AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 6, BOATS, DOCKS AND WATERWAYS,
OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962, TO PROHIBIT OPERATING A BOAT IN THE
WATERS OF THE CITY IN SUCH A MANNER AS TO CREATE
AN EXCESSIVE OR DAMAGING WAKE IN AREAS DESIGNATED
NO WAKE ZONES; DEFINING AN EXCESSIVE OR DAMAGING
WAKE; AUTHORIZING HARBORMASTER TO DESIGNATE
AREAS WHERE SPEED AND/OR WAKE OF BOATS SHOULD BE
CONTROLLED AND TO POST SUCH AREAS; DEFINING AREAS
TO BE DESIGNATED AS NO WAKE ZONES AND SPEED
LIMITATIONS THEREFOR; TO PROHIBIT OPERATION OF ANY
TYPE OF BOAT, VESSEL OR BARGE WITHIN A DISTANCE
OF THREE HUNDRED FEET FROM SHORELINE OF ANY
PUBLIC BEACH OWNED BY THE CITY; TO PROVIDE THAT.
NO BOAT OR WATERCRAFT SHALL BE MOORED OR OTHERWISE
PLACED IN SUCH A MANNER AS TO IMPEDE, RESTRICT
OR OTHERWISE INTERFERE WITH THE USE OF PUBLIC
DOCKS, LAUNCHING RAMPS OR OTHER PUBLIC WATER-
FRONT FACILITIES; TO PROVIDE THAT BOATS OR WATER-
CRAFT IN VIOLATION HE REOF SHALL BE SUBJECT TO
REMOVAL AND IMPOUNDMENT BY THE CITY AND COSTS
INCIDENT THERETO SHALL BE BORNE BY THE OWNER; TO
PROHIBIT THE ANCHORING OF VESSELS IN THE WATERS
OF THE CITY FOR ANY PERIOD IN EXCESS OF SEVENTY-
TWO HOURS IN LIEU OF MOORING AT A DOCK OR SIMILAR
FACILITY; PROVIDING A PENALTY FOR FAILURE TO
COMPLY HEREWITH; PROVIDING FOR REPEAL OF ORDI-
NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH
TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING
FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 6-8, Speed of boats--Designating, of Chapter 6,
Boats, Docks and Waterways, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, is hereby amended to read as follows:
Section 6-8. Speed of boats, excessive or damaging wakes--
Designating.
`r No person shall operate a boat or allow a boat to be operated
in the waters of the City in such a manner as to create an
excessive or damaging wake in areas designated NO WAKE
u
ZONES, or at a speed greater than the maximum speed t `
designated for the area by the Harbormaster, or, in his
absence, the Chief of Police. For the purposes of this section,
an excessive or damaging wake is defined as a wave created
by the passage of a vessel through the water which is capable
of causing damage to other watercraft, docks, seawalls, or
other property. In waterways so designated, all watercraft
shall be operated at the slowest speed' reasonably necessary,to
maintain steerageway and to conform to the dictates of safe,'"
navigation. In areas designated as NO WAKE ZONES, cre?tian
of any wave exceeding a vertical height of twelve (12) inches
from trough to crest shall constitute prima facie evidence of
an excessive wake or one having damaging capability.

Ordinances of the City of Clearwater, Florida 1962, is hereby amended to
enact a new Section 6-9. 1 to read as follows:
Section 6-9. 1 Speed of boats, excessive or damaging wakes--
Areas defined.
A. That area of Marina Channel as charted on National Ocean
Survey Chart 858 which lies between a point one hundred (100)
yards Northeast of Marina Channel Daybeacon 13 and a point
one hundred (100) yards South of Marina Channel Daybeacon 19,
together with all waters extending two hundred (200) yards to
the West of said area, is designated a NO WAKE ZONE.
B. That area of Clearwater Harbor, as charted on.National Ocean
Survey Chart 858, which lies West of a line beginning at the
shoreline nearest the Eastern terminus of Devon Drive (Latitude
27°58'Z4" N, Longitude 8Z°49123" W) and continuing Northeast
three hundred and fifty (350) yards to the South shoreline of
Memorial Causeway, is designated a NO WAKE ZONE.
C. That area of Mandalay Channel, as charted on National Ocean
Survey Chart 858, between the East shoreline of Clearwater Beach
and the West shoreline of Island Estates, South of Mandalay
Channel Daybeacon 4, and North of Memorial Causeway, including
the basin extending from Island Way to the fixed causeway bridge,
is designated a NO WAKE ZONE.
D. That channel connecting Marina Channel and Mandalay Channel
which passes beneath the fixed bridge at the West end of Memorial
Causeway is designated a controlled speed zone. No boat in this
channel may be operated at a speed in excess of four (4) nautical
miles per hour.
E. Other areas of waterways where unregulated operation of watercraft
present specific hazards to persons or property may be designated
and posted as controlled speed zones.

Section 4. Section 6-10, Boats, vessels, barges; where prohibited,
of Chapter 6, Boats, Docks and Waterways, of the Code of Ordinances of the
City of Clearwater, Florida, 196Z, is hereby amended to read as follows:
Section 6-10. Boats, vessels, barges; where prohibited.
No person shall operate any type of boat, vessel or barge,
whether mechanized or not within a distance of three hundred
(340) feet from the shoreline of any public beach owned by
the City of Clearwater, along the Gulf of Mexico side of
Clearwater Beach, Florida, except when within the designated
channel marked through Clearwater Pass, and except in case
of an emergency.
Section 5. Section 6-13, Mooring to private docks or beached without
permission, of Chapter 6, Boats, Docks and Waterways, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to
read as follows:
Section 6-13. Mooring, beaching, or placing of watercraft;
where prohibited.
No vessel or watercraft of any kind whatsoever shall moor to
or tie up to a private seawall or dock or be beached upon private
property within the City limits without the permission of the
owner thereof.
No boat or watercraft shall be moored or otherwise placed in
such a manner as to impede, restrict, or otherwise interfere
with the use of public docks, launching ramps or other public
waterfront facilities. Boats or watercraft in violation of this
section shall be subject to removal and impoundment by the
City, and costs incident thereto shall be borne by the owner.
Section 6. Section 6-20, Public anchorage, of Chapter 6, Boats, Docks
and Waterways, of the Code of Ordinances of the City of Clearwater, Florida,
196Z, is hereby amended to read as follows:
Section 6-20. Public anchorage.
Public anchorages within the City limits may be established
or designated only by the City Manager, or his authorized
representative. Therefoie, except as provided under Section
6-19 (b), and, except as further provided hereunder, the
establishment of permanent floating mooring devices, or the
anchoring of vessels in the waters of the City for any period
exceeding seventy-two (72) hours in lieu of mooring at a
dock or similar facility, is prohibited.
Public anchorages may be designated by the City Manager,
or his authorized representative, in which areas floating

mooring devices may be established by theCity or by private
parties, at the option of the City. Establishment or use of
such a device will require a permit from the City, for which
reasonable charges may be assessed, and no such device shall
be established or used prior to issuance of such permit.
Section 7. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the,
provisions of this ordinance shall be subject, upon convict ion in the Municipal
Court, to a fine not exceeding the sum of Five Hundred Dollars ($500.00),
or imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Section 8, All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 9. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 10. Notice of proposed enactment of this ordinance has been
properly advertised in a newspaper of general circulation in accordance with
Chapter 166. 041, Florida Statutes.
Section 11. This ordinance shall become effective immediately upon
its passage.
