AN ORDINANCE AMENDING THE ZONING ATLAS OIi" THIS
CITY OF CLEARWATER, FLORIDA, 1973, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
i AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO.
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
`HEREOF; PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE; AND TO PROVIDE FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on August.20, 1973, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on proposed
changes to the zoning atlas of the City of Clearwater in accordance with
procedure as established; and
indicate that fact as hereinafter set outs
which time public hearing was completed thereon; and
WHEREAS, certain items were continued until August 27, 1973, at
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the public hearing and at the continuation thereof;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 1973, it as amended, is amended to
Zoned as CPD . Commercial Planned Development
That portion of Tract No. 30, Section 20, Township 28 South,
Range 16 East, Pinellas County, Florida, more particularly
described as follows: Beginning at the center of said Section Z0,
run N 89°54'5811 E, 900.53 feet; thence South 806. 88 feet to the
P. O. B. ; thence along the arc of a curve to the right, 148. 39 feet,
chord bearing S 5° 1313411 E, 148. 18 feet and having a radius of
800. 00 feet; thence S 00,00, 161, W, 31. 05 feet; thence S 73° 0010011
W, 188. 23 feet; thence N 00° 0011611 E, 86. 10 feet; thence along
the arc of a curve to the loft, 115. 00 feet, chord bearing
N 5° 1313411 W, 114. 84 feet and having a radius of 620.00 feet;
thence N 79°2713711 E, 180.00 feet to the P.O. B.

Zoned as CG - General Business District
Lots.17 through 26, inclusive, Block J, Belmont Subdivision,
Second Addition, according to the map or plat thereof as
recorded in Plat Book 6, page 88 of the Public Records of
Pinellas County, Florida.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court, be
fined not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment
in the City Jail for not exceeding sixty (60) days, or by both such fine and
imprisonment in the discretion of the Municipal Judge. Each day that a violation
is permitted to exist shall constitute a separate offense.
Section S. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 6. The provisions of this ordinance shall take effect
immediately upon its passage.
