WHEREAS, the City Commission' of the City of Clearwater, Florida,
received a sworn petition from Chief Charley's, Inc. Employees Profit
Sharing Trust requesting the City to annex a certain parcel of real estate
described hereinafter, owned by it, into the corporate limits of the City of
Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on January 20, 1977, voted
unanimously to accept said request and authorized the proper officials to
set up a public hearing thereon for the determination and establishing of
fire district classification and to prepare an ordinance to annex said parcel
of real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Chapter 171, Florida Statutes; and
WHEREAS, on March 17, 1977, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing for the
determination and establishment of fire district classification for said
real property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at a proper
public hearing, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Chapter 171. 044,

The above described property is hereby designated Fire District {

Section 2. Petitioner, as part of this annexation and in furtherance
of the policy adopted by the City Commission, agrees to dedicate ten per,.
cent (1076) of the net property area involved in this annexation to be used
and developed for park purposes.
Section 3. The City Commission hereby formally and according to
law, accepts the dedication of all easements, streets, parka, plazas, places,
rights-of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section 4. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor.
Section 5. This ordinance and notice of the proposed enactment of
same has been properly advertised in a newspaper of general circulation in
accordance with Chapter 166. 041, Florida Statutes, and Chapter 171. 044,
Florida Statutes.
Section 6; This ordinance shall become effective immediately upon
its passage and enrollment in the City of Clearwater Ordinance Book and

Florida, and establishes fire district classification therefor;
The 5 1 /Z of the S 1 /Z of the SE 1/4 of the SE 1/4 of Section
20, Township 28 South, Range 16 East, Pinellas' County,
Florida, being further described as follows: Commence at
the SE corner of said Section 20 for a P. 0. B. and run thence
S 89'4514Z" NY, along the South boundary of said Section 20,
1, 333.41 feet to the 40 acre line; thonce N 001OZ12811 E, along
said 40 acre line, 334.98 feet; thence N 89'47151" E, 1, 333. 72
feet to the East line of said Section 20; thence S 00'05142" W,
along said East line of Section 20, 334. 1S feet to the P.O. B.
The above described property is hereby designated Fire District
No. 2.
Section 2. Petitioner, as part of this annexation and in furtherance
of the policy adopted by the City Commission, agrees to dedicate ten per
cent (1001,3) of the net property area involved in this annexation to be used
and developed for park purposes.
Section 3.- The City Commission hereby formally and according to
law, accepts the dedication of all easements, streets, parks, plazas, places,
rights,of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section'4.• The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor..
Section 5. This ordinance and notice of the proposed enactment of
same has been properly advertised in a newspaper of general circulation in
accordance with Chapter 166.041, Florida Statutes, and Chapter 171. 044,
Florida Statutes.
