PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE ;. EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; DECLARING THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE HEALTH SAFETY AND WELFARE OF THE CITIZENS OF THE CITY; AND PROVIDING FOR THE EFFECTIVE DATE t,?E? „ti:',? : r .> ' OF THIS ORDINANCE. 1 ; ; 4. f ?.• WHEREAS, the present traffic code of the City of Clearwater does not specify fine amounts for specific charges, in particular parking ticket charges; and WHEREAS, similar problems have arisen in both Dade and Hillsborough Counties resulting in rulings that.parking tickets were invalid for lack of penalty provisions; and WHEREAS, an emergency exists within the City of Clearwater in that it id immediately necessary to provide specific penalties for parking violations in order that the City of Clearwater may have an enforceable Parking code thereby Preserving the health safety and welfare of the citizens of the City of Clearwater; NOW, THEREFORE, BE IT ORDAINED BY THE CITY` COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Article IV, Stopping, Standing and Parking, of Chapter 22, Traffic, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to enact a new Division 3 thereof to read as follows: Division 3. Fines, penalties and procedures. Section 2z-131. Fines. '_; 0 i e., =i 77' T (954 (3) Double parking $5.00 (4) No parking zone, including but not limited to parking without permit, parking near fire plug, in reserved space, in alley, on sidewalk, near railroad, near intersection, in driveway, loading zone, over curb in parkway $5.00 (5) Motor running--no attendant $5.00 (b) Keys in ignition $5.00 (7) Any other violations listed in Divisions 1 and 2 of Article IV of Chapter 22 of the Code of Ordinances $5.00 Section 22-132. Warning letters and penalties. Warning letter, in the form heretofore approved by the County Court, shall be mailed to the registered owner of vehicles when one (1) ticket has been unpaid for a period of three (3) days. The original fine due shall be doubled upon the mailing of the warning letter. Warning letters shall be mailed on a weekly basis. Section 22-133. Warrants. Warrants, in the form heretofore approved by the County Court, for the arrest of Pinellas County owners of vehicles who have failed to pay double the amount of the original fine on parking violations within the ten (10) day period specified in the warning letter, shall be issued by the Clerk of Court. These warrants shall be issued on a weekly basis. Bond shall be set on such warrants at double the amount of the original fine. Bond on such warrants shall be made returnable in accordance with instructions from the Traffic Division of the Court. Section 2. All ordinances or parts of ordinances in conflict herewith to the extent of such conflict are hereby repealed. Section 3.' Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4.
