AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, AUTHORIZING CONDEMNATION OF CERTAIN
RIGHT-OF-WAY AND A DRAINAGE EASEMENT IN
SEC'T'ION 11, TOWNSHIP 29 SOUTH, RANGE 15 EAST,
PINELLAS COUNTY, FLORIDA, TO BE ACQUIRED FOR
THE EXTENSION OF KEENE ROAD WITHIN THE CITY
LIMITS OF THE CITY OF CLEARWATER; DIRECTING
THE PROPER OFFICIALS TO FORTHWITH INSTITUTE
SUCH PROCEEDINGS; AUTHORIZING EXECUTION OF
NECESSARY DOCUMENTS, CHECKS FOR PAYMENT OF
MONEY, BONDS, PLEADINGS, OR OTHER PAPERS
INCIDENTAL OR REQUIRED IN ORDER TO COMPLETE
THE ACQUISITION OF SAID RIGHT-OF-WAY AND EASE-
MENT BY CONDEMNATION; AND PROVIDING THAT THIS
ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON
ITS PASSAGE.
WHEREAS, the City of Clearwater has determined that certain
right-of-way and drainage easement is required for the extension of Keene
Road within the City limits of the City of Clearwater, and
WHEREAS, the Commission has been unable to acquire said right-of-
way and drainage easement; and
WHEREAS, the City's only means of completing said project is by
acquisition of said right-of-way and easement for the extension of Keene
Road by means of condemnation proceedings;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
1. That the appropriate officials of the City of Clearwater are hereby
instructed and directed to obtain all necessary surveys and execute all neces-
sary instruments, documents, checks for payment of money, bonds, pleadings
and other papers which are incidental and necessary to the institution of con-
demnation proceedings to acquire fee simple title for right-of-way and an
easement from Saturn Lake Apartments, Inc., 5403 Aloha Place, Holiday,
Florida 33589, of the parcels of land described as follows:
An 80. 00-foot parcel of land lying 40. 00 feet, each side of the
following described line:
Start at the southeast corner of the northeast 1/4 of the southeast
1/4 of Section 11, Township 29 South, Range 15 East, and run
N 00• 12' 21" E, 60. 00 feet; thence run S 890 20z 18" E, 6.00
feet to the Point of Beginning; thence run N 00° 40' 51" E,

2. The City Attorney is hereby instructed to institute condemnation
proceedings in the Circuit Court of the Sixth Judicial Circuit of the State of
Florida for the purpose of acquiring said easement at the earliest possible
moment for storm drainage purposes.
3. Any and all irregularities in procedure, description or other
matters which may have occurred to date of this Ordinance are hereby
corrected, ratified and confirmed.
4. This Ordinance shall take effect immediately upon its passage.
