ORDINANCE NO. 1381 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTIONS '21-5, 21-6, 21-7, 21-9 and 21-10, PERTAINING TO UTILITY TAX, AMOUNT, PAYMENT AND COLLECTION, OF CHAPTER 21, PERTAINING TO TAXATION, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO PROVIDE THAT THE UTILITY TAX SHALL ALSO APPLY TO EVERY PURCHASE IN THE CITY OF FUEL OIL; PROVIDING A DEFINITION OF THE TERM FUEL OIL: SETTING FORTH AS A LEGISLATIVE FINDING OF FACT THAT THE SALE OF FUEL OIL IS A COMPETIT- IVE UTILITY SERVICE WITH THOSE UTILITIES PREVIOUSLY COVERED AND INCLUDED AND SUBJECT TO SAID UTILITY TAX; PROVIDING A PENALTY FOR FAILURE TO COMPLY HEREWITH; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEP- ARABILITY OF THE PROVISIONS HEREOF AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CIT "I' COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Sections 21-5, 21-6, 21-7, 21-9, and 21-10, pertain- ing to Utility Tax, Amount, Payment and Collection thereof, of Chapter 21, pertaining to Taxation, of the Code of Ordinances of the City of Clearwater, Florida, 1962, are hereby amended to read as follows: Section 21-5. Utility tax -- Amount. There is levied by the City on every purchase in the City of electricity, metered or bottled gas (natural or manu- factured), water service, fuel oil and local telephone service, a tax of ten per cent (1077)• of the charge made by the seller thereof, which tax shall be in every case paid by the purchaser, for the use of the City, to the seller of such electricity, gas, water, fuel oil or telephone service at the time of paying the charge therefor. (1) The term "fuel oil" as used herein shall include Fuel Oil Grades Nos. 1, 2, 3, 4, 5, and 6, Kerosene, and coal oil. Section 21-6. Utility tax--Payment, collection. It shall be the duty of every seller of electricity, metered or bottled gas (natural or manufactured), water service, fuel oil., or'local telephone service, to collect from the purchaser, for the use of the City, the tax hereby levied, at the time of collect- ing the selling price charged for each transaction, and to re- port and pay over, on or before the fifteenth day of each calen- dar nr bnth, unto the treasurer of the City, all such taxes levied and collected during the preceding calendar month. E t I 1 I r fuel oil, or telephone service, without, at the same time, collecting the tax hereby levied in respect to such sale or sales, unless such seller shall elect to assume and pay such tax without collecting the same from the purchaser. Any seller failing to collect such tax at the time of collecting r the price of any sale, where the seller has not elected to assume and pay such tax, shall be liable to the city for the amount of such tax in like manner as if the same had been actually paid to the seller, and the City Manager shall cause to be brought all suits and actions and to take all proceedings in the name of the City as may be necessary for the recovery of such tax; provided, however, the seller shall not be liable for the payment of such tax upon uncollected bills. If any pur- chaser shall fail, neglect or refuse to pay to the seller, the seller's said charge, and the tax hereby imposed and as hereby required, on account of the sale for which such charge is made, ;S 1 r=?; or either, the seller shall have and is hereby vested with the right, power and authority to immediately discontinue further service to such purchaser until the tax and the seller's bill shall have been paid in full. Section 21-7. Utility tax -- Records of service Each seller of electricity, metered or bottled gas (natural or manufactured), water service, fuel oil, and local telephone service shall keep complete records showing all sales in the City of such commodities or service, which records shall show the price charged upon each sale, the date thereof, and the date of payment therefor, and said records shall be kept open for inspection by the duly authorized agents of the City during business hours of all business days, and said duly authorized agents of said City shall have the right, power and authority to make such transcript thereof during such times as they may desire. Section 21-9. Utility tax--Computation period. In all cases where the seller of electricity, entered or bottled gas (natural or manufactured), water service or fuel oil or local telephone service collects the price thereof at monthly perids, the tax hereby levied may be computed on the aggregate amount of sales during such period, provided that the amount of tax to be collected shall be the nearest whole cent to the amount computed. For the purpose of Section 21-5 through 21-9 a sale shall be determined to be made in the City in everyinstance where electricity, metered or bottled gas (natural or manufactured)', water service, fuel oil and local telephone service is delivered to a purchaser residing within the City, regardless of whether the residence or business office or headquarters of the sellers be located within the City or elsewhere . Section 2. The City Commission does hereby make a legislative finding of fact that the sale of fuel oil in the City of Clearwater is a-com- petitive utility service with those utilities previously covered and included and subject to said utility tax. s a.`, Yta. Any person, organization, society, association or corporation, or any agent or representative thereof, who shall violate the provisions of this ordinance shall be subject, upon conviction in the Muni- cipal Court, to a fine not exceeding the eum of Five Hundred Dollars ($500.00), or imprisonment in the City Jail for not exceeding sixty (60) days, or by both 6uch fine and imprisonment in the discretion of the Municipal Judge. Section 4. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 5. Should any part or provision of this ordinance be de- clared by a court of competent jurisdiction to be invalid, the same shall not affect the.validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 6. This ordinance shall become effective immediately upon its passage.
