1542¦. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 8-1, Time of holding general elections; officers to be elected, of Article I, In General, of Chapter 8, Elections, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 8-1. Time of holding general elections; officers to be elected; procedures. (1) Regular municipal elections shall be held on the second Tuesday in February of each year. The Mayor-Commissioner and two Commissioners shall be elected in odd-numbered years for two-year terms,- and two Commissioners shall be elected in even-numbered years for two-year terms. (2) Candidates for Mayor-Commissioner shall file for that particular office, and the candidate receiving the largest number of votes shall be elected. Candidates for City Commissioner shall file for that particular office, and the two candidates receiving the largest number of votes shall be elected. (3)A11 candidates shall run "at-large" and shall beelected by the duly qualified electors of the City of Clearwater. a. The City Commission prescribes the methods and manner for holding elections in the City of Clearwater, and the Supervisor of Elections of Pinellas County serves as registration officer for the City of Clearwater. b. Vacancies occurring on the City Commission between regularly scheduled elections are filled in accordance with the City Charter. An elector who moves from the City precinct in which he is registered may be permitted to vote in the precinct of former residence in any election prior to the next County general election. e. An elector whose name changes because of marriage or other legal process may be permitted to vote in the precinct where such person is registered under another name but that person must first obtain an affidavit from the Supervisor of Elections testifying to the change. (4) All individual candidates shall be permitted to have one watcher in each polling place from the beginning to the conclusion of each election, as designated in Chapter 101. ,131, Florida Statutes. Watchers must be designated and certified to the City Clerk at least five (5) days prior to the election. Section 2. Section 8-5, Qualifications of Electors, of Chapter 8, Elections, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 8-5. Qualifications of electors. Any person who shall possess the qualifications requisite to an elector at general state elections and who shall have been registered as provided in Section 161 of the Charter shall be a qualified elector of the City at any election, general or special, held in the City, except as provided in the Charter of the City for elections held for the purpose of authorizing loans and issuing bonds, granting franchises, or authorizing the levy of special taxes. Section 3. Section 8-15, Candidates--Refusal of Nomination, of Chapter 8, Elections, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 8,15. Candidates--Refusal of nomination. The name of no person shall be printed on the ballot who shall, not less than twenty (20) days before the election, notify the City Commission in writing that he will not accept the nomination specified in the certificate of nomination or request of electors. Candidates. Section B..52. Compliance with Applicable Statutes. e) After qualification by the candidates in accordance with the Charter and Code of Ordinances of the City of Clearwater as presently set forth or as hereafter amended, all candidates for the office of Mayor-Commissioner and City Commissioner of the City of Clearwater shall comply with all applicable laws, including the following: 1. The Federal Election Laws. Z. The Public Disclosure and Conflicts of Interest Act, Chapter 112,. Florida Statutes. 3. The Florida Election Code as set forth in Chapters 97 through 106, Florida Statutes. 4. Article II, Section 12, and Article XIV, Division 1 of the Charter of the City of Clearwater, Florida. 5. Chapter 8 and Chapter 18 of the Code of Ordinances of the City of Clearwater, Florida. The omission of any laws from this particular list shall not excuse the candidates from compliance therewith. Section 8-53. Candidates--requirements. 1. No individual may qualify as a candidate who holds another elective or appointive office-.State, County or Municipal-- the term of which, or any part thereof, runs concurrently with the term of office for which the individual seeks to qualify. If seeking to qualify, the individual must resign his current office not less than ten days prior to the first day of qualifying for the office he intends to seek. The resignation shall have the effect of creating a vacancy in the office currently held and shall become effective immediately but the officer shall continue to serve until his successor is elected and installed. 2. All candidates for the offices of Mayor-Commissioner or City Commissioner must be at least eighteen (18) years of age; must be legal residents of the City of Clearwater and sign an affidavit to that effect when filing for office; must file nominating petitions bearing the names of at least 250 qualified electors of the City of Clearwater; and must pay personally at the time of filing, a fee of Twenty-five Dollars ($Z5. 00). Candidates shall be nominated without knowledge of party affiliation or political belief. Section 8.54. Petitions. 1. Nominating petitions may be secured from the office of the City Clerk. 2. These petitions must be signed personally by at least two hundred fifty of the qualified electors of the City, in the exact manner as the signature of the qualified elector appears on the registration books of the Supervisor of Elections of Pinellas County. 3. Petitions shall contain the residence address of each signer. 4. Petitions shall be validated by the Supervisor of Elections. ' EM- -3. Candidates for the offices of Mayor-Commissioner or City Commissioner may file in the office of the City Clerk during regular business hours at Clearwater City Hall not more than sixty (60) and not legs than thirty(30) days prior to the day of the election. Prior to twenty (20) days before the scheduled election any candidate may withdraw his name from nomination, but no fee will be refunded. Section 8-55. Campaign period designated. °.r •i x. ? -4- 1. The sixty-day period prior to the regularly scheduled election on the second Tuesday of February of each year shall constitute the campaigning period. 2. A candidate may announce his intention to run prior to the first filing date; he may secure signatures on nominating petitions; and he may secure promises in regard to campaign contributions, workers and other types of assistance, but he may collect no funds prior to actually filing for office; he may expend or contract to expend no funds prior to filing; and he may not speak at public gatherings in furtherance of his candidacy or allow others to do so for him prior to filing. Section 8-56. Campaign Treasurer Required, 1. Upon filing for office each candidate shall appoint a campaign treasurer and may appoint not more than three (3) deputy campaign treasurers, and shall designate one primary campaign depository and may designate one secondary depository and shall file the name and address of each with the City Clerk. The candidate may designate himself or any other elector to act as campaign treasurer and may designate as his campaign depository any bank authorized to transact business. He may, at any time during the campaign, change his campaign treasurer or depository by properly notifying the City Clerk. 2. The campaign treasurer shall secure necessary forms from the City Clerk. By noon on the first Monday of each week after appointment, the campaign treasurer shall make to the City Clerk a full and complete report of all moneys received and all expenditures made in behalf of the candidate during the preceding seven (7) days. Reports shall be filed with the City Clerk, and continued in like manner until the campaign account is closed. 3. The weekly reports shall contain the names and addresses of each of the contributors, the amounts contributed, and the occupation of each contributor; and they shall contain a listing of the types of expenditures, the name of the firm or individual from whom the service was purchased, the address of the firm or individual, and the amount of expenditure. 4. All funds received by the campaign treasurer less than five (5) days before the election shall be returned by the campaign treasurer to the person contributing, and shall not be used or expended in behalf of the candidate or in furtherance of his candidacy. All funds received by the campaign treasurer in furtherance of the candidacy of any candidate between the time the candidate formally files for office and five days prior to the scheduled election shall, prior to the end of the second business day following the receipt thereof (Sundays and holidays excluded), be deposited in a campaign depository of such candidate In an account designated: "Campaign Fund of " 6. No contribution or expenditure of money or other things of value, nor obligation therefor, including contributions, expenditures, or obligations of the candidate himself or of his family, shall be made, received, or incurred directly or indirectly, in furtherance of any candidacy of any such candidate except through the duly appointed campaign treasurer of the candidate. 7. No expenses shall be incurred by a candidate unless prior to the incurring of the expenses there shall be on deposit in the candidate's campaign depository ample funds available to pay all such expenses incurred. B. No moneys shall be paid in behalf of the candidate's campaign except upon the presentation of a written order signed by the campaign treasurer of the candidate (prescribed forms must be obtained from the City Clerk) which authorizes the expenditure and unless that order is accompanied by a certificate from the person claiming the payment for the service rendered. No funds shall be withdrawn unless an order for payment of the claim properly signed by the campaign treasurer, and certified by the claimant is presented to the campaign depository. The order authorizing such expenditure, the certificate, and the order for payment shall be on the same piece of paper and shall be presented to the person rendering the service when the service is received. 9. Within forty-five (45) days after each election, the designated campaign depository shall file either the original or a true copy of all the deposit slips filed with the said depository by the campaign treasurer, and the original or a true copy of all authorizations of the campaign treasurer upon which funds were withdrawn from said depository. Such statement by the depository shall be filed with the City Clerk, 10. Any funds remaining in the campaign fund shall be returned to the candidate by the campaign treasurer and the fund closed. 11. The City Clerk and all campaign treasurers shall keep all records regarding each municipal election for a minimum of two (2) years; and all reports filed in accordance with this section shall be open to public inspection during the normal hours of operation of the office of the City Clerk. Section 8-57. Campaigning Regulations. C 1. No employee or official of the State, County or City may use O his official authority or influence for the purpose of influencing the nomination for office nor the election to office of an individual, ?ti"Y9 or coercing or influencing another person's vote, or directly or indirectly attempting to control the outcome of an election. This shall not include such things as transportation to the place of registration or baby-flitting in ?. connection with the absence of an elector from home for registering. 3. Candidates shall not promise any money, office, employment, or any other thing of value to secure nomination to office or election to office. However, this shall not apply to the serving of food to be consumed at a political rally or meeting; and it shall not apply ` t to furnishing transportation to the polls on election day, 4. No literature "against a candidate" shall be distributed a;'i` Erb ' on election day, and on the day of the election it shall be unlawful` for any person to distribute any political pamphlets, cards or literature, or solicit votes within 100 yards of any polling place. 5. Candidates shall not give or promise to give, pay or loan any money or other thing of value to the owner, editor, publisher, agent or employee of any communication media to advocate or oppose, through such media, any candidate for election. The above prohibition shall not apply to paid political advertisements. 6. Candidates for election shall not give, pay, expend or contribute any money or thing of value to further the candidacy of any other candidate running in opposition. 7. Candidates shall not furnish, give or deliver to another person any money or other thing of value, to be used by another person for any purpose prohibited by the election laws. 8. Candidates shall not falsely, wilfully or maliciously make charges against an opposing candidate. 9. Candidates, in the furtherance of such candidacy for nomination or election for public office in any election, shall not use the services of any officer or employee of the state during working hours. Section 8-58, Campaign Literature Requirements. 1. All advertising, materials, supplies, services, etc. to advance a candidate shall be reduced to monetary value and included in reports of contributions. 2. No candidate shall give money or anything of value for advertising in a publication or newspaper not qualified for legal advertising as provided by law, unless the publication has been published at least once each month for not less than twelve (12) months. 3. Political signs require permits from the City Building Department and are permissible only in areas zoned for business. No signs are permitted in City rights-of-way. 5. All bulletins, ads, programs, news sheets, magazines, pamphlets, brochures, handbills, etc. published and distributed advocating election or defeat of a candidate shall identify in a prominent place-- in print equal in size to or larger than the smallest print.appearing thereon--the publisher of such material, the person paying for publication thereof, and the name of the person expressing the views. " Political advertisement is an expression by any mass media, attracting public attention, whether radio, television, newspaper, magazine, periodical, direct mail, display, or by means other than the spoken word in direct conversation, which shall transmit any idea furthering the candidacy for public office of any person. Section 8-59, Contributions to Candidates. 1. No contribution shall be received or expenditure made by or on behalf of a candidate until the candidate files for office and appoints a campaign treasurer, 2. No contribution or expenditure, including contributions or expenditures of a candidate himself or of his family, shall be directly or in- directly made or received in furtherance of the candidacy of any person for nomination or election except through the duly appointed campaign treasurer. 3. No person, firm, corporation, or other entity shall contribute to a candidate to municipal office directly or indirectly in money, advertising, material, supplies, services, loans, or in any other manner whatsoever in an amount or value in excess of One Thousand Dollars, This shall not apply to the candidate personally or to his family. 4. No person, firm, corporation or other entity shall give, furnish or contribute moneys, advertising, material, supplies, services, loans, or in any other manner whatsoever, in support of a candidate for election, through or in the name of another, directly or indirectly. 5. All contributions shall be reduced to their monetary value and shall be included in all reports of contributions along with the name or names of the donor or donors. Section 5. It being specifically understood that prosecution for the violation of any of the said provisions may be commenced before, but not after, two years shall have elapsed from the date of the violation. Section 76 Should any section, paragraph, sentence or word of thi s ordinance be declared for any reason to be invalid, the same shall not 11 affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. f Section 8.
