ORDINANCE NO. 1632
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 9, RELATING TO FIRE PREVENTION,
OF THE CODE OF ORDINANCES OF THE CITY OF CLEAR-
WATER, FLORIDA, 1962, TO ADOPT THE NATIONAL FIRE
CODES, 1976 EDITION THEREOF; PROVIDING FOR IN-
SPECTIONS AND THE ISSUANCE OF CITATIONS; PROVIDING
A PENALTY FOR FAILURE TO COMPLY THEREWITH;
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER
NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section L Chapter 9, relating to Fire Prevention, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby amended
by amending Section 9-14 to read as follows:
Section 9-14. National Fire Codes adopted; inspections;
issuance of citations.
(a) There is hereby adopted by the City of Clearwater, Florida,
that certain code known as the National Fire Codes, as published
by the National Fire Protection Association, being; particularly
the 1976 edition consisting of sixteen (16) volumes, of which code
one (1) copy thereof is now and has been for the last preceding
ten (10) days on file in the office of the City Clerk of the City
of Clearwater, and the same is hereby adopted and incorporated
by reference as fully as if set out at length herein, and from
the effective date of this ordinance shall take effect, the
provisions thereof shall be controlling within the limits of
the City of Clearwater, Florida.
(b) The Fire Prevention Division shall make periodic inspections
of all buildings or structures and is empowered to issue
citations for violations.
Section Z. Any person who shall violate any of the provisions of this
code hereby adopted or fail to comply therewith, or who shall violate or fail
to comply with any order made thereunder, or who shall build in violation of
any detailed statement of specifications or plans submitted and approved there-
under, or any certificate or permit issued thereunder, and from which no
appeal has been taken, or who shall fail-to comply with such an order as
affirmed or modified by the City Commission, or by a court of competent
jurisdiction, within the time fixed therein, shall severally for each and
every such violation and noncompliance respectively, be guilty of a

misdemeanor, punishable by a fine not exceeding'Piva Hundred Dollars
($500. 00) or by imprisonment for a term not exceeding sixty (60) days or
by both such fine and imprisonment. Each day's continuance of any violation
of any provisions of said Code shall constitute a separate offense. The

imposition of one penalty for any violation shall not excuse the violation or
permit it to continue; and all such persons shall be,required to correct or
remedy such violations or defects within a reasonable time.
Section 3. All ordinances or parts of ordinances conflicting or
inconsistent with the provisions of this ordinance or of the code hereby adopted
are hereby repealed.
Section 4. Should any section, paragraph, sentence or word of this
ordinance or of the code hereby adopted be declared for any reason to be
invalid, the same shall not affect the validity of the ordinance or code as a
whole, or any part thereof other than the part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166.041, Florida Statutes.
Section 6. This ordinance shall become effective immediately upon
