Chapter 9, Fire Prevention, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended by enacting a new Section 9-15, Prohibiting Smoking in Specified Places, to read as follows: Section 9-15 - Prohibiting Smoking in Specified Places.`. i 1. Definitions. For the purpose of this section, the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory. (a) "City" is the City of Clearwater. a ?• ? (b) "Commission" is the City Commission of the City of Clearwater. (e) "Institutional Buildings" are those used for purposes such as medical or other treatment or care of persons suffering from physical or mental illness, disease or infirmity; for the care of infants, convalescents or aged persons; and for penal or corrective purposes. (f) "Smoke" or "Smoking" shall mean and include the carrying of a lighted pipe, cigar or cigarette of any kind, or the lighting of a pipe, cigar or cigarette of any kind. (a) Retail Stores. All retail stores designed and arranged to accommodate more than one hundred (100) persons, or in which more than twenty-five (25) persons are employed, or any retail store or business establishment whose owner or lessee desires to apply the provisions of this ordinance. This shall include drug stores, variety stores, food stores and supermarkets. (1) The prohibition of (a) above shall not apply to smoking in rest rooms, restaurants, executive offices, barber shops or beauty parlors in retail stores when specifically approved by the Fire Inspector by written order to the person having control of the premises upon a finding that such use therein is not dangerous to life or property. (2) The prohibition of (a) above shall apply only to retail stores within a shopping mall and shall not apply to other public areas of the mall. (b) Elevators. All elevators, regardless of capacity. (c) Beds in Public Lodging Houses. In beds in hotels, dormitories, rooming and lodging houses and institutional buildings, except for bedridden individuals who are under the close supervision of responsible persons. (1) Placarding required. A printed notice advising the occupant of the effect of sub-section (c) above shall be posted in a conspicuous place in every sleeping room of the buildings enumerated in said sub-section (c), (d) Waiting rooms or public hallways of every private or 2ublic health care facility, including, but not limited to, hospitals, clinics, doctors I offices of all types. (1) The prohibition of (d) above shall not prevent the establishment of a separate waiting room or area in which smoking is permitted, properly signed, as long as there exists a waiting room or area in the same facility in which smoking is prohibited. Ord. 2. Smoking Prohibited in Specified Places. It shall be unlawful for any person to smoke or carry a lighted cigar, cigarette, pipe or match, or use any spark, flame or fire-producing device not specifically authorized for use in such place by the Fire Inspector in any of the following places: -2 - `#a.5ss }} r Y ? ,. }.. {1 is 5 r-M .. =?' ;'r r. During a performance in enclosed places{ , which are primarily used for or designed for the purpose of ? Y?. , , li =f Y' '':fi„?;-k x'd?} exhibiting any motion picture stage drama lecture musical recital, or other similar performance. (1) Exception for approved areas. The prohibition of (e) ?• ;',"'fir #" '?- r above shall not be applied to smoking rooms and areas and rest rooms when specifically approved by the Fire Inspector by written order to the person having control of the premises upon a finding that such use therein Is not dangerous to life or property. (2) Exception for performers. The prohbition of (e) above shall not be construed to prohibit smoking by ;:;?',4;°`'?"'?;`'6<t , Performers upon the stage as p any theatrical part of any theatrical production. ?,??•;? ? • Nei; ' (f) Public Assembler Meeting Rooms in Public Buildings and in Meeting Rooms in Private Buildings when in use by Public. L r., (1) The prohibition of (f) above shall not apply to private meetings of private clubs in private facilities or to private parties held in public facilities, but smoking at private affairs in public meeting room facilities must be approved in advance by the Fire Inspector. (g) Public Museums, Galleries and. Libraries. (1) The prohibition of (g) above shall not apply in the office sections of such facilities if approved by the Fire Inspector. Qi) Projection Booths. Any projection booth, enclosure or other room in a public place in which any motion picture machine is operated. (i) Public Conveyances . Street cars, buses, trackless trolleys, or other public conveyances, except taxicabs and jitneys. (j) Dance Floors. Dance floor of any cabaret, restaurant, night club or other public place offering facilities for dining and dancing. (1) The prohbition of (j) above shall not apply to smoking in other areas of said cabaret, restaurant, night club or other public place offering facilities for dining and dancing. 3, Violation by Persons Having Control. It shall be unlawful for any person, or his agent, having control of any premises or place, to knowingly permit a violation of this Section. 4. Authority of Fire Inspector. The Fire Inspector shall have the authority to order "No Smoking" signs erected in any place of public assemblage where, in his opinion, smoking or the carrying of a lighted cigar, cigarette, pipe or match, or any use of any spark, flaine or fire-producing device not specially authorized for use in such place would constitute a menace to life or property. 5; Placarding Required. Every person, or his agent, having control of premises upon which smoking or the carrying of lighted objects is prohibited by or under the authority of this Section, shall conspicuously display upon the premises a sign reading "No Smoking by City Ordinance". It shall be unlawful for any person to smoke in any properly placarded place, or for any person to remove or cause to be removed any placard required to be erected by or under the authority of this section. T. Throwing Hot or Burning Substances. It shall be unlawful for any person to throw hot or burning substances or objects such as cigars, cigarettes, or the contents of a burning pipe, papers, matches and ashes from windows and doors of any building or public place or from any moving vehicle. r 8. Placing Lighted Objects Close to Combustible Matter So ' Identified by a Sign. It shall be unlawful for any person to throw or place hot or burning substances or objects such as cigars, cigarettes or the contents of a burning pipe in, upon or in close proximity to any public or private premises, object or structure, w or in any public street or place where there is any material or condition which is combustible, or liable to damage by heat, ?'j fire or explosion and said combustible matter has been so identified by a sign placed thereon. 9. Exceptions. (a) Prohibitions above shall not apply to restaurants, coffee shops, snack bars, or lunch counters, either as separate retail facilities or in combination with a business so covered by this section; provided that in such case the said facility is separated from the remainder of the business by some type of divider. (b) This section shall not apply to lobbies or dining rooms, or rooms while in use for dining, of hotels, motels, retirement homes, etc. , except at the option of the owner. (c) This section shall not apply to banks, savings and loan institutions and stock brokerage firms except in regard to meeting rooms which they make available to the public. (d) This section shall not apply to any private club facilities ' within the City. Section 2. Owners and managers of all business establishments or firms not covered by this section are encouraged to, and may at their discretion, post "No Smoking" signs within various areas of their business and utilize the provisions of this ordinance. Section 3. Any person, organization, society, association or corporation, or any agent or representative thereof, who shall violate the provisions of this ordinance shall be subject, upon conviction, to a fine not exceeding the sum of Five Hundred Dollars ($500.00), or imprisonment for not exceeding sixty (60) days, or by both such fine and imprisonment in the diecretion-of the Judge. Should any part or provision of this ordinance be declared by a court of competent, jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 6. This ordinance shall become effective immediately upon its passage.
