Compatible with their surroundings; 2. Appropriate to the type of activity to which they pertain; 3. Expressive of the identity of individual proprietors or of the ?"ilop ? (b) That the increased number and size of such signs, coupled with +:, ; the increased use of motor vehicles, make it imperative that the public •' hways be kept free from signs which detract from traffic streets and hi g safety by diverting drivers I attention away from the flow of traffic; t.,, , , ' • ` `' (c) That the size and location of such outdoor signs may, if uncon- trolled, constitute an obstacle to effective fire-fighting techniques; (d) That in addition thereto, the construction, erection and main- tenance of large outdoor signs suspended from or laced on to of buildings, " - :=' '; ;.'•" "'r' .•: walls or other structures constitute a direct dan er to edestrian traffic p g below such signs, especially during periods when winds of high velocity are prevalent; (e) That the natural beauty'of landscape, view and attractive sur- roundings of the City constitutes an attraction for tourists and visitors; (f) That the indiscriminate erection and maintenance of large signs seriously detract from the enjoyment and pleasure of the natural scenic beauty of the City which, in turn, injuriously affect the tourist trade and thereby the economic well-being of the City; and (g) It is therefore deemed necessary for the promotion and preser- vation of the public health, safety and welfare of the people of the City that the erection, construction, location and maintenance of signs be regulated and controlled; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Chapter 18, being Sections 18-1 through 18-51 inclusive, pertaining to Signs, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed in its entirety and the following is enacted in lieu thereoft ARTICLE I. The provisions of this Ordinance shall be considered as correlated, f ' M =: where applicable, with the Southern Standard Building Code requirements and the Zoning Ordinances of the City of Clearwater. B. General Types of Signs. (1) Outdoor advertising displays hereinafter abbreviated DAD and so defined are divided into functional categories according to purpose. (a) To advertise or identify an establishment, service or product available on the premise (P), or (b) To advertise or identify an establishment, service or product available off-premise (OP) at some other location, or (c) To only identify and give direction to an establishment at another location than that of the sign (also considered as an off-premise (OP) sign). (2) Certain types of signs do not require permits; however, all type signs herein defined are regulated in order to promote the consistency of commercial charac- ter intended for each zone. Sec. 18-3. Definitions. A. General Terms. (1) General Construction Terms. (a) Alter, (on-premise), shall include but not be limited to the following: the addition of surface area, the changing of name of business, the changing of the location of light source. (b) Erect shall mean to construct, build, raise, assemble, place, affix, attach, create, paint, draw, or in any other way bring into or establish, but it shall not include any of the foregoing activities when performed as an incident to the change of advertising message. (c) Maintain shall include general servicing and upkeep in safe and attractive condition. (d) Relocate shall include any horizontal or vertical positioning of the sign on its supporting structure or change from original location of sign on the premises. (2) Notice (Notification). (6) Temporary Sign is any sign, banner, valance or advertising display intended to be displayed for a limited period of time, excepting the American flag or the flag of the State of Florida (or of other countries), or other banners, flags or symbols displayed in connection with or to commemorate or celebrate an event or occasion specifically authorized by the City Commission. (a) A temporary sign is not located permanently. (Fixed to a building or ground structure.) (b) A temporary sign also may be one authorized for a limited period or otherwise so noted in this Ordinance. B. Outdoor Advertising Display Sign - Structure Type, means any letter, figure, character, mark, plane, point, marquee sign, design, poster, pictorial picture, stroke, stripe, line, trademark, reading matter or illuminated surface, which shall be so constructed, placed, attached, painted, erected, fastened or manufactured in any manner whatsoever, so that the same shall be used for the attraction of the public to any place, subject, person, firm, corporation, public performance, article, machine or merchandise, whatso- ever, which are displayed in any manner whatsoever out-of-doors. (2) Can op shall include any structure, other than an awning, made of cloth' or metal with a metal frame attached to a building and/or projecting over a public right-of-way, but not carried by a frame supported by the ground or sidewalk within the public right-of-way. Canopy supports may only be erected within or on private property.. (3) Combination Sign is any sign incorporating any combination of the features of ground, projecting or roof signs. (4) Ground Sign means an "Outdoor Advertising Display Sign" when such sign is supported by uprights or braces in or upon the ground, also referred to as pole sign. (5) Marquee Sign means a sign attached to or hung from a marquee and said marquee shall be known to mean a canopy or covered structure projecting from and supported by a building, when such canopy or covered structure extends beyond the building, building line or property line. (b) Projection Sign means an "Outdoor Advertising Display Sign" which is affixed to any building wall or structure and extends beyond the building wall, structure, building line or property line more than twelve (12) inches. (7) Roof Sign means an "Outdoor Advertising Display Sign" erected, constructed, or maintained above the highest point of the roof of any building, or painted on structural portion of the roof, (8) Shingle Sign means a projection or wall sign not over six (b) square feet in area, constructed of metal or other noncombustible material attached securely to a building. (9) Wall Sign means an "Outdoor Advertising Display Sign" that shall be painted on the wall, or be affixed to the wall of any building, when such sign, shall project no more than twelve (12) inches from the building. A permanent, enframed surface area principally devoted to, and designed for, changeable text information pertain- ing to entertainment, menu, price, etc. (2) Directional Sign is any aign utilized only for the purpose of indicating the location or direction of any object, place or area. (3) Directory Signa shall mean signs which give the name and/or occupation of the occupants of the building or give the use of the building including office building directories, church directories and apartment house directories. When an identification of an entity is placed on a common direc- tory board with identical uniform style, size of letter, such identity shall not be defined as a separate sign but considered as a part of a directory board sign. (4) Identification- Individual Entity_ is any person who is the lessee, owner or who has a proprietary interest in the business for which the sign is proposed. Each business shall be considered a separate entity. Eligibility for an identification as an individual entity shall not exist when the lessee is under the same roof and riith the same entrance or access; in such case of leased floor space the occupant is not defined as an individual entity. However, eligibility for identification as an individual entity may apply to the lessee if the owner or the lessor makes of record to the building official a transfer (assign- ment) of all or part of his computed eligibility to the lessee. (5) Informational Signs . Any combination of directory, directional and/or explanatory information. (6) Outdoor Advertising Display - Off-Premise (Commercial Advertising). - Any sign upon which advertising matter may be painted or upon which posters may be pasted or otherwise secured to the face thereof, advertising goods, services or other things not sold or available upon the premises upon which sign is located. (9) Real Estate Sign. Any structure, device, display board, screen, surface or wall with characters, letters, or illustrations placed thereto, 1 ';z thereon, or thereunder, by any method or means whatsoever where the r 4 a matter displayed thereon shall be used solely for the purpose of offering for t ?= sale, for lease, or for rent the exact property on which sign is placed. f t D. Outdoor Advertising Display Sign - Character. ' A t ,{ : (1) Activated Sign. Any sign which contains or uses for illumination N any light, lighting device or lights which change color, flash or alternate, or change appearance of said sign or any part thereof automatically. (For the purpose of this Ordinance, a slowly rotating sign, not exceeding 10 r. p. m. illuminated but not flashing, shall not be considered an activated sign.) (Z) Animated Sign shall mean a sign upon which a character, letter or figure or group or combination thereof, show movement or motion to such an extent as to be readily detected. (3) (a) Banner Sign shall mean signs possessing characters, letters, illustrations or ornamentations applied to cloth, paper or fabric of any kind, either with or without frames. (b) Banners, Streamers, Spinners, Pennants, within the scope of this Code shall be considered as a special form of advertising composed of, but not limited to the above materials, with or without letters or symbols, erected for the purpose of attracting attention to an area or a point. (4) Beacon Light. Any light with one or more beams capable of being directed in any direction or directions, or capable of being revolved auto- matically or capable of having any part thereof revolve automatically. Signs that alternately din- play only time and temperature are excluded from this definition. ?i (7) Fluorescent Painted shall include any sign which is wholly or partially composed of letters, symbols, or characters, or background which 6 is of fluorescent qualities causing a reflective light to illuminate. (8) Illuminated Sign. Any sign which has characters, letters, figures, designs or outline illuminated by electric lights or luminous tubes , whether or not the lights or tubes are a part of the sign proper. :•? ,,? ?i ?'c??''' (9) Sandwich Signs shall mean any sign double- or single-faced which is portable and may readily be moved from place to place., f (10) Snipe Signs shall mean any small sign of any material including t : y ,tI paper, cardboard, wood and metal, when tacked, nailed or attached in any way. i to trees or other objects where such sign may or may not apply to the premises. (11) Window Signs are signs located on, or within one foot of the street window surface intended to be viewed from the outside. ' ' w•$ E. On-Premise Signs - Special Uses. (1) Service Station. That structure or portion thereof with fuel r ,? w y Tt dispensing pumps involved with sale of fuel to general public and located with ?`?;. ' 3.. access to public street. Operation may include minor auto repair and service . t. area and/or building for storage of vehicle for duration of service.' t, (2) Tire. Battery and Accessory Facility (referred to as TBAY facility)-must be in conjunction with the above dispensing service and must have a minimum of 300 square feet of separate office-sales and display area, exclusive of rest rooms, shop and tool storage, work stalls and service .i + corridors. (Car rental and/or trailer rental is not considered a TBA function. Eligibility for signs for these services is included within the permitted product and/or service sign standards (limitations) for service station.) ., (3) Car Wash when established as a service with a service station, f shall be considered as a secondary or accessory use. r ; Sec. 18-4. Existing Nonconforming Signs, Removal. A. Intent. It is also the intent of this section,.. that there shall not be any unreasonable invasion of established private property E rights. . . B. Continuance. Subject to the sign amortization schedules set forth below, a nonconforming sign may be continued and shall be maintained in good condition, but it shall not be: (1) Enlarged or changed to another nonconforming sign, L'Y }%e'',?'?.,•;;, .'H;• °"`'' . hy, s•y (Z) Structurally altered so as to prolong the life of the sign, 3; ?o 7h i (3) Re-established offer its discontinuance for ninety (90) days, or ,?`??srt?'??=-r; ,?: ?`?t•'r.t; , (4) Re-established after damage or destruction if the estimated expense of reconstruction exceeds fifty percent (50%) of the appraised replacement cost. C. Removal or Conformance - Amortization Schedules. A sign, in- cluding the supporting structure, which is in existence upon the effective date of this Ordinance, and which theretofore conformed to all legal requirements but which is made nonconforming by the provisions of this Ordinance, shall be brought into conformity or shall be removed in accordance with the following: (1) All existing outdoor advertising off-premise signs as of the effective date of this chapter shall be considered nonconforming; the only exception shall be off-premise directional signs as defined in this chapter. The cost of compliance for removal, replacement or alteration to meet ordinance requirements shall be determined by a Sign Appraisal Board, composed of not less than three, nor more than five, members, so designated and appointed by the City Commission and the Sign Industry. No member shall be a City official. D. Establishment of Sign Review Board. A Sign Review Board is hereby established for the purpose of advising the City Commission on matters con- cerning sign appeals and establishing corridor development policies in accord- ance-with authority granted by the City Commission. (2) The City building official, with the approval of the City Manager, may issue permits for signs to be located upon public property, where the applications therefor comply with the provisions of this Ordinance. 'i (3) The City building official shall charge and collect a fee for all sign erection, alteration, and relocation permits, except those otherwise exempted. Fees shall be based upon the cost of construction, erection of the sign, and/or its electrification. Such schedule shall be established and adopted by the City Commission. (4) The City building official may delay the issuance of any permit RNINNNOM, for a sign for a reasonable length of time up to sixty (60) days, for the purpose of studying the effect the sign may have on public health, safety, morals and general welfare. (5) Any sign application shall become void 180 calendar days after the date of approval of such application. One ninety (90) day extension may be granted by the building official provided substantial evidence is shown that such extension should be granted. B. Validity of Permit - Changes in Application. (3) The sign or advertising structure was erected or used in a manner not in substantial compliance with the plans, specifications or location as shown in the application and accompanying data. D. Plans. The building official may not require plans to be filed for small, unimportant or temporary signs, nor for previously approved standard plans for sign supports, provided the application is otherwise in compliance with conditions of approval of the standard plans. ARTICLE III. Regulations and Specifications. Sec. 18-7. General Regulations Governing Signs. Signs erected or maintained in the City under the provisions of this Ordinance are subject to the following regulations: A. Interference with Public. (1) The sign must not create a traffic or fire hazard or be dangerous to the general welfare or interfere with the free use of public streets or sidewalks. (2) Safety Requirements. (a)' No sign shall be erected or maintained at any location in such a manner as to obstruct free and clear vision at the intersection of any streets or other public ways. C. Repair and Maintenance. All signs must be kept in good condition, neat appearance and good state of repair. Any sign more than sixty-five per- cent (6516) destroyed must be immediately removed at the owner's expense and a new permit secured before the sign is replaced. If not repaired within a reasonable time, the sign shall constitute a public nuisance and shall be removed. D. Avoidance of Fire Hazard. Weeds and debris shall be kept cut or cleared in immediate area of sign. E. Imprint of Owner's Name. Allsigns requiring permits shallbe marked withthe owner's name, date and number of the permit. F. Obstruction of Doors, Windows and Fire Escapes. No sign shall be attached to or placed against a building in such a manner as to prevent ingress or egress through any door or window of any building, nor shall any sign obstruct or be attached to a fire escape. G. Posting or Tacking Notice and Signs. (1) From the effective date of this Ordinance, no permit shall be issued for the construction or erection of any new outdoor advertising display off-premise (commercial advertising) sign on any property presently within or hereafter annexed into the corporate limits of the City of Clearwater. (z) Location of signs within or upon public property and rights-of- way is prohibited. Exceptions: Except as permitted herein, no sign shall be located in or upon any "P", Public District, as defined in the City Zoning Ordinance, or in any street or in any street or railroad right-of-way, except = k t T ?'?``. upon specific permission of City Manager therefor. It is intended that these waterway areas shall be treated as Special Sign Control Districts. (3) Rental Rates. It shall be unlawful for any person, firm or cor- n poration who owns and operates, or has control of the operation, or manages any hotel, apartment house, rooming house, motor court, tourist camp or trailer camp, to erect, maintain and display on or about the outside and on the grounds of any such hotel, apartment house, rooming house, motor court, tourist camp or trailer camp, any written sign thereby setting forth or advertising the rates charged to its guests for the rental of rooms, apartments, trailer space or any other accommodation provided for and available at such hotel, apartment house, rooming house, motor court, tourist camp or trailer camp. (4) Snipe Signs. Snipe signs, except when used as real estate signs, as defined herein in Sec, 18-3, sidewalk or sandwich signs and all other signs not specifically defined or provided for herein, shall be prohibited within the city. (5) Signs attached to or placed on a vehicle (including trailer), that is parked on private property, shall be prohibited. This provision is not to be construed as prohibiting the identification of a firm or its principal products on a vehicle operating during the normal course of business. Neither is it to be construed as prohibiting such identification on a vehicle when it is parked temporarily at a location other than the site where the business is located, provided that such parking of a vehicle takes place subject to the following conditions : (a) The duration of parking shall not exceed, except on week- ends or nationally recognized holidays, a period of sixteen (16) hours. (b) The vehicle shall be parked within the confines of a building or in some other manner which provides for effective screening so as not to allow the signs on the vehicle to be viewed from any public street. ' (6) Flashing or activated signs as defined are prohibited in all zones. (7) Electrical Disturbance. Real estate sign as a temporary sign shall be limited to six (6) square feet in size and also shall be limited to one (1) per street frontage per parcel. (b) Copy Type: Name of construction company, contractor, builder or sales agent (or reasonably similar words may be used). One sign for each 200-foot frontage or building lot. Maximum - 32 square feet. Such signs shall be nonactivated, nonfla.shing, nonanimated, and shall be a minimum of five (5) feet from right-of-way line. (2) Temporary Signs which require permit shall be limited to twelve (12) months and shall meet applicable restrictions set forth. (a) Copy Type: Model home with name of builder and/or sales agent (or reasonably similar words may be used). One sign per model. Maxi- mum - 36 square feet. Such signs shall be nonactivated, nonflashing, non- animated and shall be a minimum of five (5) feet from right-of-way line. Banners or similar display shall be prohibited. (b) Copy Type:. Maximum number of signs - 2 - of which the total combined surface area shall not exceed 150 square feet. 25 feet from right-of-way. Height maximum 40 feet. (c) Sandwich Sign. Three (3) signs - total area not to exceed twenty-four (24) square feet. No sign to exceed sixteen (16) feet. Prohibited in public right-of-way and shall not in any way be placed as to restrict a vehicle (sight or movement) from properly entering a public right-of-way. (d) Safety Requirement. Refer to Section 18-7 (A) (2). (e) Banners, Streamers, Spinners, Pennants. Refer to Section 18•.3 (D) (3) (a) and (b) and to Section 18.8 (A) (8). (3) Tire, Battery and Accessory Facility. Eligibility factor: one square foot of sign surface area for each two lineal feet of right-of-way frontage of facility. Such surface eligibility may be used as follows: (a) One pole sign (minimum setback 25 feet from right-of-way), or one projection sign not to exceed 150 square feet. Maximum height 50 feet. (b) Any one marquee or wall sign shall not exceed 150 square feet. (4) Car Wash as accessory to a service station shall share eligibility of the primary usage. G. Regulations for Special Type Signs. (1) Roof Signs. No roof signs shall be permitted on buildings exceeding one (1) story or sixteen (16) feet in height; however, special exceptions for roof signs on buildings over sixteen (16) feet in height may be permitted by the Board of Adjustment and Appeal on Signs. Roof signs on buildings sixteen (16) feet or less in height shall be permitted provided the roof sign faces the principal street serving the building, and meets all of the following requirements: (a) Do not exceed the permitted maximum height of the stated pole (ground) sign for the zone. (b) Do not exceed the maximum area (size) of sign permitted for the zone. (c) The supporting members of the roof sign shall appear to be •"s r i u?. , • n• free of any extra bracing, angle iron, guy wires, cables, etc. The supports " shall appear to be an architectural and integral part of the building. Supporting columns of round, square or shaped steel members may be erected if the required bracing is visible to the public, is covered and is not more than one-fifth of the total'height of the sign structure.
