WHEREAS, on August 4, 1977, and on August 18, 1977, the City
Commission of the City of Clearwater, after proper public notices, held public
hearings for the determination and establishment of zoning classifications
for certain property annexed into the City of Clearwater in accordance with
procedure as established; and
WHEREAS, certain of the amendments to the zoning atlas for
establishing zoning for such newly annexed real property were approved by
the City Commission after its evaluation of all evidence presented at the
said public hearings;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 197711, as amended, is amended to
indicate that fact as hereinafter set out:
Zoned as RS-75 - Single Family Residential District
That part of the SE 1/4 of the NE 1 /4 of Section 9,
Township 29 South, Range 16 East, described as;
Begin at the SW corner of the SE 1/4 of the NE 1/4 of
Section 9, Township 29 South, Range 16 East, and run
thence N 090611611 E, along the 40 acre line, 874.24 feet;
thence S 89 °22'45'1 E, 736.99 feet for P. O. B.; thence
continue S 89°221451' E, 171. 5 feet to the Westerly right-
of-way line of Rose Road as shown on a plat, of Del Oro
Heights, as recorded in Plat Book 54, Page 12 of the
Public Records of Pinellas County, Florida; thence
N 0°37'15" E, along the Westerly line of said Rose Road
127. 0 feet to the SE corner of Lot 26 of said Del Oro

437. 10 feet to the P. O. B. on the Southwesterly line curve of
the 200-foot wide right-of-way for State Road No. 55 (U. S.
Highway No. 19), said point being 100. 00 feet from, and radial
to the centerline of said road, sand curve being concave South-
westerly having a radius of 2764. 93 feet; thence Northwesterly,
along said Southwesterly right-of-way line curve, a chord
bearing and distance of N 33 °4214011 W, 142. 57 feet to a point
that is 87. 50 feet Northwesterly of the centerline of the existing

W, parallel to and 87. 50 feet distant from said transmission

Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared

Section 4. Any person, or persons, firm or corporation or
association of persons, who shall violate or fail to comply with any of the
terms or provisions of this ordinance shall, upon conviction, be fined not
exceeding the sum of Five Hundred Dollars ($500.00), or imprisoned in Jail
for not exceeding sixty (60) days or by both such fine and imprisonment in
the discretion of the ,nudge. Each day that a violation is permitted to exist
shall constitute a separate offense.
Section 5. Notice of the proposed enactment of this ordinance bas
beenFroperly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
