AN ORDINANCE AUTHORIZING THE ISSUANCE OF NOT
EXCEEDING $15, 000, 000 GENERAL OBLIGATION BONDS
OF THE CITY OF CLEARWATER, FLORIDA, TO FINANCE
THE COST OF VARIOUS MUNICIPAL PROJECTS IN THE
CITY; PROVIDING FOR AND CALLING A BOND ELECTION
OF THE QUALIFIED ELECTORS RESIDING IN THE CITY TO
BE HELD ON JULY 12, 1977, ON THE QUESTION OF THE
ISSUANCE OF SUCH GENERAL OBLIGATION BONDS;
PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR
PRbPER NOTICE OF PROPOSED ENACTMENT.

Section 1. Authority of this Ordinance. This Ordinance is adopted
pursuant to Chapter 9710, Laws of Florida, Acts of 1923, and acts amendatory
thereof or supplemental thereto, as amended by Ordinance No. 1649 of the
City of Clearwater; Chapter 166, Part II, Florida Statutes; Sections 100.201,
et seq. , Florida Statutes; and other applicable provisions of law.
Section 2. Authorization of Bonds. Subject and pursuant to the
provisions hereof, General Obligation Bonds of the City of Clearwater, Florida,
(herein called 'City"), are authorized to be issued in the aggregate principal
amount of not exceeding Fifteen Million Dollars ($15, 000, 000. 00) to finance
the cost of the purposes described in paragraphs number (1) through (4)
inclusive in Section 3 hereof. The moneys received and the interest earned
from the issuance of such General Obligation Bonds will be used for such
purposes. Such General Obligation Bonds shall be secured by the full faith
and credit andthe taxing power of the City. None of such bonds shall be issued
for a longer term than twenty-five (25) years from their date of issuance,
and such bonds shall bear interest at such rate or rates not exceeding the
maximum rate permitted by law at the time of the sale of the bonds, the
actual rate to be determined upon sale of the bonds.

p !V 'r Section 3. Bond Election. A bond election of the qualified electors
residing in the City is hereby called to be held on July 12, 1977, to determine
whether or not the issuance of such General Obligation Bonds in an aggregate
amount of not exceedin ifteen illion Dollars 000 Q 00 a L ;Y`s=f?r?'"R

by such qualified electors to finance the cost of the following municipal purposes
within the City:
(1) $1, 500, 000 to provide for the acquisition of land for active and

passive recreation parks and land, not more than $500, 000 of which shall be c
used for active recreation parks, and not more than $1, 000, 000 of which shall ffti t -'
be used for passive, environmentally sensitive land, all at locations to be
subsequently determined by the City Commission. f

(2) $1, 650, 000 for construction and acquisition of additions, extensions , {
and improvements to the City's storm drainage facilities and easement or rights-
o£-way therefor, not exceeding $300, 000 of which shall be used for Stevenson
Creek Basin purposes; not exceeding $1, 000, 000 of which shall be used for
Downtown Area Drainage System purposes; and not exceeding $350, 000 of which
shall be used for Clearwater Beach drainage system, purposes.
(3) $4, 450, 000 for construction of libraries and parking facilities,
furnishings and equipment therefor; not exceeding $3, 050, 000 of which shall be
used for a main library at the site of the present main library; and not exceeding
$1, 400, 000 of which shall be used for a branch library at the site of City-owned
property at Starcrest Avenue and Cleveland Street.
(4) $7, 400, 000 for construction and acquisition of a culture civic center
comprised of a flat floor auditorium and a raked floor auditorium, and land,
parking facilities, furnishings and equipment therefor, not exceeding $2, 100, 000
of which shall be used for the coat of acquisition of land at the site known as
the Annex Site, generally bounded on the East by Missouri Avenue, on the West I I
by Washington Avenue, on the North by Cleveland Street and on the South by
Brownell Street, containing approximately 17. 5 acres, MOL.
All of such purposes described above shall also include tither purposes
appurtenant or incidental thereto.

All qualified- electors residing in the City shall be entitled and permitted
to vote in such bond election. The places of voting and the inspectors and clerks
for the bond election shall be designated as provided by the Code of Ordinances,
City of Clearwater, and by applicable State Law. The polls will be open at the
voting places from seven (7) o'clock A.M. until seven (7) o'clock P.M. on the
same day.
Section 4. Official Ballot. Voting machines shall be used at such
bond election and the form of ballots to be used shall be in substantially the
following form:

Proposition, No. 1
Shall the City of Clearwater, Florida issue not exceeding
$1, 500, 000 principal amount of General Obligation Bonds of
the City bearing interest at not exceeding the maximum legal
rate of interest at the time of the sale of the bonds, maturing
not later than twenty'-five (25) years from the date of issuance
thereof, secured by the full faith and credit "the taxing powers
of the City, for the purpose of financing active and passive
recreational parks and land as more specifically described and
provided in Ordinance No. 1680 of the City.
Proposition No. 2
Shall the City of Clearwater, Florida issue not exceeding $1, 650, 000
principal amount of General Obligation Bonds of the City bearing
interest at not exceeding the maximum legal rate of interest at
the time of the sale of the bonds, maturing not later than twenty-
five (25) years from the date of issuance thereof, secured by the
full faith and credit aryl the taxing powers of the City, for the purpose
of financing storm drainage facilities as more specifically described
and provided in Ordinance No..1680 of the City.

of libraries, parking facilities, furnishings and equipment
therefor, as more specifically described and provided in Ordinance
No. 1680 of the City.
Proposition No. 4
Shall the City of Clearwater, Florida issue not exceeding
$7,400, 000 principal amount of General Obligation Bonds of the
City bearing interest at not exceeding the maximum legal rate of
interest at the time of the sale of the bonds, maturing not later
than twenty-five (25) years from the date of issuance thereof,
secured by the full faith and credit andthe taxing powers of the City,
for the purpose of financing the construction and acquisition of a
Cultur Civic Center comprised of a flat floor auditorium and a
raked floor auditorium, and land, parking facilities, furnishings
and equipment therefor as more specifically described and provided
in Ordinance No. 16$4 of the City.
The ballots and voting machines shall be so arranged that the voter
may vote "FOR BONDS" or "AGAINST BONDS" with respect to each proposition.
Section 5. Absentee Voting. Paper ballots shall be used at such
election for absentee voting. The form of ballot to be used in the election for
absentee voters shall be in substantially the form provided in Section 4 above.

Section 7. Election Procedure. The bond election shall be held and
conducted in the manner prescribed by law for holding general elections, except
as herein provided. The Inspectors and Clerks at each polling place shall
canvass the vote and make due returns of same without delay to the City Clerk.
Such returns shall show the number of qualified electors who voted at such
bond election on each proposition and the number of votes cast respectively for
and against approval of each proposition. The returns of the Inspectors and
Clerks shall, within twenty-four (24) hours after the close of the polls, be
canvassed by the City Commission of the City, which shall declare and certify
the results of such bond election.
Section 8. Election Results. If a majority of the votes cast at such
election in respect to any proposition or group of such General Obligation Bonds
shall be "For Bonds", such proposition or group of bonds shall be approved;
and then the particular bonds, the issuance of which shall be thereby approved,
shall be issued as hereafter provided by the City. The rejection at such election
of any proposition or group of General Obligation Bonds proposed by this ordinance
to be issued shall not prevent the approval of the other propositions or groups of
bonds proposed by this ordinance to be issued; and any one of such propositions
or groups of bonds which may be so approved shall be issued as hereafter
provided by the City,

or sentence or paragraph hereof shall be held invalid by any court of competent S
jurisdiction, such holding shall not affect any other word, clause, phrase,
sentence or paragraph hereof.
Section 11, Repealing Clause. All ordinances in conflict or =
inconsistent herewith hereby are repealed, insofar as there is conflict or
inconsistency.
Section 12. Effective Date. This ordinance shall take effect
immediately upon its passage.
Section 13. Notice. Notice of the proposed enactment of this
ordinance has been properly advertised in a newspaper of general-circulation in
accordance with Chapter 166. 041, Florida Statutes.
