WHEREAS, Chapter 71-132 was enacted by the Florida State Legislature

to become effective on July 1, 1973, and repealed Section 856. 01 of the
Florida Statutes relating to drunkenness; and
WHEREAS, said Chapter 71-132 is not to become effective until
October 1, 1974, and said Section 856. 01 has not been reenacted by the State
Legislature; and
WHEREAS, the City of Clearwater has determined that an emergency
exists affecting the health, safety and welfare of the citizens of the City
and that the prohibition and penalty for drunkenness should be enacted at once;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Chapter 14, Offenses and Miscellaneous Provisions, of the
Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended to add thereto a new Section 14-33. 1 to read as follows;
Section 14..33. 1 Drunkenness prohibited; penalty.
It shall be unlawful for any person within the City to be or
become drunk from the voluntary use of intoxicating liquors
or drugs. Whoever shall violate the provisions of this section
shall, upon conviction thereof, be subject to a fine not exceeding the
sum of Five Hundred Dollars ($500. 00) or imprisonment in the City
Jail for not exceeding sixty (60) days, or by both such fine and
imprisonment in the discretion of the Municipal Judge, but no
prosecution shall be instituted after six (6) months after the
commission of the offense.

Section 2. All ordinances or parts of ordinances in conflict herewith
are, to the extent of such conflict, hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect,
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. It is hereby found, determined and-declared that this
ordinance is necessary and urgently needed for the preservation of the health,
safety and welfare of the citizens and inhabitants of the City of Clearwater;
that an emergency is hereby declared; and that this ordinance shall be in full
force and effect immediately upon its passage.
