1721t1 e i 4 ORDINANCE NO. 1721 6 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING CHAPTER 6, BOATS, DOCKS AND WATERWAYS, OF THE CODE OF ORDINANCES OF THE CITY OF CLEAR- WATER, FLORIDA, 1962, TO DEFINE THE TERM HOUSEBOAT AND A PRIVATE DOCK; TO PROHIBIT ANY VESSEL OF ANY DESIGN USED AS A DWELLING WITH LIVING ACCOMMODATIONS TO BE MOORED TO ANY PRIVATE DOCK, WHARF, PIER, SLIP, SEAWALL, OR OTHER STRUCTURE ABUTTING ANY LOT TONED FOR RESIDENTIAL USE, FOR MORE THAN A SEVENTY-TWO HOUR PERIOD, UNLESS PERMISSION IS GIVEN BY THE HARBOR- MASTER OF THE CITY IN THE FORM OF A PERMIT REQUIRING THE OWNER OR THE AGENT OF SUCH OWNER OF SUCH VESSEL USED AS A HOUSEBOAT TO MEET ALL OTHER REQUIREMENTS CONTAINED IN SUCH APPLICATION, IN WHICH EVENT THE HARBORMASTER MAY ISSUE A PERMIT FOR NOT MORE THAN 120 DAYS IN ANY ONE CALENDAR YEAR; PROVIDING FOR A PENALTY AS CONTAINED HEREIN IF THE OWNER OR AGENT OF ANY VESSEL USED AS A HOUSEBOAT VIOLATES ANY OF THE TERMS OR PROVISIONS OF THIS ORDINANCE; TO PROVIDE FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; FURTHER PROVIDE FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; TO PROVIDE FOR PROPER NOTICE OF THE PROPOSED ENACTMENT; AND PROVIDING FURTHER FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA; Section 1. That Section 6 - 18 Houseboats--Defined, and Section 6-19, Houseboats--Anchored or Moored at Other Than Licensed Facilities, of Chapter 6, Boatia, Docks and Waterways, of the Code of Ordinances of the City of Clearwater, Florida, 1962, are hereby amended to read as follows: Section 6-18. Houseboats, Private Docks--Defined. A houseboat is defined as any beat vessel of any design used as a dwelling, w_ith_living accommodations. _A private dock is defined as any dock, wharf, jier, slip, seawall, or any other structure abutting any lot zoned for residential use. Section 6-19. Houseboats--Anchoring or Mooring at Other Than Licensed Facilities. (b) The language of this section shall not be so construed as to prohibit any boat from occupying available space within'the'waterways of the city during a period of time reasonably necessary for protection of the boat from inclement weather conditions. (c) A_ny owner of a vessel used as a dwelling with living accommodations or his duly _authorized agent who desires to moor a houseboat as defined in Section 6-18 hereof to any private dock as defined herein, for more than seventy-two-(7Z) hours shall be re wired to file and submit a written application for 'a moorage permit utilizing an application form provided by the Harbormaster of the City of Clearwater. Such application shall state therein that a vessel used as a houseboat meets all current Environmental Protection enc discharge re uirements in effect at the time such application is made and further more for the purpose of meeting all current Environmental Protection Agency discharge requirements such vessel shall be inspected by the Harbormaster or other appropriate city official. Such application shall further contain therein t_he signature of the owner of the lot to which the dock is attached and the signatures of all lots abutting the same when such vessel is moored to a private dock which signatures shall indicate on such application form that the property owners have no objection to such moorage for a period of not more than 120 days in any one calendar year. (d) The Harbormaster of the City u on submission to him of an application in proper form and meeting the requirements as set forth in Section 6-19(c) and upon payment of any necessary permit fee shall then issue to the owner of such houseboat a permit allowing such vessel to be moored to a rivate non-licensed dock which ex nit shall be valid for a period of not more thari 1Z0 days in any one calendar year from the date of submission bar the Harbormaster. Section 2. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any section, paragraph, sentence or word of this ordinance be declared for any reason to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Any person, • or persons, firm or corporation or association of persons, who shall violate or fail to comply with any of the terms or provisions of this ordinance shall, upon conviction, be fined not exceeding the sum of $504.00 or imprisoned for not exceeding 60 days or be both fined and imprisoned in"the discretion of the judge. Each day that a violation is permitted to exist shall constitute a separate offense. Section S. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. Section 6. This ordinance shall become effective immediately upon its passage.
