AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING ARTICLE 1, GENERAL AND VASCELLANEOUS
PROVISIONS, OF CHAPTER 13.. LICENSES AND REGULATIONS,
OF THE'CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962, TO CLARIFY DEFINITION OF ENGAGING IN
BUSINESS AND TO REQUIRE COMPLIANCE WITH PINELLAS
COUNTY ORDINANCE NO. 77-4, RELATING TO THE BUSINESS
OF PROVIDING FUTURE CONSUMER SERVICES; PROVIDING
A PENALTY FOR FAILURE TO COMPLY HEREWITH; PRO-
VIDING FOR REPEAL OF ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER
NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:

Section 1. Section 13-1, License required; contents; general regulations;
penalty, of Article I, General and Miscellaneous Provisions, of Chapter 13,
Licenses and Regulations, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby amended by amending sub-section (c) and enacting
a new sub-section (g) to read as follows:
(c) For the purposes of this article any person holding
himself out to the public, at a given location, by sign,
printed matter, classified section, telephone directory,
or city directory, or by word of mouth, or otherwise
as being engaged in business or as offering services or
personal property or the personal property of others or
personal property or antiques acquired for sale to the
public, regardless of whether such person actually
transacts any business or practices a profession, shall
be considered as engaging in business and shall be
liable for an occupational license therefor. The provisions
of this paragraph shall not apply to the sale by a family
or an individual of tangible personal property acquired
by the family or individual and used as a part of the
hoes ehold.
(g) Any person applying for an occupational license in
Clearwater, Florida, to engage in the business of providing
future consumer services as that term is defined in Section
2. (a) of Pinellas County Ordinance No. 77-4, shall prior
to obtaining a Clearwater occupational license and in
addiction to any other requirement provided herein, at
the time of application provide proof of compliance
with Pinellas County Ordinance No. 77-4, including
evidence of any license obtained and any bond or affidavit
provided.

'Section 2. Any person, organization, society, association or
corporation,' or any agent or representative thereof, who shall violate or
fail to comply with the provisions of this ordinance shall be subject, upon
conviction, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00),
or imprisonment for not exceeding sixty (60) days, or by both such fine and
imprisonment in the discretion of the Judge. Each day any violation of the
provisions of this ordinance shall continue shall constitute a separate offense.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section S. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 6. This ordinance shall become effective immediately upon
its passage.
