Section 22. 02, Permitted Uses and Structures, of Article XXII, CP, Parkway Business District, of Appendix A, Zoning, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended by amending Restaurant use to read as follows: Restaurant and eating and/or drinking establishments. Section 7. Section 30. 02, Setback Regulations, of Article XXX, Supplementary Regulations Applying to A Specific, To Several, Or To All Districts, of Appendix A, Zoning, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 30. 02. Setback regulations. (1) Structural overhang. No building or structure overhang shall be permitted to exceed two (2) feet beyond the required setback line in residential zoned districts having required building setbacks of five (5) feet or less; or three (3) feet beyond the required setback line in residential zard districts having required building setbacks up to and including ten (10) feet; or five (5) feet beyond the required setback line in residential zoned districts having required building setbacks of more than ten (10) feet. (2) Front of lot. Reference is made to Article Ii, Definitions, Sub.-sections (27) Front of lot and (74) Yard, front. Usual application includes the corner lot situation in which two street rights-of-way permit a structure to face either street with addresses or entrance to be associated with either right-of-way. Front setback requirements will apply to both streets. (3) Double frontage lots (Lots between two parallel streets). A standard double frontage lot has a "front" setback on both a frontage street (by address) and a "non-frontage (no address) street. " In the case of a double frontage lot created by an approved platting procedure which has resulted in a deed or plat restriction prohibiting access to the "non-frontage" street and also a restriction requiring fencing along such non-frontage street, then the yard on the non-frontage street may be considered as a private area used by the so-called rear of the house. In the above instance a swimming pool or enclosure setback in this area shall be equal to the rear setback as established for swimming pool or enclosure in that zone. Section 8. Section 31. 02, Definitions Specifically Related to Travel Parks, of Article XXXI, Travel Parks, of Appendix A, Zoning, of the Code of Ordinances of the City of Cleawater, Florida, 1962, is hereby amended by amending the definition of "Travel trailer" under "Vehicles, Recreational" to read as follows: Travel trailer. A vehicular, portable structure built on a chassis and towed with a standard automobile or truck designed to be used as a temporary dwelling for travel, recreation and vacation use and when factory equipped for the road, having a body width not exceeding eight (8) feet. Sub-section (2) of Section 33. 08, Storage and Parking of Trailers, Campers and Commercial Vehicles, of Article XXXIII, off-Street Parking Requirements, of Appendix A, Zoning, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: (2) Not more than one camping or travel trailer or camper truck or hauling trailer per family living on the premises shall be permitted and said trailer shall not exceed eight (8) feet in width; and further provided that said trailer shall not be parked or stored for more than forty-eight (48) hours unless it is located behind the front yard building setback line. A camping or travel trailer or camper truck shall not be occupied either temporarily or permanently while it is parked or stored in any area except in a mobile home park authorized under this ordinance. Section 10. Section 34. 07, Procedure for Amending Zoning Ordinance, of Article XXXIV, Administration and Enforcement, of Appendix A, Zoning, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 34. 07. Procedure for Amending Zoning Ordinance. The following procedure for amending, supplementing or changing the Zoning Ordinance or Zoning Map or Zoning Atlas of the City of Clearwater is hereby established: (1)Any person, firm, corporation, board or official of the City of Clearwater may file a written application requesting a proposed amendment, supplement, change or modification of the Zoning Ordinance or Zoning Map or Zoning Atlas of the City of Clearwater. Other supporting documents may be required with the application for change of zoning or annexation and zoning. See Section 33.01.1. (2) Applications shall be filed in triplicate with the City Clerk and shall set forth the reasons and grounds for said request; provided, however, that such requests shall not exceed the density as identified on the City Comprehensive Plan. Each application by anyone, other than a board or official of the City of Clearwater, shall be filed by the owner or his duly authorized representative and shall be accompanied at the time of filing by a fee to cover processing the application, which fee shall be set and established by resolution'passed by the City Commission. Under no condition shall such sum, or any part thereof, be refunded for failure of such change to be adopted by the City Commission. (3) The City Clerk shall forthwith transmit a copy of each application to the City Commission for acceptance and referral to the proper City departments for appropriate action and public hearing. Immediately adjacent in'the area thereof extending five hundred feet (5001) from said property line; publicly owned property shall be counted as one property owner, but not as a protest petitioner; county residents who own property within the above described area of concern shall have the right to sign protest petitions; such petitions shall include a statement of specific valid objections rather than vague statements of opposition. After such written protest, applicants for annexation and zoning or rezoning are required to meet with owners of property in the area of concern to explain proposed development plans. When such valid protest is filed, the change shall be further held in abeyance and the matter shall be referred to the City Commission by the City Manager for reconsideration at the next regularly scheduled City Commission meeting (which said meeting shall be treated as a continuation of ,the public hearing at which the matter was decided), and such amendment, supplement, change or modification shall not thereafter become effective except by the affirmative vote of not less than four (4) members of the City Commission. (7)All proposed changes and amendments to the Zoning Ordinance or the Zoning Map or Zoning Atlas as approved by the City Commission after its evaluation of all evidence presented at the public hearing, shall be incorporated in an ordinance or the Zoning Map or Zoning Atlas of the City of Clearwater which shall become effective immediately upon its passage. (8) No new application for annexation and zoning or rezoning of a specific property shall be accepted for consideration within a period of twelve (12) months of the decision of denial unless such denial is without prejudice, in which event the applicant may refile within a twelve month period (exclusive of right of appeal defined in Section 34. 09). A resubxnittal after the twelve (1Z) month time period must state a substantial change in land use and zoning based upon one or more but not limited to the following findings: (a) Change in abutting land use. (b) Change in abutting structural type. (c) Change in traffic flow, or street capacity. (d) Change in the location, nature or existence of public facilities. (9) Continuances of annexation and zoning or rezoning items shall be continued to a time and date certain at the pleasure of the City Commission, but in no event shall such continuance exceed a period of three (3) months. Section 11. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 12. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 14. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Chapter 166. 041, Florida Statutes. Section 15. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendments as hereinabove set out. Section 16. The provisions of this ordinance shall take effect immediately upon its passage.
