': r ? ." e4 i • 0 ORDINANCE NO. 1549 00 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION B-57 OF CHAPTER 8, ELECTIONS, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO CLARIFY CAMPAIGNING REGULATIONS PERMITTING ANY ELECTED OFFICIAL OR EMPLOYEE OF THE CITY TO EXERCISE HIS RIGHT OF FREE SPEECH AND EXPRESSION OF OPINION ON ANY CANDIDATE OR ISSUE; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; DECLARING THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE HEALTH, SAFETY AND WELFARE OF THE CITIZENS OF THE CITY; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. ab Y BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Paragraph I of Section 8-57, Campaigning Regulations, of Article III, Candidates, of Chapter 8, Elections, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 8-57. Campaigning Regulations. 1. No employee or official of the City of Clearwater may use his official authority or influence for the purpose of coercing or influencing another person's vote, or directly or indirectly attempting to control the outcome of an election. This shall not be construed so as to limit the individual's campaigning in his own behalf, but shall apply to the campaigns of others. a Nothing contained in this section shall be deemed to prohibit any elected official of the City of Clearwater from exercising his right of free speech and expression of opinion on any candidate or issue. No employee of the City of Clearwater shall be denied the right of expressing his opinion on any candidate or issue or from participating in any political campaign during his off-duty hours as a private citizen. Section 2. All ordinances or parts of ordinances in conflict herewith a q are, to the extent of such conflict, hereby repealed. Section 3.
