AMENDING SECTION 4-16 OF ARTICLE I, IN GENERAL, OF
CHAPTER 4, ALCOHOLIC BEVERAGES, OF THE CODE OF

1962, TO ESTABLISH HOURS OF CLOSING FOR ESTABLISH-
MENTS SELLING ALCOHOLIC BEVERAGES AND TO SET
FORTH EXCEPTIONS THERETO; PROVIDING FOR REPEAL
OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER FLORIDA:

Section 1. Section 4-16, Hours of sale; definitions, schedule, of
Article I, in General, of Chapter 4, Alcoholic Beverages, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby amended by
amending Sub-Section (B) thereof and enacting a new Sub-Section (C) to read
as follows:
Section 4-16. Hours of sale; definitions, schedule.
(B) There is hereby established the following hours of closing:
(1)A11 business establishments in the City of Clearwater
licensed or unlicensed dealing in alcoholic beverages,
public or private, either directly or indirectly shall
remain closed from the hour of 2,;00 A. M. to 8:00 A. M.
on each day of the week except Sunday.
(2)AII such business establishments shall remain closed on
each Sunday from the hour of 2:00 A. M. to 1:00 P. M.
(3) Nothing contained in this section shall be construed to
prevent a vendor of any establishment dealing in alcoholic
beverages from entering, being or remaining in such
establishment during prohibited hours when the vendor
is actually engaged in duties other than the sale or serving
of alcoholic beverages in such establishment; nor shall
this section be construed to prevent a fireman or law
enforcement officer from entering, being or remaining in
such establishment in the performance of his duties.
The closing hours established herein relate only to the sale
of alcoholic beverages. This sub-section shall not be construed
to impose a requirement other than that business establishment
may not sell and dispense alcoholic beverages during the
hours provided herein.

(1) Establishments licensed under Section 56. 021(1) (a),
Section 564. 02 1 (a and Section 565. 02 1 a Florida .y`"r"
Statutes, are specifically included in the provisions of this /
ordinance with the exception that such establishments shall

(a) Beer or wine between the hours of 1200 P.M. Midnight
and 8:00 A. M. each weekday, and between the hours of
12:00 P. M. Midnight Saturday and I100 P. M. Sunday; or
(b) Liquor between the hours of 12:00 P. M. Midnight, and
8:00 A. M. each weekday, and between the 'hours of 12:00
P. M. Midnight Saturday and 8:00 A. M. Monday.
(2) Establishments licensed to sell alcoholic beverages for
consumption on the premises shall not dispense liquor
between the hours of 1:00 P. M. Sundays and 2 A. M.
Mondays for consumption off the premises. However, such
establishments may dispense packaged beer or wine during
such hours for consumption off the premises.
(3) Drugstores or prescription shops dealing only in medicines
and drugs dispensed for medical purposes shall not be within
the prohibitions of his ordinance.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Notice of proposed enactment of this ordinance has been
