'^s? {5 r ORDINANCE NO. 1624 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, REPEALING SECTION 7-6, SIDEWALKS REQUIREMENTS FOR ALL NEW CONSTRUCTION, OF ARTICLE I, IN GENERAL, OF CHAPTER 7, BUILDINGS, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, AND ENACTING A NEW SECTION 7-6, TO SET UP REQUIREMENTS FOR SIDE- WALK CONSTRUCTION FOR ALL NEW DEVELOPMENTS, MAJOR ALTERATIONS OR ADDITIONS TO EXISTING PROPERTIES EXCEEDING FIFTY PER CENT OF THE PROPERTIES' ASSESSED VALUATION WITHIN THE CITY, INCLUDING PLAN CONSIDER- ATIONS, SPECIFICATIONS, SCHEDULE OF COMPLETION, TEMPORARY WAIVER OF REQUIREMENTS; TO ENACT A NEW SECTION 7-6A TO PROVIDE FOR FILING FEES FOR APPEALS TO THE CITY MANAGER OR CITY COMMISSION; PROVIDING A PENALTY FOR FAILURE TO COMPLY HEREWITH; PRO- VIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDI- NANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE; DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 7-6, Sidewalks Requirements for all New Construction, of Article I, In General, of Chapter 7, Buildings, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed in its entirety and the following new Section 7-6 is enacted in lieu thereof: Section 7-6. Sidewalks Requirement for all New Construction and Major Alterations or Additions. To secure safety from traffic and other similar dangers, to provide an area which can be utilized by pedestrian traffic and to promote the general welfare and safety of all adults and school children in their movement as pedestrian traffic, it is hereby required that new developments, either for residential, commercial, industrial or other purposes, or major alterations to structures all within the corporate limits of the City of Clearwater that abut a public right-of-way shall have a sidewalk or sidewalks constructed by the owner on, across or adjacent thereto as provided herein. (1) Plan considerations. As a part of securing a building permit to erect a structure on land which is vacant, remodel an existing structure where such remodeling will exceed by fifty per cent (50%) the assessed valuation of the property, or add an additional building or structure to land where a building or structure already exists and where the value of such additional building or structure will exceed by fifty per cent (5076) the assessed valuation of the property, where a sidewalk does not exist, the building plan submitted as part of securing the building permit shall provide for construction of a sidewalk either upon the property or where the property is abutting. the public. right-of-way, upon such right- of-way. Such sidewalk construction shall be required to be completed at the property owner's expense before the Building Department will issue a certificate of occupancy for the building or structure on said property. However, the certificate of occupancy may be issued if the sidewalk construction is fully guaranteed by the execution and delivery to the City Building Department of a performance bond or cash in lieu thereof covering said construction or the cost of construction. The City Building Department shall place such performance bond or cash in lieu thereof in escrow with the Office of the City Finance Director, and shall notify the City Clerk in writing of the action taken. (4) Temporary Waiver of Requirement by the City Manager. Upon appeal by an affected property owner, the City Manager shall have power to grant a temporary waiver of the installation requirement imposed by this section. (a) Where, following a hearing and inspection of the property, the City Manager has determined that natural topographical conditions, existing ditches, tree location, inadequate right- of-way, or other similar physical conditions peculiar to the premises, exist, such as would prevent construction of the sidewalk; or where the property owner can demonstrate that he would have the only sidewalk within two hundred (ZOO) feet of his property, that such sidewalk would not form a part of a route leading to a school and that the absence of a sidewalk would not create a pedestrian hazard by reason of the proximity of the property to motor vehicle traffic. (b) Following the hearing and inspection of the property provided for herein, the City Manager shall cause written findings with respect to whether or not the installation requirement should be waived to be served upon the affected property owner by mailing a copy of such finding by certified mail to the address provided by the property owner. (c) The affected property owner may within ten (10) days following receipt of the findings provided for herein, where the temporary waiver has been denied, make demand in writing for an appeal to the City Commission. Filing fees for appeals. Any application for an appeal to the City Manager or City Commission as provided for herein shall be filed with the City Clerk, and a filing fee in the following amounts shall be paid to defray the costs of processing and conducting the hearings involved: (a) Appeals to the City Manager: $12.00 (b)Appeals to the City Commission: $1Z. 00 Section 3. Any person, organization, society, association or corporation, or any agent or representative thereof, who shall violate the provisions of this ordinance shall be subject, upon conviction, to a fine not 'd exceeding the Bum of Five Hundred Dollars ($500. 00), or imprisonment in ' + ? • r jail for not exceeding sixty (60) days, or by both such fine and imprisonment in the discretion of the Judge.
