AMENDING THE CAPITAL IMPROVEMENT PROGRAM REPORT
AND BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, ,
19740 AND ENDING SEPTEMBER 30, 1975, TO REFLECT AN
EXPENDITURE INCREASE OF $150, 000 TO ALLOW THE WATER
SUPPLY SYSTEM UPGRADING NECESSARY FOR ADEQUATE
FIRE PROTECTION PURPOSES IN THE UNINCORPORATED
AREA SERVED BY THE CLEARWATER FIRE DEPARTMENT
AND TO REFLECT A REVENUE INCREASE OF $150, 000 FROM
UNALLOCATED WATER AND SEWER RENEWAL AND
REPLACEMENT FUND; PROVIDING FOR THE SEPARABILITY

PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, the Capital Improvement Program Report and Budget for
the fiscal year beginning October 1, 1974, and ending September 30, 1975,
was adopted in accordance with the Charter of the City of Clearwater, Florida,
and Chapter 166, Florida Statutes, the Municipal Home Rule Powers Act,
by Ordinance No. 1536; and
WHEREAS, an unanticipated increase in expenditures of $150, 000
to allow the water supply system to be upgraded for adequate fire protection
in the unincorporated area served by the Clearwater Fire Department,
necessitates increasing the appropriations authorized by the City Commission; }
and
WHEREAS, the unallocated water and sewer renewal and replacement fund i-;

has a positive balance sufficient to cover this extraordinary expenditure;
and
WHEREAS, Section 85 of the Charter of the City of Clearwater authorizes
the City Commission to provide for the expenditures of moneys for proper Iffi "',
purposes not contained in the budget as originally adopted due to unforeseen
circumstances or emergencies arising during the fiscal year;
NOW, THEREFORE, BE IT ORDAINED BY TI-M- CITY

Section 1. That the City Manager' s Annual Capital Improvement
Program Report and Budget for the fiscal year beginning October 1, 1974,
and ending September 30, 1975, as previously adopted by Ordinance No. 1536,
be amended to reflect a revenue increase of $150, 000 from unallocated water
!r and sewer renewal and replacement fund and an expenditure increase of

$150, 000 for upgrading the water supply system for adequate fire protection
for the unincorporated area served by the Clearwater Fire Department.
Section 2. Should any section, paragraph, sentence, phrase, clause
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole, or
any part thereof, other than the part declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed to
the extent of their conflict.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166, 041, Florida Statutes.
Section 5. This ordinance shall become effective immediately upon
its passage.
