BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 21-8, pertaining to Utility Tax, Exemptions, of
Chapter 21, pertaining to Taxation, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, is hereby amended to read as follows:
Section 21-8. Utility Tax--Exemptions.

The United States of America, State of Florida, and political r f +3
subdivisions and agencies thereof are hereby exempted from
payment of the taxes imposed by Section 21-5. Said tax shall ;
not apply to sales of bottled water, nor to long distance telephone
service, nor to coin-box telephones.
There is excluded from the tax levied and imposed under Section
21-5 the following:
(1) Purchases of special fuels as defined in Chapter 206,
Florida Statutes, 1971.
(2) The purchase of not more than five (5) gallons of fuel
oil delivered at the seller's place of business into the
purchaser Ia container of not more than five (5) gallon

capacity.
(3) The purchase of fuel oil for use in the propulsion of :
ships, motor vessels, motorboats, aircraft, railroad R
trains, and other media of transportation.

(4) The purchase of fuel oil by a public or private utility,
including municipal corporations and rural electric
cooperative associations, either for resale or for use r
as fuel in the generation of electricity.
Section Z. Any person, organization, society, association or corporation, EVEN= M,
or any agent or representative thereof, who shall violate the provisions of this
ordinance shall be subject, upon conviction in the Municipal Court, to a fine

not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment
in the City Jail for not exceeding sixty (60) days, or by both such fine and •.3
imprisonment in the discretion of the Municipal Judge.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent Jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the part
declared to be invalid.
Section 5. This ordinance shall become effective immediately upon
its passage.
