AMENDING THE BUDGET FOR THE FISCAL YEAR BEGINNING

WHEREAS, the budget for the fiscal year beginning October 1 1974, and ending September 30, 1975, for operation purposes, including pensions ;•, , ``: ,i?

' and debt service was, adopted in accordance with the Charter of the City of "IX3°t:..
Clearwater, Florida, and Chapter 166, Florida Statutes, the Municipal Home
Rule Powers Act, by Ordinance No. 1535; and
WHEREAS, the unanticipated expenditure of $125, 000 in settlement
of the suit styled Elizabeth Wysor, as Administratrix of the Estate of Fredric
Johnston Wysor, Jr. , deceased, vs. City of Clearwater and The Home Insurance
Co. , Circuit Civil No. 74-r6581-16, necessitates increasing the appropriations
authorized by the City Commission; and
WHEREAS, the General Fund surplus has a positive balance sufficient
to cover this extraordinary expenditure; and
i, WHEREAS, Section 85 of the Charter of the City of Clearwater authorizes
the City Commission to provide for the expenditure of monies for proper purposes
not contained in the budget as originally adopted due to unforeseen circumstances
or emergencies arising during the fiscal year;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the City Manager's Annual Report and Budget for the
fiscal year beginning October 1, 1974, and ending September 30, 1975, as
previously adopted by Ordinance No. 1535, be amended to reflect a revenue
increase of $125, 000 from unappropriated surplus and an expenditure increase
of $125, 000 for non-departmental expenses.

Section 2. Should any section, paragraph, sentence, phrase, clause
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole, or
any part thereof, other than the part declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed to
the extent of their conflict.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 5. This ordinance shall become effective immediately upon
its passage.
