AN ORDINANCE PROVIDING FOR A SPECIAL REFERENDUM
ELECTION ON JUNE, 13, 197x, FOR THE PURPOSE OF
DETERMINING WHETHER OR NOT SENATE BILL 1177,
BEING CHAPTER 7Z. 505 , SPECIAL ACTS OF FLORIDA
OF 1972, REPEALING IN ITS ENTIRETY THE MUNICIPAL
CHARTER OF THE CITY OF CLEARWATER, PINELLAS
COUNTY, FLORIDA, BEING CHAPTER 9710, SPECIAL
ACTS OF FLORIDA, 1923, TOGETHER WITH ALL AMEND-
MENTS THERETO, AND ENACTING A NEW MUNICIPAL
CHARTER OF THE CITY OF CLEARWATER, PINELLAS
COUNTY, FLORIDA, SHALL BE RATIFIED; PROVIDING
FOR REGISTRATION AND QUALIFICATION OF ELECTORS;
PROVIDING FOR THE MANNER AND CONDUCT OF SAID
ELECTION; PROVIDING FOR THE DESIGNATION OF
POLLING PLACES AND OFFICIALS IN CONNECTION WITH
SAID ELECTION; PROVIDING FOR PUBLICATION OF NOTICE
OF THE PURPOSE OF SAID ELECTION, THE POLLING
PLACES AND THE CLASS OF PERSONS ELIGIBLE TO VOTE
THEREIN; PROVIDING FOR DETERMINING THE RESULTS
OF SAID ELECTION AND CERTIFYING SAID RESULTS TO
THE DEPARTMENT OF STATE AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA;
Section 1. That a special referendum election shall be held in the
manner herein provided and according to the Charter and the appropriate
ordinances and laws of the City of Clearwater and State of Florida, on
Tuesday, June 13, 1972, for the purpose of determining whether or not
Senate Bill 1177, being Chapter 72•. 505 , Special Acts of Florida of 1972,
shall be ratified, said Act repealing in its entirety the Municipal Charter of the
City of Clearwater, Pinellas County, Florida, being Chapter 9710, Special
Acts of Florida, 1923, together with all amendments thereto, and enacting a
new Municipal Charter of the City of Clearwater, Pinellas County, Florida;
Section Z. At said special referendum election, Senate Bill 1177,
being Chapter 72505 , Special Acts of Florida of 1972, pertaining to repealing
in its entirety the Municipal Cla rter of the. City of Clearwater, Pinellas County,
Florida, being Chapter 9710, Special Acts of Florida, 1923, together with all
amendments thereto and enacting a new Municipal Charter of the City of
Clearwater, Pinellas County, Florida, shall be submitted to a vote of the
qual3fied,electors residing in the City of Clearwater, who shall be registered

Section 3. The list so certified and/or the books submitted by the

Section 4. Notice of said election shall be given in accordance with
the ordinances and charter of the City of Clearwater and in accordance with ,S°•j
State election laws pertaining thereto.
Section 5.? Absentee voting shall be allowed and where practicable
the provisions of Sections 101. 62 101.70 inclusive, Florida Statutes, as
amended, shall be followed in connection therewith.
Section 6. Votes in such election shall be cast at polls as hereafter
designated by the City Commission, with notice thereof being given as
hereinabove provided. The polls shall open at 7 o'clock A. M. Eastern
Daylight Saving Time and close at 7 o'clock P.M. Eastern Daylight Saving Time,
on the date of such election.
Section 7. Inspectors and Clerks of the election shall be appointed
by the City Commission, except that if the Commission shall fail to appoint 54
the same at least seven (7) days before the date of the election, the Mayor..`'
Commissioner of the City of Clearwater shall appoint them. Where possible,

Inspectors and Clerks shall be residents of theprecinet in which they are serving.
Section 8. Voting machines shall be used and on all voting machines
for those voting, the ballot shall contain the following question and be in the
following form:
Do you approve Chapter 72.-505 , Special Acts of Florida of
1972, repealing in its entirety the presently existing Municipal
Charter of the City of Clearwater, Pinellas County, Florida,
and enacting a new Municipal Charter for said City?

Section 9. At least three (3) true sample copies of said Special
Act shall be posted at each polling place and notice of said special referendum
election shall be published in a newspaper of general circulation in Clearwater,
Florida, once a week for four (4) weeks, the first publication being at least
thirty (30) days prior to said election.
Secti6n'10. The results of the voting shall be certified by returns
in duplicate signed by the Clerk and a majority of the election inspectors.
One copy of such return shall be delivered to the Mayor-Commissioner and
the other copy to the City Clerk, both of whom shall transmit such returns
to the City Commission, at a meeting to be held at 12 o'clock noon Eastern
Daylight Saving Time on the day following the election. At such meeting the
City Commission shall canvass the returns and shall independently total the
vote for and against the ratification of said Special Act. Said Special Act
shall be effective upon its ratification by a majority of those persons qualified
as aforesaid and actually voting thereon in said election.
Section'll. The results of the voting on said Special Act shall be
certified to the Department of State of the State of Florida in accordance with
Section 100. 351, Florida Statutes.
Section 12. This ordinance shall become affective immediately
upon its passage.
