BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Chapter 23 1/2, pertaining to trees, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended

by amending Section 23 1/2-1Z, relating to mangrove trees, to read as
follows : ffi"N. " ;
Section 23 1/Z-12. Removal of mangrove trees--Permit required.
The following species of mangroves are recognized to be
of special ecological value to the City of Clearwater:
Rhizophora mangle (Red mangrove)
Laguuncularia racemosa (White mangrove)
Ayicennia nitida (Black mangrove)
Conocarpus erects (Buttonwood or button mangrove)
No mangrove tree, regardless of size, located within an area
thirty feet (301) landward and thirty feet (30=) seaward of the yl +. ,';
mean high water line shall be removed or relocated without
a tree removal permit. ?.--.
Section 2. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate
the provisions of this Ordinance shall be subject, upon conviction in the
Municipal Court, to a fine not exceeding the sum of Five Hundred Dollars
($500. 00), or imprisonment in the City Jail for not exceeding sixty (60)
days, or by both such fine and imprisonment in the discretion of the
Municipal. Judge.
Section 3. All ordinances or parts of ordinances in conflict here-
with are to the extent of such conflict hereby repealed.

Section 4. Should any part or provision of this Ordinance be
declared by a court of competent jurisdiction to be invalid, the same
shall not affect the validity of the Ordinance as a whole, or any part
thereof other than the part declared to be invalid.
Section 5. This Ordinance shall become effective immediately
upon its passage.
