time for the hearing panel to consider the impasse, such time to be not more than thirty (30) days from the date of rejection of the Board's recommendation. Upon receipt of such notice from the Board, the parties shall meet and shall select a hearing panel. (b) Selection of Hearing Panels. The parties shall select a hearing panel to hear the impasse issues. Each party shall select one (1) hearing officer and the two (2) hearing officers selected shall select a third and these three (3) individuals shall act as the hearing panel. In the event that the hearing officers selected by the parties are not able to agree upon a third hearing officer, they shall so notify the persons selecting them and the parties shall select two. (2) other individuals. In the event that either party fails to select a hearing officer in ten (10) days of being notified that such selection is necessary by the Board, the Board shall have the right to select a hearing officer to represent that party. Upon appointment, the hearing panel shall notify the interested parties of the time and place of the hearing, the time being during the thirty day period from the date of rejection, the hearing shall be conducted on an expedited basis. Compliance with the judicial rules of evidence shall not be required and the hearing shall be conducted as the hearing panel deems proper to provide full administrative hearing to both parties. (c) Issues for Consideration. The hearing panel shall lirnit its deliberations to the issues submitted by the parties. No finding or recommondation of hearing panel shall conflict with or prohibit the park owner from malting managerial decisions consistent with the recognized standard practices for the administration of mobile home parks. (d) Decision of Hearing Panel. Following the close of the hearing, the panel shall review and consider all of the relevant evidence which has been presented and any oral or written argument provided by the parties. The hearing panel shall expeditiously prepare a decision containing its findings and conclusions and shall forward a copy of such decision to both parties and shall file a copy with the Mobile Home Park Board and with the City Clerk. The hearing panels' decision shall be final and shall be binding on all parties. The parties shall forthwith undertake any necessary action to implement the decision of the hearing panel and failure to do so shall be deemed a violation of this Chapter which shall result in ' ! revocation of the mobile home park owner's license to operate a mobile home park in the City of Clearwater or -removalI:df the mobile home resident from the mobile home park. (e) Records--Public. All records of the Board and hearing panel, including the reports of its recommendations, shall be open for inspection by the public. Section 2. Any person, organization, society, association or corporation, or any agent or representative thereof, who shall violate the provisions of this ordinance shall be subject, upon conviction, to a fine not exceeding the sum of Five Hundred Dollars ($500.00), or imprisonment for not exceeding sixty (60) days, or 'by both such fine and imprisonment in the discretion of the Judge. Section 3. Should any section, paragraph, sentence or word of this ordinance be declared for any reason to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repe,:ed. Section 5.
