AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, AMENDING SECTION 14-3.1 OF THE
CODE OF ORDINANCESOF THE CITY OF CLEARWATER$
FLORIDA, 196x, TO PROHIBIT THE PLANTING
WITHIN THE CORPORATE LIMITS OF THE CITY OF
PUNK TREES OR BRAZILIAN PEPPER TREES;
PROVIDING A PENALTY FOR FAILURE TO COMPLY
HEREWITH; PROVIDING FOR REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH
TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR
THE SEPARABILITY OF THE PROVISIONS HEREOF AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA;
Section 1. , Section 14-3.1 of Chapter 14, Offenses and Miscellaneous
Provisions, of the Code of Ordinances of the Gity of Clearwater, Florida,
1962, is hereby amended to read as follows:
Sec. 14-3. 1. No person, shall plant, or cause to be planted
or permit to be planted within twenty feet (201) of any public
street or -right of way any Casuarina trees, better known as
Australian pine trees.
No person shall plant or cause to be planted anywhere within
the corporate limits of the City of Clearwater the following trees:
Melaleuca leucodendron (Punk tree or cajeput tree)
Schinus terebinthefolius (Brazilian pepper tree).
Section 2. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this ordinance shall be subject, upon conviction in the Municipal
Court, to a fine not exceeding the sum of Five Hundred Dollars ($500. 00), or
Section 4. Should any part or provision of this ordinance be declared

by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
