Section 8. 26, Type of machine authorized, of Article II, Voting Machines, of Chapter 8, Elections, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 8-26, Type of machine authorized. Any voting machine may be adopted, rented, purchased 11 j j or used which shall be so constructed as to fulfill the requirements set forth in Fla. Stat. 101. 28. l'. Section Z. Section 9-34, Proximity of people to voting machines, of Article II, Voting Machines, of Chapter 8, Elections, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed in its entirety, and a new Section 8-34, Persona allowed in polling places, is hereby enacted to read as follows: Section 8_34. Persons allowed in polling places. As many electors are admitted to vote as there may be booths available and no person is permitted under any pretext to come within 15 feet of any polling place whatever from the opening to the closing of the polls, except the Sheriff or his deputy, officially designated watchers, the inspectors, the clerks of election, and the wipervisor of elections or his deputy. No sheriff, deputy sheriff, or city policeman shall enter the polling place without permission from the clerk, except to cast his ballot. Section 8..36 Duties of election officers in connections *' i isn' with opening polls, of Article II, Voting Machines, of Chapter 8, Elections, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 8-36. Duties of election officers in connection with opening polls. 7 "he election officers of each polling place shall attend at the polling place one hour before the time set for opening of the polls, at each election, and shall proceed to arrange the furniture, stationary and voting machine for the conduct of the election. The keys to the voting machine shall be delivered to the election officers at least three-quarters of an hour before the time set for opening the polls, in a sealed envelope on which shall be written or printed the number and location of the voting machine, the number of the seal and the number registered on the protective counter or device, as reported by the custodian. The said envelope shall not be opened until the Clerk and at least two inspectors are present and shall have examined the envelope to see that the same has not been opened. Before opening the envelope, all election officers present shall examine the number on the seal on the machine, also the number registered on the protective counter, and shall see if they are the same as the number written on the envelope; and if they are not the same, the machine must not be opened until the custodian or other authorized person shall have been notified and shall have presented himself at the polling place for the purpose of re-examining such machine and shall certify that it is properly arranged. If the numbers on the seal and protective counter are found to agree with the numbers on the envelope, the election officers shall proceed to open the doors concealing.the counters, and each officer shall carefully examine every counter and see that it registers zero, and the same shall be subject to the in- spection of official watchers. The machine shall remain locked against voting until the polls are formally opened, and shall not be operated except by voters in voting. If any counter is found not to register . zero, the board of election shall immediately notify the custodian, who shall, if practicable, adjust the counters at zero, but if it shall be impracticable for the custodian to arrive in time to so adjust such counters before the time set for opening the polls, the election officers shall immediately make a written statement of the designating letter and number of such counter, together with the number registered thereon, and shall sign and past same upon the wall of the polling room, where it shall remain throughout election day, and in filling out the statement of canvass, they shall subtract such number from the number then registered thereon. Section 4. Any person, organization,, society, association or corporation, or any agent or representative thereof, who shall violate the provisions of this ordinance shall be subject, upon conviction, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment for not exceeding sixty (60) days, or by both such fine and imprisonment in the discretion of the Judge. Section 8. Should any section, paragraph, sentence or word of this ordinance be declared for any reason to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid.
