AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING TRACT A OF M. A. SMITHIS BAYVIEW SUB-
DIVISION; A PORTION OF SECTION 5, TOWNSHIP 29
SOUTH, RANGE 16 EAST AND A PORTION OF SECTION 12,
TOWNSHIP 29 SOUTH, RANGE 15 EAST, PINELLAS COUNTY,
FLORIDA, TOGETHER WITH ALL ABUTTING STREETS, INTO
THE CORPORATE LIMITS OF THE CITY OF CLEARWATER,
FLORIDA, AND REDEFINING THE BOUNDARY LINES OF
THE CITY TO INCLUDE SAID ADDITIONS, ACCORDING TO
THE PROVISIONS OF THE CHARTER OF THE CITY OF
CLEARWATER, FLORIDA, AND THE LAWS OF FLORIDA,
AFTER PROPER PUBLIC NOTICE AND PUBLIC HEARING
THEREON, ESTABLISHING THE ZONING USE DISTRICT
CLASSIFICATIONS AND THE FIRE DISTRICT CLASSIFICA-
TIONS FOR SAID PROPERTY; PROVIDING FOR PROPER
NOTICE OF PROPOSED ENACTMENT; AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE.

WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from James B. Nall and Gertrude S. Nall, his
wife, requesting the City to annex a certain parcel of real estate described
hereinafter, owned by them, into the corporate limits of the City of
Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on June 4, 1973, voted
unanimously to accept said request and authorized the proper officials to
set up a public hearing thereon for the determination and establishment of
zoning and fire district classifications and to prepare an ordinance to
annex said parcel of real estate into the corporate limits of the City of
Clearwater in accordance with the provisions of Section 6 (d) of the
Municipal Charter of the City of Clearwater and the Laws of Florida; and
WHEREAS, on July 16, 1973 and on December 10, 1973 the City
Commission of the City of Clearwater, after proper public notices, held
public hearings for the determination and establishment of zoning and fire
district classifications for said real property; and
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from the School Board of Pinellas County, Florida,

City to annex a certain parcel of real estate described hereinafter, owned by
it, into the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on November 19, 1973, voted
unanimously to accept said request and authorized the proper officials to set
up a public hearing thereon for the determination and establishment of zoning Ott'..;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CIZARWATER, FLORIDA:
Section I. After its evaluation of all evidence presented at a proper
public hearing, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Section 6 (d) of
the Municipal Charter of said City of Clearwater and the Laws of Florida,
hereby annexes into the corporate limits of the City of Clearwater, Florida,
and redefines the boundary lines of said City so as to include the following
described parcels of real property in Pinellas County, Florida, and
establishes zoning and fire district classifications therefor:
Tract "A" of Myron A. Smith's Bayview Subdivision, as
recorded in Plat Book 25, page 57, Public Records of
Pinellas County, Florida, less that portion presently in
the City limits of the City of Clearwater.
The above-described property is hereby zoned t'CG't (General
Business District) and designated Fire District No. 1.
AND
West 660 feet of the South 1/2 of the Northeast 1/4 of the
Southeast 1/4 of Section 5, Township 29 South, Range 16
East, Pinellas County, Florida, together with all abutting
streets.
The above-described property is hereby zoned 11P" (Public
I,and District) and designated Fire District No. Z.
AND
A parcel of land in the Southwest Quarter (SW 1/4) of the
Northeast Quarter (NE 1/4) of Section 12, Township 29 South,
Range 15 East, described as follows: From the Southeast
corner of the Southwest 1/4 of the Northeast 1/4 of said
Section 12, Township 29 South, Range 15 East, run thence
N 0' 0610011 E along the 40-acre line 40. 0 feet for the Point
of Beginning; thence continue N 0° 0610011 E along the 40-
acre line, 200. 0 feet; thence N 89° 18015" W, 230.0 feet
to the Easterly right-of-way of Kapp Drive; thence
S 0' 061001' W along said Easterly right-of-way, 200. 0
feet to the Northerly right-of-way of Palmetto Street; thence
S 89. 1811511 E along said Northerly right-of-way, 230.0 feet
to the Point of Beginning, together with all abutting streets.
The above-described property is hereby zoned "CS" (Commercial
Services District) and designated Fire District No, 1.
Section Z. The City Commission hereby formally and according to
law, accepts the dedication of all easements, streets, parks, plazas, places,

made by plat, deed or user within the areas so annexed.
Section 3. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official
zoning atlas and other Official maps and records of the City of Clearwater
3 the foregoing property and the zoning and fire district classifications therefor.
Section 4. Notice of the proposed enactment of this Ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166.041, Florida Statutes.
Section 5. This Ordinance shall become effective immediately upon
its passage and enrollment in the City of Clearwater Ordinance Book and a ,
certified copy thereof being recorded in the Office of the Clerk of the Circuit
Court of Pinellas County, Florida.

received a sworn petition from The Spare Room Corporation requesting the
City to annex a certain parcel of real estate described hereinafter, owned by
it, into the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission, after 'due consideration of said
request for annexation, at a regular meeting held on November 19, 1973, voted
unanimously to accept said request and authorized the proper officials to set
up a public hearing thereon for the determination and establishment of zoning
and fire district classifications and to prepare an ordinance to annex said
parcel of real estate into the corporate limits of the City of Clearwater in
accordance with the provisions of Section 6 (d) of the Municipal Charter of
the City of Clearwater and the Laws of Florida; and
WHEREAS, on December 17, 1973 the City Commission of the City of
Clearwater, after proper public notice, held a public hearing for the deter-

NOW, THEREFORE, DE IT ORDAINED 13Y THE CITY „
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at a propor
public hearing, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Section 6 (d) of
the Municipal Charter of said City of Clearwater and the Laws of Florida,
hereby annexes into the corporate limits of the City of Clearwater, Florida,
and rc Ietines the boundary lines of said City so as to include the following
described parcels of real property in Pinellas County, Florida, and
establishes zoning and fire district classifications therefor:
Tract "A" of Myron A. SmithIs Bayview Subdivision, as
recorded in Plat Book 25, page 57, Public Records of
Pinellas County, Florida, less that portion presently in
the City limits of the City of Clearwater.
The above-described property is hereby zoned "CG" (General
Business District) and designated Fire District No. 1.
AND
West 660 feet of the South 1/2 of the Northeast 1/4 of the
Southeast 1/4 of Section 5, Township 29 South, Range 16
East, Pinellas County, Florida, together with all abutting
streets.
The above-described property is hereby, zoned "P" (Public
Land District) and designated Fire District No. 2.
AND
A parcel of land in the Southwest Quarter (SW 1/4) of the
Northeast Quarter (NE 1/4) of Section 12, Township 29 South,
Range 15 East, described as follows: From the Southeast
corner of the Southwest 1 /4 of the Northeast 1/4 of said
Section 12, Township 29 South, Range 15'East, run thence
N 00 06'00" E along the 40-acre line 40. 0 feet for the Point
of Beginning; thence continue N 00 06100" E along the 40-
acre line, 200.0 feet; thence N 89° 18'15" W, 230.0 feet
to the Easterly right-of-way of Kapp Drive; thence
S 0. 06'00" W along said Easterly right-of-way, 200.0
feet to the Northerly right--of-way of Palmetto Street; thence
S 89. 18'15" E along said Northerly right-of-way, 230.0 feet
to the Point of Beginning, together with all abutting streets.
The above-described property is hereby zoned "CS" (Commercial
Services District) and designated Fire District No. 1.

Section 3. The City Engineer, the City Clark and the Planning
Director are directed to include and act out and show upon the official
zoning atlas and other official maps and records 'of the City of Clearwater
the foregoing property and the zoning and fire district classifications therefor„
Section 4. Notice of the proposed enactment of this Ordinance has
bken properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section S. This Ordinance shall become effective immediately upon
its passage and enrollment in the City of Clearwater Ordinance Book and a
certified copy thereof being recorded in the Office of the Clerk of the Circuit
Court of Pinellas County, Florida.
