1578Tr, N, R „ ORDINANCE NO. 1578 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, REPEALING SECTIONS 5.2, 5.10 AND 5»39 OF CHAPTER 5, ANIMALS AND FOWL, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, AND ENACTING NEW SECTIONS TO DEFINE THE TERMS USED IN THIS CHAPTER; TO PROHIBIT KEEPING OF ANIMALS, BEES, REPTILES, FOWL AND LIVESTOCK, EXCEPT AS OTHERWISE PROVIDED; TO REGULATE BEEKEEPING WITHIN CERTAIN ALLOWED ZONING DISTRICTS BY PROVIDING FOR THE ISSUANCE OF PERMITS AND FOR THE RENEWAL THEREOF, AND ESTA BLISHING PROCEDURE FOR REVOCATION OR SUSPENSION OF THE PERMIT BY THE CITY MANAGER AFTER INVESTIGATION AND A DULY NOTICED HEARING; PROVIDING EXEMPTIONS TO THE PROVISIONS HEREOF; PROVIDING A PENALTY FOR FAILURE TO COMPLY HEREWITH; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Sections 5-2, 5-10 and 5_39 of Chapter 5, Animals and Fowl, of the Code of Ordinances of the City of Clearwater, Florida, 1962, are hereby repealed in their entirety and the following new Sections are hereby enacted to read as follows: Section 5..2. 1 Definitions. The following terms as used in this section shall have the following meanings: (1) Animal shall mean any mammal, bird, fowl, reptile, monkey, chimpanzee, bee or other dumb creature, including but not limited to horse, cow, goat, sheep, pig, mule, goose, dog, cat, calf, rabbit, hamster or mouse. (2) At lar a shall mean any animal off the premises of its owner and not under restraint, leash or chain, or not otherwise controlled by any person. (3) Harbor or harbored shall mean to furnish shelter or food. (4) Kennel shall mean any person, firm or corporation engaged in the commercial business of breeding, buying, selling or boarding of dogs or cats. (5) Owner shall mean any person, firm, partnership or corporation owning, having an interest in, or having control, custody or possession of any animal. ".Ord01578 (6) Person shall include any individual, partnership, corporation, proprietorship, trust or association of persons. NIR?ie ?? Section 5+•2. Z Keeping of animals, bees, reptiles, fowl or livestock prohibited. No animals, and in particular an animal which by its nature is wild and untamed, boos, reptiles, fowl or livestock, including horses, mules, cows, sheep, hogs or calves, except as otherwise provided in this Chapter, shall be kept, harbored, raised or permitted to run at large on any property either public or private within the City Limits of Clearwater by any person. Section 5.Z. 3 Beekeeping. The keeping of boos shall be allowed in all non-residential zoning districts and RS-200 Zoning Districts within the City of Clearwater, Florida; provided, however, that when bees are to be kept in urban zoning districts, including but not limited to, the following provisions shall apply: (1) No such beekeeping shall be allowed until the person proposing to function as a beekeeper first secures a permit from the City Forester and pays a fee of $5. 00. (2) No permit to conduct a beekeeping operation maybe granted until the City Forestor determines that the following conditions have been met: (a) The density of bee colonies on any proposed lot may not exceed one (1) colony of bees for each 2500 square feet of lot area. (b) The proposed colony of bees may not be located within fifty (50) feet of any property line. (c) A person applying for a beekeeping permit must have available and continue to maintain a fresh source of water on his lot for bees that will be located on the lot during the times that bees fly from hives. (d) Any colony to be located on a lot shall be maintained in smooth frame hives and mature colonies shall be housed in two full-depth brook chambers. (e) The proposed location of the bee hive will not result in the creation of a danger to the health or safety of persons in the immediate vicinity of the site where it is proposed to locate the bee hive. I;I?•riw'?_,?'?? `?Y', o•-i ?!'{fit. 1 3 j? a • 4 Section 5-2.4 Renewal Permit. k The permit required shall expire on the last day of September following its issuance regardless of the date of issuance of the permit. " Permits required by this Chapter may be renewed where an application for renewal is filed with the City Forester on or before August 1, prior to the expiration date of such permit. Each applicant for renewal shall pay a fee of $2. 00 for each such renewal. Section 5•-2.5 Approval of application for renewal. Upon receipt of an application for renewal the City Forester shall make an investigation and shall approve the application for a renewal permit if he finds the following: (1) That the provisions set out in Section 5..2. 3 for the issuance of a permit are being complied with. (2) That conditions have not changed in the vicinity of the lot where the beehive is maintained such as will result in the creation of a danger to the health or safety of persons in the immediate vicinity if a renewal permit is issued. (3) That the continued retention of the beehive on the property where it is maintained will not result in the creation of a public nuisance if the renewal permit is issued. Section 5-2.5 Revocation or suspension. The City Manager shall have the power to revoke or suspend the permit required by Section 5-2. 3 of the Code of Ordinances of Clearwater, Florida, or any renewal permit issued pursuant to Section 5..2.5 of the Code of Ordinances if, after investigation and a duly noticed hearing, the City Manager finds any of the following to be true: (1) The permit holder is in violation of Chapter 5 as it relates to keeping bees or has violated any zoning, health or building code relating to the keeping of animals; or (2) The permit holder has failed to maintain a fresh water source for the bees located in his hive; or (3) The permit holder's continued maintenance of the beehive on his property will endanger any person or property. If, after investigation, the City Manager concludes that it is probable that one or more of the above grounds for revocation has occurred, he shall cause written notice thereof to be transmitted by registered mail to the address of the permit holder. The notice shall specify the grounds of possible revocation of the permit and shall provide a date and time for an informal hearing to be held before the City Manager thereon. The provisions of Section 5,2.2 of the Code of Ordinances of the City of Clearwater, Florida, shall not apply to the following: ` ' 1) Owners who use animals for diagnostic purposes or research " ?'-`? °, ''•?-r;;:, ; r. and who have secured a valid permit, where required, issued,. : ; , ;•,.ti yR+f' ,: 'r ,s by a governmental agency and whose animals are kept on the _ premises specified in the permit." (2) Owners who use animals for teaching purposes in recognized educational institutes and whose animals are kept on the premises of the institution or other authorized place. :a (3) Owners of establishments which treat or board animals on the promises and which are owned or operated by veterinarians licensed by the State of Florida. (4) Owners who are engaged in agriculture as a permitted use pursuant to the zoning ordinance of the City of Clearwater, Florida, and in connection therewith on the premises affected 1i keep horses, cows, hogs, sheep, calves, mules, or raise animals as farm animals in dairying and animal and poultry husbandry. (5) Owners of horse riding academies and public horse stables and premises on which they are operated as a permitted use pursuant to the zoning ordinance. (6) Owners of horses and other animals and the premises on which they are permitted to be kept for recreational purposes accessory to the residential use of property as permitted by the zoning ordinance. (7) Owners of establishments licensed to keep animals for the purpose of resale whose animals are kept on the premises of such establishment or other authorized place. (8) Owners of dogs, birds, domestic cats and other family pets such as white mice, hamsters and rabbits. The owners of such animals must keep the same on the premises of the owner and such animals shall not be allowed to run at large by the owner. Further the owners of such animals are required to remove all excrement deposited by their animals on City of Clearwater property or on the private property of other persons. Penalty for Violation of Certain Code Sections, Any person who shall violate qny provision of Sections 5-2. 2, t 5-2. 3, 5-z. 4, 5-2.7, 5-4, 5.5, 506, 507, 508, 5-9, 5-16 through 1 5-21, 5-29 and 5-30 shall be punishable by a fine of not more than One Hundred Dollars ($100.00). Each separate occurrence in violation of the sections enumerated herein shall constitute a separate and distinct offense. Section Z. All ordinances or parts of ordinances in conflict herewith are.to the extent of such conflict hereby repealed. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance 1 with Chapter 166. 041, Florida Statutes. Secti6n-5.
