BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF

CLEARWATER, FLORIDA;
Section 1. Chapter 2, Administration, of the Code of Ordinances of
the City of Clearwater, Florida, 1962, is hereby amended by enacting a
new Section 2-88 to read as follows:
Section 2-88. Dishonored check, service fee.
Any person who presents a check, draft or any other form of
payment order to the City of Clearwater for payment purposes
which check, draft or other payment order is subsequently
presented by the City of Clearwater for payment and dishonored
shall be subject to the imposition of a service fee of not more
than Five Dollars ($5.00) for the collection of the dishonored
check, draft or any other payment order.
Notice to any person subject to the provisions of this Section
that a check, draft or other payment order presented to the
City of Clearwater has been dishonored shall be similar to that
set out in' Section 832. 07 (1), Florida Statutes, except that such
notice shall contain an indication that the service fee may not
be more than Five Dollars ($5.00).
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared by
a court of competent jurisdiction to be invalid, the same shall not affect the
validity of the ordinance as a whole, or any part thereof other than the part
declared to be invalid.
Section 4. Notice of the proposed enactment of this ordinance has been
properly advertised in a newspaper of general circulation in accordance
. .-%-ith Chapter 166.041, Florida Statutes.
