WHEREAS, the Federal Insurance Administration has published MVAWW'Nf a revised Flood Hazard Boundary Map with new flood areas designations in conflict with those existing in the City of Clearwater Code of Ordinances; and WHEREAS, an amendment must be made as soon as possible in order that the City of Clearwater may remain in the National Flood Insurance Program; and WHEREAS, an emergency exists wi thin the City of Clearwater in that these amendments must be made immediately in order to remain eligible for the National Flood Insurance Program and thereby preserving the health, safety and welfare of the citizens of the City of Clearwater; NOW, THEREFORE, BE IT ORDAINED BY THE CITY y' COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Cfyi rs? ?i?"`t',•'y..?t F' A A Building Permit issued by the Director of the City Building Inspection Department in conformity with the provisions of this ordinance shall be secured prior to the erection, addition or alteration of any building, structure or portion thereof resulting in substantial improvement thereto, or other development including, but not limited to the placement of a mobile home, dredging, filling, grading, paving or clearing of land lying within areas identified as Zone A'I-trhroag#t-AZ- ic?Lusva-ar Trar?e Aths.otigh,A?V..sivs A, AO, and Al-30, or Zone V, VO and V1-30 on the Flood Hazard Boundary Map prepared by the Federal Insurance Administration for the City of Clearwater, Florida. (1) Application for a Building Permit shall be made, on a form or forms to be provided by the City, to the Director of the City Building Inspection Department. The Director shall have the responsibility for accepting such application and shall have the authority to require the following submittals in addition to the application: (a) Plans drawn to scale showing the nature, location; dimensions and elevations of the areas in question; existing or proposed structures, fill, storage of materials; and the location of the foregoing, where applicable, in relation to mean sea level, drainage facilities, the regulatory flood protection elevation and any applicable Flood Hazard District. (b) Required certifications by a registered professional engineer or architect (relating to the adequacy of flood proofing methods or anchorage design). (2) In determining whether or not to issue a Building Permit, the Director of the City Building Inspection Department or his authorized representative, shall examine the application and all supporting materials submitted to determine the following: (a) That all necessary permits have been received from those governmental agencies from which approval is required by Federal, State, or local regulations, and that the building or development is in substantial compliance with the Coastal Zone Management and Conservation Elements of the updated Comprehensive Plan for the City. (b) That plans and specifications conform to the criteria established by the Federal Insurance Administration for the applicable flood zoning district. (g) That all mobile homes to be placed within Zones A4 thr-oWla,A&4nclusF1*e._ A AO or, through A30 on the Flood Hazard Boundary Map shall be anchored to resist flotation, collapse, or lateral movement by providing over the top and frame ties to ground anchors as specified by the Federal Insurance Administration. (h) That within Zones ,A•lr.thFrraug4A,5.4xo ,u•si've Ai AO, or At through A30 on the Flood Hazard Boundary Map, new mobile home parks and mobile home park sub- divisions; or existing mobile home parks and mobile home park subdivisions that request a permit to expand their facilities; or to repair, reconstruct or improve their streets, utilities and pads at a cost equal to or exceeding 50% of the value of the streets, utilities and pads before the repair, recon- struction, ox improvement has cone-nenced: 1. Stands or lots are elevated on compacted fill or on pilings so that the lowest floor of the mobile home will be at or above the 100 year flood level as established by the Federal Insurance Administration. 2. Adequate surface drainage and access for a hauler are provided. 3. (i) That all now construction and substantial improvements with Zones A IV-tIb"ugh A5•V daieI%ts vo V, VO, or V1 through V30 on the Flood Hazard Boundary Map are elevated on adequately anchored pilings or columns and securely anchored to such piles or columns so that the lowest portion of the structural members of the lowest floor (excluding the pilings or columns) is elevated to or above the 100 year flood level as estab- lished by the Federal ?assurance Administration, and that a registered professional erigineer or architect has certified that the structure is securely anchored to adequately anchored pilings or columns in order to withstand velocity waters and hurricane wave wash. Also that the space below the lowest floor is free of obstructions or constructed with "break-away walls" intended to collapse under stress without jeopardizing the structural support of the structure so that the impact on the structure by abnormally high tides or wind driven water be minimized. Such temporarily enclosed space shall not be used for human habitation. (3) The following activities are prohibited within those areas Zoned A4V-td,%.noug4*A4V V, VO, or VI through V30 on the Flood Hazard Boundary Map; (a) The use of fill for structural support of buildings. (b) Man-made alterations of sand dunes and mangrove stands which would increase potential flood damage. (c) Placement of mobile homes, except in e:cisting mobile home parks and mobile home subdivision. (A4ic4iorag-e- skall-eeafarrn-ta 4aX-I} eb-ov-e4. (d) New construction seaward of the roach of mean high tide. (4) Mobile home parks and mobile home subdivisions located within Zones Al.thrEwgi?A5-itliseive A, AO, or Al through A30 on the Flood Hazard Boundary Map shall, file an evacuation plan indicating alternate vehicular access and escape routes with the local Disaster Preparedness Authority. (5) Now and replacement water supply systems located within flood prone areas shall be designed to minimize or eliminate infiltration of flood waters into the system. Section 3. Any person, organization, society, association or corporation, or any agent or representative thereof, who shall violate the provisions of this ordinance shall be subject, upon conviction, to a fine not to exceed the sum of Five Hundred Dollars ($500. 00), or imprisonment for not exceeding sixty (60) days, or by both such fine and imprisonment in the discretion of the Judge. Section 4. Should any section, paragraph, sentence or word of this ordinance be declared for any reason to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. It is hereby found, determined and declared that this ordinance is necessary and urgently needed for the preservation of the health, safety and welfare of the citizens and inhabitants of the City of Clearwater; that an emergency is hereby declared; and that this ordinance shall be in full force and effect immediately upon its passage. This ordinance shall automatically expire ninety (90) days from the date of its passage unless the ordinance is submitted during such time for consideration as a nonomergency ? ordinance.
