AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, ENACTING A NEW SECTION 7-9, OF ARTICLE
I, IN GENERAL, OF CHAPTER 7, BUILDINGS, OF THE
CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962, TO REQUIRE BUILDINGS TO BE ERECTED
IN CONFORMANCE WITH AN ELEVATION DESIGNATED BY
THE FEDERAL INSURANCE ADMINISTRATION; 'TO PROHIBIT
EXPANSION IN COASTAL HIGH HAZARD AREAS OF NON-
CONFORMING USES BELOW 100 YEAR FLOOD LEVEL; TO
REQUIRE ALL NEW CONSTRUCTION AND RECONSTRUCTION
OF BUILDINGS TO COMPLY WITH ALL RELATED SECTIONS
OF THE SOUTHERN STANDARD BUILDING CODE; TO PROVIDE
RELIEF FROM THE TERMS AND PROVISIONS OF THIS
ORDINANCE BY APPLICATION TO THE'BOARD OF AD3UST-
MENTS AND APPEALS ON BUILDING, WHICH MAY GRANT
VARIANCES TO THE PROVISIONS HEREOF; TO PROVIDE
THAT THIS ORDINANCE TAKES PRECEDENCE OVER ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; TO
PROVIDE FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF AND TO PROVIDE FOR THE EFFECTIVE DATE OF
THIS ORDINANCE.
WHEREAS, it has become necessary for the City Commission of the
City of Clearwater, Florida, to recognize certain low elevation areas of
the City as flood hazard areas; and
WHEREAS, such recognition has been requested by the Federal Insurance
Administration in order for the City residents to receive flood insurance
coverage;
NOW, THEREFORE, BEIT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Article I, In General, of Chapter 7, Buildings, of the
Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended
to add thereto a new Section 7-9 to read as follows:
Section 7-9. No building shall be erected in any manner
which would allow its first story to be occupied for any use
whatsoever except as a garage, storage, patio, lobby and
other non-commercial space and non-residential living space,
on any lot lower than that elevation designated by the Federal
Insurance Administration to be the 100 YEAR FLOOD LEVEL.

Section 2. Existing non-conforming uses in accordance with this
ordinance and the Building Code of the City of Clearwater located on land below
the elevation of the 100 Year Flood Level in the coastal high hazard areas
designated by the Federal Insurance Administration shall not be expanded.

Section 3. Thy, City shall require all new construction and reconstruction
of buildings and structures to comply with all related sections of the Southern
Standard Building Code pertaining to methods, materials and anchorage to
minimize flood damage.
Section 4. Any person, persons or corporate entity may seek relief
from the terms and provisions of this ordinance by making application to the
Board of Adjustments and Appeals on Building of the City of Clearwater, as
provided in Sections 111 through 115, inclusive, of the Southern Standard
Building Code, which may grant variances to the provisions contained in this
ordinance.
Section 5. This ordinance shall take precedence over all ordinances or
parts of ordinances in conflict herewith to the extent of such conflict.
Section b. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 7. This ordinance shall become effective immediately upon
its passage.
