THE EFFECTIVE DATE OF THIS ORDINANCE.

WHEREAS, the City of Clearwater has received many complaints
concerning landings and take offs of airplanes during the nighttime hours from ' i
residents of the area surrounding the airfield within the City of Clearwater; and z' r
such nighttime activities are dangerous and endanger the
WHEREAS

safety, the rest and repose of the surrounding residents; and
WHEREAS, the City of Clearwater has determined that an emergency
exists affecting the health, safety and welfare of the citizens of the City
and that this ordinance should be enacted at once;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Chapter 14, Offenses and Miscellaneous Provisions, of
the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended to add thereto a new Section 14-71 to read as follows:

Section 14-71. Nighttime landings and take offs of airplanes
prohibited; penalty.
It shall be unlawful for any person to land or take off in any
airplane during the nighttime hours within the City of Clearwater;
provided, however, that emergency landings may be made in
cases of fuel - shortage, inclement weather and in cases where
life, limb and property may be endangered. Further, it shall be
unlawful to conduct or permit any student flying or teaching at
night within the City of Clearwater. It shall be incumbent upon
the operator of any airport within the City of Clearwater to
prohibit such nighttime activities at the airport and especially
take off flights between one half hour after sunset and one half
hour before sunrise, and failure to comply with the provisions

hereof shall be considered a violation by the operator of the
airport, the pilot and/or the owner of the airplane. Whoever
shall violate the provisions of this section shall, upon conviction
thereof, be subject to a fine not exceeding the sum of Five Hundred
Dollars ($500. 00) or imprisonment in the City Jail for not ex-
ceeding sixty (60) days, or by both such fine and imprisonment
in the discretion of the Municipal Judge.
Section x. All ordinances or parts of ordinances in conflict herewith
are, to the extent of such conflict, hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
11 part declared to be invalid.
Section 4. It is hereby found, determined and declared that this
% ordinance is necessary and urgently needed for the preservation of the health,
safety, and welfare of the citizens and inhabitants of the City of Clearwater;
that an emergency is hereby declared; and that this ordinance shall be in full
force and effect immediately upon its passage.
