ORDINANCE NO. 1428
AN ORDINANCE AMENDING THE ZONING MAP OF THE
CITY OF CLEARWATER, FLORIDA, 1972, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; BY PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; BY
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; BY PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on August 7, 1972, the City Commission of the City of
Clearwater, Florida, after proper public notice, held a public hearing on
certain proposed changes to the zoning map of the City of Clearwater in
accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to
the zoning map were approved by the City Commission after its evaluation
of all evidence presented at the public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Map
of the City of Clearwater, Florida of 197211, as amended, is amended to
indicate that fact as hereinafter set out:
Zoned as RM-.12 « Duplex-Apartment District
From the NE corner of the NE 1/4 of Section 11, Township
29 South, Range 15 East, run thence N 89°23'46" W, along
the Section line, 665. 22 feet for a P. O. B. ; thence continue
N 89 0 2314611 W, 125. 06 feet; thence S 0° 25121" W, 749. 11
feet; thence S 89°2113011 E, 133. 0 feet; thence N 0°25121" E
23.20 feet; thence N 89*231461i W, 7. 09 feet; thence N 0°2112211
E along the 10 acre line, 726. 0 feet to the P. O. B.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3, Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof, other than the
part declared to be invalid.

Section 4. Any person or .persons, firm or corporation or association
'of persons, who shall violate or fail to comply with any of'the terms
or provisions of this ordinance shall, upon conviction in the Municipal
Court, be fined not exceeding the sum of Five Hundred Dollars ($500. 00),
or he imprisoned in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Section 5` The Planning Director is directed to include and set out
and show upon the official zoning map of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 6. The provisions of this ordinance shall take effect
immediately upon its passage.
