BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Chapter 25, Vehicles for Hire, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to add thereto Article 111, Public Conveyances, to read as follows: ARTICLE III. Public Conveyances Division I, Generally Section 25..60. Definition. Public Conveyance. Any motor or other vehicle of whatever name called, except a taxicab as defined in Article I, which is used or operated for the purpose of transporting passengers for any fee, hire or compensation over, upon or along the public streets or highways of or in the City except regularly established bus lines. Section 25«61. Permit Required. No person shall operate a public conveyance without first obtaining a permit therefor as prescribed in this Article. Section 25«62. Application. 'tr 1f I (a) The owner of the vehicle and, if not owned by the applicant, 1 '. from whom the vehicle is leased or rented; (b) If the owner of the vehicle is a corporation, where the corporation is chartered, the amount of capital of the corporation, the officers thereof, and the name of the principal stockholders; (c) If the owner of the vehicle is a partnership, the name and residence of each partner; (d) A detailed tariff schedule to be charged for the vehicle; ',. (e) The applicant shall state, declare and agree that he will comply with all of the laws of the City and that for a violation of any of the provisions of this Chapter or of any of the other ordinances } ` " of the City, the City Manager shall have the power to cancel ; ;:,. :,°; 't ;." ?"?°'•q` and withdraw the permit and terminate the right of the person to use the streets or alleys of or in the City for such transportation ` business; ; (f) The applicant shall agree to maintain and keep in workable condition each vehicle for which a permit is sought. Section 25.63. Requirements for permit issuance. Before a permit required by this Article shall be issued by the Chief of Police, the operator of the public conveyance shall conform to the following requirements: (a) Pay to the City the occupational license tax required. (b) For each motor vehicle operated, file with the Chief of Police a corporate surety bond or policy of insurance in a solvent company authorized to do business in the State of Florida. Such bond or policy of insurance must be acceptable to and approved by the City Commission. The amount of liability insurance or surety bond for each vehicle shall be as follows- (1) An amount of not less than $50, 000 for any one person injured by reason of the negligent operation of the vehicle; (2) An amount not less than $100, 000 for more than one person so injured in any one accident; and (3) An amount not less than $10, 000 for all property damage in any one accident. (c) Provide the make and model of the vehicle and the year of its manufacture, together with the serial number of the vehicle and the seating capacity thereof. (d) Provide the State license number of the motor vehicle. Section 25-64. Issuance. After the applicant for a permit required by this Article shall 'have complied with the prerequisites for such a permit and if there is a permit available.for the operation of the type of public conveyance desired, the Chief of Police shall issue to the applicant i the permit sought. ?Jr? Emblem; display. 3r„ When an operator is granted a permit pursuant to this Article, the Chief of Police shall furnish to him a metal plate or disk, which metal plate or disk shall be securely fastened to the front of the motor vehicle for which the permit is issued. The metal plate or disk issued to the operator shall remain the property of the City and shall be returned to the City at the expiration or cancellation of the permit. Section 2566, Permit period. A permit issued pursuant to this Article shall conform to the fiscal year of the City and shall expire on the last day of September following ita issuance. Permits issued after the last day of March shall be issued for the balance of the fiscal year. Section 2567. Notice of substitution of schedule. The occupational'tax division shall be notified immediately of any change or replacement of a motor vehicle prior to placing the vehicle in operation on the City streets. Section 2568. Revocation and suspension. (a) Generally. The City Manager shall have power to revoke a permit issued pursuant to this Article where following notice to the permit holder and a hearing, it is shown that the operator has violated the provisions of this Article or of any other ordinance of the City in the maintenance or operation of a public conveyance. (b) Revocation upon cancellation or lapse of bond or insurance. The City Manager shall have power to revoke or suspend the permit issued to any person pursuant to this Article, where, following notice to the permit holder and a hearing, it is shown that any bond or policy of insurance required by this Article has been revoked or cancelled; provided, however, that such permit shall not be cancelled or revoked if at the time of the hearing the permit holder can produce a bond or policy of insurance as required by this Article and demonstrate that such bond or policy of insurance is in force for at least the balance of the fiscal year. Division U. Driver's Permit Section 25..69. Permit Required. Application, Y y? b {' T' r Y 'r (a) Each applicant for a permit required by this Division shall n=aE-r?'vw?..+" make application to the Chief of Police on forms provided by the Chief of Police, and in addition shall provide an affidavit ~• ?' that he is free of defective sight, hearing, heart trouble or :j any other infirmity, physical or mental, that would render him unsafe for the proper operation of a public conveyance; ,,;;;. .,.:,.,\;..? .b.r.;r,• and that he is not addicted to the use of alcohol or other drugs. In addition, the applicant shall obtain a physic al examination and shall submit a written report from the physician performing the exam detailing the results of such examination, E? "y '" +.• `?' (b) The applicant shall submit with his application evidence of a valid chauffer's permit. 4"4 .1rri?dad•?sii!:y '•(c) The applicant shall file with his application two (2) photographs ti 4 ry _. , of himself, which photographs shall have been taken within thirty (30) days next preceding the date of the application. (d) The Police Department shall take the applicant's fingerprints and affix the fingerprints to the application. Section 25..71. Review of Application; -rejection. (a) Upon the filing of the application required by this Division, the Chief of Police shall cause the same to be reviewed. If upon review the Chief of Police shall find that the applicant has made any false or misleading statements in his application, that the applicant is not physically or mentally capable of safely operating a public conveyance, that the applicant is addicted to alcohol or other drugs or any similar cause, he shall deny the application. (b) For the purposes of the review provided herein, the Chief of Police may require the applicant to submit to a physical examination and an examination related to the applicant's knowledge of traffic regulations and his skill and ability to drive a public conveyance. If the results of such examinations are unsatisfactory, the Chief of Police shall deny the permit. Section ZS-72. Issuance; fee; pern-dt'period. (a) Upon the satisfactory fulfillment of the requirements of this Division, the Chief of Police shall issue to the applicant the permit required by this Division; the permit shall be issued only upon the payment by the applicant to the City of a fee in the sum of Two Dollars ($2.00). (b) All permits issued pursuant to this Division shall conform to the fiscal year of the City and shall expire on the last day of September following their issuance regardless of the date of the. issuance of the permit. Permits may be renewed where an application for renewal is filed with the Police Department on or before August 1, prior to, the expiration date of each permit. Where the Chief of Police determines that an applicant for renewal continues to possess a valid chauffer's permit; that the report of physical examination submitted by his physician is not more than twelve (12) months old; that the applicant remains free of defective sight, hearing, heart .; ; trouble or any other infirmity,' physical or mental that will render him unsafei for the proper operation of a public conveyance; r... Each applicant for renewal shall pay a fee of Two Dollars ($2. 00) for each such renewal. Section 25-73. Issuance of metal badge. Upon the issuance of a permit required by this Division, the driver shall be provided with a metal badge containing a number on its face. It shall be unlawful for a driver to drive any public conveyance unless he has on his person at all times when driving the issued badge in full and plain view. Section 25-74. Revocation or suspension. (a) The City Manager shall have power to revoke any permit issued pursuant to this Division where following notice to the permit holder and a hearing, it is shown that the holder of the permit has been guilty of any violation of this code. (b) Upon the conviction of a driver of a public conveyance of the violation of this Chapter, the Court may, in addition to any other penalties, revoke or suspend the driver's permit issued pursuant to this Division. Such revocation or suspension shall be reported by the Court to the Chief of Police. (c) Whenever a permit issued pursuant to this Division is revoked or suspended as provided herein, the driver shall immediately surrender the metal badge issued to him to the Police Department. It shall be unlawful for any driver to fail to refuse to surrender the metal badge issued to him where the permit issued pursuant to this Division is suspended or revoked. Section 2. Any person, organization, society, association or corporation, or any agent or representative thereof, who shall violate or fail to comply with the provisions of this ordinance shall be subject, upon conviction, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment for not exceeding sixty (60) days, or by both such fine and imprisonment. Each day any violation of the provisions of this ordinance shall continue shall constitute a separate offense. Section 3.
