AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING SECTION 7-5. 10 DEVELOPMENT IMPACT FEE,
OF ARTICLE I, IN GENERAL, OF CHAPTER 7, BUILDINGS,
OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962, TO ESTABLISH A NEW CLASSIFICATION FOR
HOTEL OR MOTEL FACILITIES AND TO ESTABLISH A
DEVELOPMENT IMPACT FEE THEREFOR;: PROVIDING A PENALTY
FOR FAILURE TO COMPLY HEREWITH; PROVIDING FOR REPEAL
OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 7-5. 1, Development Impact Fee, of Article I, In
General, of Chapter 7, Buildings, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, is hereby amended to read as follows:
Section 7-5. 1 Development Impact Fee.
For all new buildings and structures, the applicant shall at
the time of requesting final inspection and issuance of a
certificate of occupancy, also pay a Development Impact Fee
as follows:
New Residential Structures--single family, apartment,
condominium or mobile home - per unit - $250. 00
New Commercial Structures--$250. 00 for each 2, 500 square feet
of floor area or fraction thereof
New Industrial Structures--$250. 00 for each 5, 000 square feet
of floor area or fraction thereof
New Hotel or Motel Facilities -per unit - $250. 00
Commercial area other than units, $250. 00 for each 2, 500 square feet
of floor area or fraction thereof
The funds derived from these fees shall be deposited in a special
account to be used exclusively for the construction of roads, public
transit facilities and storm drainage in the City of Clearwater,
including actual construction costs, acquisition of rights-of-way,
the construction of sidewalks, curbs, drainage structures and
signal installations.
Section 2. Any person, organization, society, association or corporation,
or any agent or representative thereof, who shall violate the provisions of this
Ordinance shall be subject, upon conviction in the Municipal Court to a fine not
exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment in the City
Jail for not exceeding sixty (60) days, or by both such fine and imprisonment in

Section 3. All ordinances ox parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4_ Should any part or provision of this Ordinance be
declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the Ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section S. This ordinance shall become effective immediately upon its
passage.
