AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ADOPTING THE CAPITAL IMPROVEMINT PROGRAM AND
BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1,
1977, AND ENDING SEPTEMBER 30, 1978, APPROVING THE
SIX-YEAR CAPITAL IMPROVEMENT PROGRAM, WHICH
SHALL BE RE-EVALUATED AT THE BEGINNING OF EACH
FISCAL YEAR; AUTHORIZING THE CITY MANAGER TO IS&UE
SUCH INSTRUC'T'IONS THAT ARE NECESSARY TO ACHIEVE AND
ACCOMPLISH THE CAPITAL IMPROVEMENTS SO AUTHORIZED;
AUTHORIZING THE CITY MANAGER TO MAKE AMENDMENTS
BETWEEN PROJECTS IN THE CAPITAL IMPROVEMENT PROGRAM;
APPROPRIATING AVAILABLE AND ANTICIPATED RESOURCES
FOR THE PROJECTS IDENTIFIED; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING
FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDIN-
ANCES IN CONFLICT HEREWITH; PROVIDING FOR PROPER
NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE,
WHEREAS, the City Manager has submitted a proposed Six-year
Capital Improvement Program, and has submitted an estimate of the amount neces-
sary to carry on said Capital Improvement Program for the fiscal year beginning
October 1, 1977 and ending September 30, 1978; and
WHEREAS, the estimated resources available and income to be
received by the City during said period from ad valorem taxes and other sources
have been submitted to the City Commission; and
WHEREAS, a general summary of the Capital Improvement Budget and
the times and places where copies of the budget message and capital budget are
available for inspection by the public was published in a newspaper of general
circulation; and
WHEREAS, the City Commission has, in meeting duly assembled,
examined carefully, considered and approved same; and
WHEREAS, in accordance with Section 2-76(a) of the Code of Ordin-
ances of the City of Clearwater, Florida, as set forth in Ordinance #E1665, the City
Commission shall meat in the City Hall for the purpose of holding a public hearing
upon said proposed budget at 12:30 P. M. on September 1, 1977;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

Composite Exhibit A - Document entitled "Annual Operating
and Capital Budgets 1977/78, City of Clearwater, Florida"
consists of 228 pages, herein the Capital Improvement Program
and Budget is set forth on pages 166 - 194, preceded by intro-
ductory materials on pages 161 -165 and followed by summary `:. €'';;rln=?1j:' 3
materials set forth on pages 196 -•205, is hereby adopted as
the Capital Improvement Program and Budget of the City of ImD ,¦
Clearwater, and is made a part of this ordinance as if it were
set forth in full herein.
Section 2. That a summary of the Capital Improvement Program and Budget was
published in a newspaper of general circulation pursuant to the requirements of
Section 2-76(a) of the Code of Ordinances of the City of Clearwater, Florida as set
forth in Ordinance No. 1665.
Section 3. That the City Commission shall meet in the City Hall at the City of
Clearwater at 12:30 P.M. on September 1, 1977, for the purpose of holding a public.
hearing upon said proposed Capital Improvement Program Report and Budget for
said fiscal year, subject to the right of the City Commission to amend or change
said budget at the time and place stated or at the time of the final adoption of this
ordinance or as provided by Section 2-76 and Section 2-78 of the Code of Ordinances
of the City of Clearwater, Florida as set forth in Ordinance No. 1665.
Section 4. That the City Manager is authorized and directed to issue such instruc-
tions and directives that are necessary to achieve and accomplish the capital improve-
ments authorized by the adoption of this budget.
Section 5. That the City Manager in authorized to transfer appropriations within
the capital budget provided such transfer does not result in changing the scope of any project or the fund source included in the adopted capital budget.

Section 6. Should any section, paragraph, sentence, phrase, clause or other part
or provision of this ordinance be declared by any court to be invalid, the same shall
-not affect the validity of the ordinance as a whole, or any part thereof, other than
the part declared to be invalid.

Section 7. All ordinances or parts of ordinancen in conflict herewith or inconetatent`'
with the provisions of this ordinance are hereby' repealed to the extent of their confllci.
Section 8. Notice of the proposed enactment of this ordinance has been properly
advertised in a newspaper of general circulation in accordance viith Chapter 166.041,
Florida Statutes.
Section -9. This ordinance ahall become effective Immediately upon its passage.
