ORDINANCE NO. 1559
AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1975, AS
AMENDED, BY RECLASSIFYING AND ZONING CERTAIN
PROPERTY AS DESCRIBED HEREIN; BY PROVIDING
FOR REPEAL OF ORDINANCES OR PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; HY PROVIDING FOR THE SEPA-
RABILITY OF THE PROVISIONS HEREOF; BY PRO-
VIDING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE; BY PROVIDING FOR PROPER NOTICE OF
PROPOSED ENACTMENT; AND BY PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.

WHEREAS, on February 17, 1975, the City Commission of
the City of Clearwater, after proper public notice, held a public
hearing on certain proposed changes to the zoning atlas of the City of
Clearwater in accordance with procedure as established; and .

WHEREAS, certain of the proposed changes and amendments
to the zoning atlas were approved by the City Commission after its
evaluation of all evidence presented at the said public hearings and
continuations thereof;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated, and
"The Zoning Atlas of the City of Clearwater, Florida of 1975, 11 as
amended, is amended to indicate that fact as hereinafter set out:
Zoned as RS-100-Single Family Residential District
1. Commencing at the center of Section 29, Township
28 South, Range 16, East, Pinellas County, Florida,
run N 68° 28120" E 1, 280.28 feet for a Point of begin-
ning. Run thence N 10 0010011 W 165. 40 feet : run
thence S 87° 0010011 E 54.68 feet, thence 267. 80 feet
along the arc of a curve to the right, radius 1, 765. 00
feet, chord S 82° 39112" E, 267. 54 feet; thence
357. 75 feet along the are of a curve to the right,
radius 965. 00 feet, chord N 34° 2214611 E, 355.71'
feet; thence N 20° 3115111 E 297. 53 feet; thence S 89' 001001!

Section 2. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the same
shall not affect the validity of the ordinance as a whole, or any part
thereof other than the part declared to be invalid.
Section 4. Any person, or persons, firm or corporation or
association of persons, who shall violate or fail to comply with any of
the terms or provisions of this ordinance shall, upon conviction in the
Municipal Court, be fined not exceeding the sum of Five Hundred Dollars
($500. 00), or imprisonment in the City Jail for not exceeding sixty (60)
days or by both such fine and imprisonment in the discretion of the
Municipal Judge. Each day that a violation is permitted to exist shall
constitute a separate offense,

Section 5. Notice of the proposed enactment of this ordinance ?.'
has been properly advertised in a newspaper of general circulation in
accordance with Chapter 166. 041, Florida Statutes.
Section 6. The Planning Director is directed to include and set
out and show upon the official zoning atlas of the City of Clearwater the
foregoing amendments as hereinabove set out.
