AMENDING CHAPTER 15A, PURCHASING, OF THE CODE OF
ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA,

THERETO; PROVIDING FOR REPEAL OF ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING
FOR PROPER, NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 15A-2, Definitions, of Article I, System Established,
of Chapter 15A, Purchasing, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby amended by amending sub-sections (1) and (2)
thereof to read as follows:
(1) Commodity: Any of the various supplies, materials,
goods, merchandise, equipment, services and other
personal property purchased, leased or otherwise
contracted for by the City, unless coming within the
definition of public works contracts, as hereinafter
defined. However, commodities purchased for resale
are excluded from the provisions of this ordinance.
(2) Public Works Contracts: All contracts involving
construction for the City. Any construction involving
a project related to, but not included in, a project for
which the City has contracted, is not exempted from
the competitive bidding procedures as set forth in this
ordinance, notwithstanding its relationship to a project
which has previously been bid upon.
And by repealing in its entirety sub-section (4) thereof defining Purchasing
Agent,

Section 3. Section 15A-4, Purchasing Agent, of Article I, System

City of Clearwater, Florida, 1962, is hereby amended by amending the first
unnumbered paragraph thereof to read as follows:
The City Manager is the purchasing aget for the City,
with ultimate responsibility under the Charter. He may
in his discretion delegate some or all of this authority,
except authority to make the final decision, to any City
employee or employees. The City Manager or his
delegated authority shall have the authority to do as follows:
Section 4. Section 15A-5, Submittal of Requisitions; Department
Directors' Signatures, of Article 1, System Established, of Chapter 15A,
Purchasing, of the Code of Ordinances of the City of Clearwater, Florida,
1962, is hereby amended to read as follows:
Section 15A-5. Submittal of Requisitions; Department
Directors' Signatures.
Department directors shall submit requests for commodities
to the purchasing agent or his representative by standard
requisition forms, or by other means as may be established
by the purchasing rules and regulations. The department
director's signature on a purchase requisition indicates that
funds are available and authorizes expenditure of such funds
to the purchasing agent or his representative, except that
the final voucher authorizing the expenditure shall be signed
by the purchasing agent.
Section 5. Section 15A-10, Exceptions to Bidding Procedures, of
Article II, Purchase of Commodities, of Chapter 15A, Purchasing, of the
Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended by adding thereto a new sub-section (5) to read as follows:
(5) When the City Manager determines that the nature
of the commodity is such that competitive bidding
is impossible, impractical, or, cannot be obtained.
