1598i° 0 ORDINANCE NO. 1598 0 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, --- ---» AMENDING CHAPTER ZZ, TRAFFIC, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO PROVIDE THAT IF TREES AND SHRUBBERY OBSTRUCTING A DRIVER'S VISION IS NOT TRIMMED OR REMOVED AFTER NOTICE THEREOF, THE CITY SHALL HAVE THE NECESSARY ACTION TAKEN TO RELIEVE AND TERMINATE SUCH TRAFFIC HAZARD AND CHARGE THE COSTS THEREOF TO THE REAL PROPERTY OWNER; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section ZZ-30, Trees and shrubbery obstructing driver's vision..-Right of City to trim or remove, of Article I, In General, of Chapter 22, Traffic, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section ZZ-30. Trees and shrubbery obstructing driver's vision-- Right of City to trim or remove. If after the service of the notice herein provided, the owner or occupant does not comply with the directions contained in such notice within the time specified or does not have an appeal granted by the City Commission, the City Manager shall have the necessary action taken to relieve and terminate such traffic hazard, either by having such trees or shrubbery trimmed or by having it or them removed, and charge the costs thereof to the real property owner. Section 2. Any person, organization, society, association or corporation, or any agent or representative thereof, who shall violate the provisions of this ordinance shall be subject, upon conviction, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment for not exceeding sixty (60) days, or by both such fine and imprisonment in the discretion of the Judge. . w lw :A. , i j=.1 .. ;. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not .affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Chapter 166. 041, Florida Statutes. Section 6. This ordinance shall become effective immediately upon its passage.
