WHEREAS, on September 4, 1975, and on September 18, 1975, the
City Commission of the City of Clearwater, after proper public notices, held
public hearings on certain proposed changes to the zoning atlas and zoning
ordinance of the City of Clearwater in accordance with procedure as established,
which hearings were continued until October 16, 1975, and thereupon
completed; and
WHEREAS, certain of the proposed changes and amendments to the zoning
atlas and zoning ordinance were approved by the City Commission after its
evaluation of all evidence presented at the public hearings and continuations
thereof;
NOW, THEREFORE, BY IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 1975, " as amended, is amended to
indicate that fact as hereinafter set out:

Section 2. Article II, Definitions, of Appendix A, Zoning, of the
Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended by adding thereto new sub-sections (35. 1) and (35. 2) to read
as follows:
Article II, Definitions.
(35.1) HELIPORT: An area, located at ground level or elevated
on a structure, used by a helicopter or any similar motor
vehicle or contrivance for vertical flight now known or
hereafter invented for landing and takeoff and shall include
support facilities necessary for such craft, including but not
limited to parking areas, waiting room facilities, storage
areas and fuel and maintenance facilities.
(35. 2) HELISTOP: Shall mean a heliport located at ground level
or elevated on a structure for the landing and takeoff of a
helicopter or any similar motor vehicle or contrivance for
vertical flight now known or hereafter invented, excluding
therefrom all support and maintenance facilities.
Section 3. Article XVII, CTF»-Commercial-Tourist Facilities Use
District, of Appendix A, Zoning, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, is amended by adding thereto a new Section
17. 031 to read as follows:
Section 17. 031. Prohibited Uses.
The following uses are prohibited in the CTF--Commercial-
Tourist Facilities Use District;
(1) Heliports and helistops. This prohibition shall not apply
to helicopters engaged in performing emergency or law
enforcement activities.

Regulated in Article XXXV, Section 35. 09, to enact a new sub-section (12)
to read as follows:

Section 26. 04. Prohibited uses.

apply to helicopters engaged in performing emergency
or law enforcement activities.
Section 11. Article XXIX, AL-..Aquatic Lands District, of Appendix
A, Zoning, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
is amended by amending Section Z9. 06, Prohibited Uses, to read as follows:
Section Z9. 06. Prohibited uses.
There shall be no other uses than those itemized above. In
addition there shall be no drilling of gas or oil wells; excavation
of minerals, except the dredging of dead oyster shells as approved
by the department of natural resources; no heliports or helistops
(this prohibition shall not apply to helicopters engaged in performing
emergency or law enforcement activities); and no erection of structures
(other than docks and seawalls) within this district unless such activity
is associated with activity authorized by this zone district.
Section 1Z. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 13. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 14. Any person, or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500. 00), or imprisonment in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the discretion
of the Judge. Each day that a violation is permitted to exist shall constitute
a separate offense.
Section' 15. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.

Section. 16. The Planning Director is directed to include and set"out 1
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 17. The provisions of this ordinance shall take effect
immediately upon its passage.
