AN ORDINANCE OF THE CITY OF. CLEARWATER, FLORIDA,
ANNEXING A PORTION OF SECTION 7, TOWNSHIP 29 SOUTH,
RANGE 16 EAST, LOT 9, BLOCK F, OAK ACRES ADDITION
UNIT 1 AND LOTS 1, 2 AND 5, BLOCK B AND LOT 1, BLOCK
C, CLEARWATER HIGHLANDS UNIT A, PINELLAS COUNTY,
FLORIDA, TOGETHER WITH ALL ABUTTING STREETS, INTO

FLORIDA, AND REDEFINING THE BOUNDARY LINES OF THE
CITY TO INCLUDE SAID ADDITIONS, ACCORDING TO THE
PROVISIONS OF THE CHARTER OF THE CITY OF CLEAR-
WATER, FLORIDA, AND THE LAWS OF FLORIDA; AFTER
PROPER PUBLIC NOTICE AND PUBLIC HEARING THEREON,
ESTABLISHING THE ZONING USE DISTRICT CLASSIFICATIONS
AND THE FIRE DISTRICT CLASSIFICATIONS FOR SAID PROPERTY
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Donald O. McFarland, Attorney for Shirley
Bernfeld and Lester Bernfeld, her husband and Rosalyn Zavatsky and Phyllis
Levinson, requesting the City to annex a certain parcel of real estate described
hereinafter, owned by them, into the corporate limits of the City of Clearwater,
Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on September 5, 1972,
voted unanimously to accept said request and authorized the proper officials to
set up a public hearing thereon for the determination and establishment of
zoning and fire district classifications and to prepare an ordinance to annex
said parcels of real estate into the corporate limits of the City of Clearwater
in accordance with the provisions of Section 6 (d) of the Municipal Charter of
the City of Clearwater and the Laws of Florida; and
WHEREAS, on October 16, 1972, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing for the determination
and establishment of zoning and fire district classifications for said real
property; and

corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission of the City of Clearwater, Florida,
also received a sworn petition from Joseph A. Shiels and Anna Shiels, his wife,
requesting the City to annex a certain parcel of real estate hereinafter described,
owned by them, into the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission of the City of Clearwater, Florida,
also received a sworn petition from Samuel Shiels and Anna Mae Shiels, his
wife, requesting the City to annex a certain parcel of real estate hereinafter
described, owned by them, into the corporate limits of the City of Clearwater,
Florida; and

WHEREAS, the City Commission, after due consideration of said
requests for annexation, at a regular meeting held on October 16, 1972, voted
unanimously to accept said requests and authorized the proper officials to set
up a public hearing thereon for thedetermination and establishment of zoning
and fire district classifications and to prepare an ordinance to annex said parcels
of real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Section 6 (d) of the Municipal Charter of the City of
Clearwater and the Laws of Florida; and
WHEREAS, on November 20, 1972, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing for the determination
and establishment of zoning and fire district classifications for said real
property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at proper
public hearings, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Section 6 (d) of the
Municipal Charter of said City of, Clearwater and the Laws of Florida, hereby
annexes into the corporate limits of the City of Clearwater, Florida, and redefines
the boundary lines of said City so as to include the following described parcels
of real property in Pinellas County, Florida, and establishes zoning and fire
district classifications therefor:
A parcel of land in the E 1/4 of the NE 1/4 of the NE 1/4
of Section 7, Township 29 South, Range 16 East, being
further described as follows: From the NE corner of Section
7-29-16, run S 0°5414411 W, along the centerline of U. S. 19,
89.58 feet; thence N 89°0511611 W, 100. 0 feet to a point on the
West right-of-way lire of U. S. 19, said point being the P. O. B.;
thence S 0°54'4411 W, along said West right-of-way line of U.S.
19, 641. 0 feet; thence N 89°0511611 W, 235. 85 feet; thence
N 0°5313911 E, 490. 65 feet to a point on the South right-of-way
line of S.R. 590; thence N 58'2414511 E, along said South right-
of-way line of S. R. 590, 279. 83 feet to the P. O. B.
The above described property is hereby zoned "CTF11
(Commerciale-Tourist Facilities Use District) and designated
Fire District No. 2.

Section 2. The City Commission hereby formally and according to
law accepts the dedication of all easements, streets, parks, plazas,. places,
right-of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section 3. The City Engineer, the City Clerk and the Planning Director
are directed to include and set out and show upon the official zoning map and
other official maps and records of the City of Clearwater the foregoing
property and the zoning and fire district classifications therefor.
Section 4. This Ordinance shall become effective immediately upon
its passage and enrollment in the City of Clearwater Ordinance Boak and a
certified copy thereof being recorded in the Office of the Clerk of the Circuit
Court of Pinellas County, Florida.

WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Donald. O. McFarland, Attorney for Shirley
Bernfeld and Lester Bernfeld, her husband and Rosalyn 7avatsky and Phyllis
Levinson, requesting the City to annex a certain parcel of real estate described
o hereinafter, owned by them, into the corporate limits of the City of Clearwater,

_ NOW, THEREFORE, BE IT ORDAINED BY ViE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After ?s evaluation bf all evidence presented at proper
public. hearings, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Section 6 (d) of the
Municipal Charter of said City of Clearwater and the Laws of Florida, hereby
annexes into the corporate limits of the City of Clearwater, Florida, and redefines
the boundary lines of said City so as to include the following described parcels
of real property in Pinellas County, Florida, and establishes zoning and fire
district classifications therefor:
A parcel of land in the E 1 /4 of the NE 1/4 of the NE 1/4
of Section'7, Township 29.South, Range 16 East, being
farther described as follows: From the NE corner of Section
7- 29--16, run S 0°54'44" W, along the centerline of U. S. 19,
89. 58 feet; thence N 89 ° 05,1611 W, 100, 0 feet to a point on the
West right-of-way line of U. S. 19, said point being the P. O. B. ;
thence'S 0°54'44" W, along said West right-of-way line of U. S.
19, 641. 0 feet; thence N 89,°05' 16" W, Z35. 85 feet; thence
• N 0°53'39" E, 490. 65 feet to a point on the South right-of-way
line of S.R. 590; thence N 58°24'45" E, along said South right-
of-way line of S. R. 590, 279, 83 feet to the 'P. O, B.
